  1. Keep in mind you have to prove strong ties to Algeria - to show you have a reason to return. Once you file an I-130 it is tougher because now your wife and child are there in the US, you have shown you want to migrate, etc. So you will need some pretty strong evidence you will return. Algeria does not hand out visitor visas lightly.

  2. Waiting times for the first time will not be a reason for expedite. As I recall the denial you had was due to problems in your paperwork. This unfortunately does not qualify for one. Good news is you are 68 days in though... two months in is not great - but somewhat helpful. Best of luck for a quicker process! :)

  3. Of course we are not in the LA area, or even California... but we

    found the best way for my husband to really move forward with his adjustment was for him to get a job. It took a while, but he actually found one at a marketplace owned by a Muslim man where everything in it is is halal/permitted. This was a great place for him to feel comfortable, open up and find others from North Africa with similar experiences with immigration and getting used to life in America. All without needing to change his own beliefs and behaviors.

    Now with that said, he has yet to adjust to the way the women dress here in the US! rofl.gif
    I doubt he will ever become acclimated to that.

    Wow you do have some things going on there! :)

    I think consulting an attorney was a wise choice and all you can do at the moment. Although they cannot deny him on his illegal travels, it can make them highly suspicious he is doing what it takes to get a green card. Just do what you can to prove your legitimate relationship and keep the attorney close just in case. You are not too young at 21 to petition. They will also not worry about his religion, but they may question if yours is the same or not. It does help you are living with him over there, it most certainly cannot hurt. I would also suggest you make sure to attend the interview with him when the time comes.

  5. I would never admit to the first filing being fraudulent , just say you couldn't cope with distance and are wanting to try again to be together now.

    I would never admit to being proud of the fact I would lie to immigration officers to benefit myself. If they take this advice and lie, then get caught they are done. No chance. We are not here to encourage lies... it is against the forum policy and it really is not beneficial to the OP and their situation at all.

    Getting a good immigration attorney and being honest about the entire situation is the best chance of getting through the process. Coming clean now and getting it all taken care of is far better then fighting through it long term during every step of the way... only to be banned.

    U.S. Embassy Algiers Announces New Visa Appointment Procedure

    The Embassy of the United States of America in Algeria announces its transition to a new appointment and document delivery service for the visa unit. This system is being implemented at U.S. Embassies worldwide, and is designed to be more convenient and user-friendly, with all services included in one single visa fee. In addition to a new online system, Call Center representatives will be available for applicants to obtain information by phone.

    Starting August 16, 2013, non-immigrant visa applicants must follow this procedure:
    1. Visit http://www.ustraveldocs.com/dz to begin the process. You can also access this site through the U.S. Embassy website:http://algiers.usembassy.gov/
    2. Create a profile in the online system, then fully complete and submit the DS-160 application form.
    3. Schedule a visa interview at the U.S. Embassy.
    4. Attend your interview at the time you selected, making sure to bring the DS-160 and all supporting documents that apply to your case, as well as the appropriate fee for your visa type.
    5. If your visa is approved following your interview, your passport will be delivered to the location that you designated upon scheduling your interview at no additional cost to you.

    Applicants are advised to select their interview date and time carefully. Multiple no-shows could lead to significant delays in rescheduling.

    Applicants with existing interview appointments will still be processed under the old system and should attend their interviews as scheduled.

    Call Center representatives will be available to answer questions regarding the new system beginning on August 16, 2013. The Call Center phone number is 983 2000 20 and can be reached seven days a week between 07:00 and 19:00.

    I guess I would say you should consider cancelling the petition right now before the interview and reapply later - start over after you divorce wife one... and remarry wife 2.

    Even then, no guarantees with your other red flags and one cancelled petition.

    I agree your wife may just need to get used to life in Egypt. A price to pay for an American woman being fine with marrying an already married man. These types of things can and do happen!

  8. Yes, the CR1 process can easily take a year or more.

    The first step is the I-130 and getting the approval through the USCIS. This can take anywhere from 4-8 months (on average). Once that is done you need to get through the NVC which can take a month or more, depending on how quickly you respond to them and what they need. Once that is done you need to wait for the embassy to schedule an interview, which can take some time... and then the interview itself which i often scheduled 6-8 weeks out (depending on the embassy and availability). So there is your potential year or so right there. That does nto include any AP... which may or may not happen, which is an undetermined amount of time.

  9. Don't worry about a joint bank account at this time. USCIS knows that it is very rare for a foreigner, with no SSN, to be on a joint US bank account. This will come into play two years later when you apply for removal of conditions on your spouse's green card.

    For now, just follow "lost_at_sea"'s advice on other evidence which you can have.

    We did not have one either, it is normal to not have a joint account at this stage when living in two separate countries.

    Thanks friend for your kind words. It means a lot to me. Although the end result was not what we were expecting, at least we now know which direction to go from here. We are so relieved to be out of this black hole. So we thank God for that. I can't tell you how much we both have prayed for a decision to be made on our case rolleyes.gif .

    Do you think once our file gets back to USCIS it will be expired? I have been wondering how long before it gets back here, and weather or not I need to wait for them to contact me. I would like to start planing my trip to Algeria....

    I love, love, LOVE your attitude towards this whole thing. You are definitely on the right track lady!

    I would say you are safe to start planning your trip. Just keep in mind the differences I gave to you before between getting married in Algeria vs. getting married in Tunisia - as well as the time it takes. If you need any help at all remember we have all the steps ready to go for you! Just send me a message!

    You will also need to keep your safety in mind with everything going on over there right now.

  11. There are a couple of COs at the Algerian embassy. You will not know which one you get until you get there. And not to scare you but the "nice guy" was extremely nice to my husband but he was still initially denied.

    All you can do is prepare the best you can and be confident going in.

    I am soooooo sorry this was the end result of all that effort and waiting on your part.

    I would say definitely get married and go the CR1 route at this point. It would be helpful to know why the denial, so you may want to check into that so you can improve or correct the issue the next time through. Going this route will not take you much longer then a K-1 but is more likely to get through the embassy at this point. I also suggest you plan it so you can be at his interview next time through.

    Good news, our case was reaffirmed on May, so we overcame the NOIR without appeal, and now i have my next interview on Aug 2013, i just wanted to share it with you, you've been a good factual adviser yet positive, thanks so much MedRoni.

  14. Since you got married you are ineligible for a fiance visa. The I-130 is filed, however I assume you have incorrect information about your home, etc. if you filled it out here. I believe you may need to cancel the one you sent and refile - (which could be done now) with the proper UK addresses and information about your resident status. I am not 100% sure on that so if anyone else knows for sure - I am sure they will be by to help.

  15. I am concerned that even if she does obtain legal counsel, there is nothing that they can do, as she obtained the GC illegally. Although she was not aware of the situation, in Government rules and regulations, it does not matter. She obtained her GC under false pretenses, and she may be put into the process for deportation.

    It is possible, especially since she obtained the green card through an invalid marriage while on a few year overstay of a tourist visa... which is a big no no.

  16. So how did you come to live here permanently with no I-130 filed? You cannot just come permanently live and adjust status at this point. What you are trying to attempt is immigration fraud. That can get you a lifetime ban from the US. We cannot help you stay.

    Legally - You need to go back to the UK and let your wife file an I-130 at this point. Since she is not a citizen the process will take a couple of years. You might want to hold off on having children until you can be together

    And I STRONGLY agree with Darnell... 100% !!!

    Why would she not take the opportunity to help possibly prevent him from his illegal immigration and fraud attempts? After the divorce goes through and he loses legal status.... following in dad's footsteps, what happens when he gets the bright idea to marry another American woman here he does not love and wants to take advantage of just to hopefully help him change his status to legal? Do we know this would happen? No... Is it possible - yes. Therefore if the OP writes her letters and gives the USCIS/ICE the facts then THEY can determine if he should be allowed to stay or not. I see no need to cover his tracks for him, just because SingleDad2usc thinks this guy needs protected.

    Taal... I was so happy to see how strong you are and the steps you are taking... and not waiting around to be used any longer. You are a remarkable woman. I wish you the best for long term happiness when it is all said and done. rose.gif
