  2. Hello all,

     

    My son entered United States yesterday under IR2, my US citizen husband petitioned him but he wasn't adopted yet..simply a step parent. He is getting info on how to adopt him as soon as he can.

    My question is what's the next step for him so we can get him the citizenship? do we have to wait for the adoption paper to be completed? His IR2 visa will be expiring on March 8, 2018.

     

  3. hello all..so  I have an upcoming trip to the Philippines and booked my ticket online. I've booked my last trip to the same website so I thought when I booked my current one they have saved my information because it auto populated my name.

    I just noticed though that on my e ticket it only has my First and Last name and no middle name, while my full name w/ middle name is included in my Philippine passport. I googled it and it says the names must match exactly to board the plane....

    Does anybody had a similar situation and is this a problem especially when I arrive in the Philippines? Thank you in advance.

     

     

  4. Hello all,

     

    My son who is 9 years old is scheduled for an interview. I'm planning to get his medical done 2 weeks before the interview.

    My problem is I can't come home and accompany him because of work right now. I know a legal guardian can accompany him, I just need to send an authorization letter. 

    However, I'm worried though because my mom doesn't know how to speak tagalog and knows very little english. She takes care of my son so technically she would be the legal guardian.

    I wanted my brother to go with them so he can help my mom during the process. My question, how many people are allowed to come inside St. Lukes to accompany my son?

    I was wondering if anybody has the similar situation with mine or have answers to my questions.

    We've applied for my son's visa (IR2). Yesterday I've received an email from them stating they've already scheduled my son's interview for August 24, 2017.

    The interview checklist is showing this "You need to register your appointment online. Registering your appointment provides us with the information we need to return your passport to you after your interview. Registration is free. Click the “Register” button below to register".

    Do I still have to register online even though NVC already scheduled it for us?

     

     My son is 9 yrs old is it required for me (mother) to be there for the interview?

    I was just wondering who recently went back to the Philippines? I'm going back there this May and I've booked my ticket from CheapOair. My ticket is set for American airline and Philippine airline.

    My question, how many allowed checked in baggage for both American airline and Philippine airline? is it free? I also was wondering if I can carry 1 luggage and 1 tiny purse at the same time for carry on?

     

    Any inputs will be very much appreciated. I know I have to call the airlines but wanted to check on here first just in case somebody who had the same experience.

    We sent our petition for I-130 for my son in the philippines last April 22, 2016 we've received the receipt for it and the case number.

    I wanted to go home this year around October so I can process my son's passport. I'm only working for at least 7 months in my current job right now.

    I sent a request for a month of personal leave at work but HR told me to send them a documentation that will provide information showing that

    I am required to be there for the immigration process.

    I only have the receipt and it is under my husbands name because he is the one who is petitioning my son I am only holding a permanent resident.

    I don't know where to go from here I am not sure where to get those kind of documentation.

    My question is that does USCIS will ask for my sons passport first before they set an interview or approve it?

    and do I need to be present during the interview?

    If anyone already experience or have some information on how to resolve this issue I would really appreciate it very much.

  8. the K-2 follow to join had an eligibility to apply for that K-2 visa within a year past 2011-04-14 (from your K-1 visa interview date).

    Since you missed it, it's possible that your uscitizen husband (is he still around, you two still married?) can file an I-130 petition, to chase an IR-2 visa for your child. Figure about a year on the I-130 at USCIS, NVC doc take for the IR-2 visa application, an interview in Manila IV. Might be less if petitions for the PI are still being expedited.

    I would suggest you not be the petitioner unless you are a USA Citizen, it's a long slog..

    oh ok, yep we are still married. That's what I am afraid of smh. Thank you so much for the response, will research more about the IR-2.

    My I-485 has recently been approved, I am just waiting for my card now. I have a 8 year old son back home in the Philippines and we would like to get him over here. I know it is possible for a permanent resident to bring family members, however I am not sure if this is the right time? or if we should wait for me to get the citizenship first? Because I've read a lot of comments, that if I apply now under a permanent resident status it will take 3-5 years coz he needs to wait for a visa number? I really don't know.

    If it's possible and it will take less time, Is he eligible for a following to-Join benefits? I came in with a k1 visa. And are there any difference with filing/submitting the requirements for "Following to-Join benefits? and just submitting the normal papers for 1-30? If anybody here had the same experienced with this matter, I sure will appreciate your inputs. Thank you in advance.

    Im assuming since your in the state of Illinois....Chicago USCIS is processing your I485.

    Although mam good luck sa final round and lugar mo kasi as of December 23, 2014 this office is processing February 22, 2014 Filers. I thought Charleston is super delayed but yours is more than pala.

  11. With your EAD you can apply for work and get a driver license although it depends on the state with your at. Normally SSN will take about 2 weeks for them to mail you SSN card. With regards to your I485 it will also depend if you received an RFE that will reset the processing time back to zero and it will be based on the actual date they received the response. There is also a possibility that you will receive an Interview waiver just like in my case, if your in the Interview waiver club you have to wait for 6 months before you receive your GC.

    Like you we are in the same boat and almost days apart of filing our AOS. But kababayan dont stress yourself on the GC for us long as you have EAD and AP were good. Just keep yourself busy Ive been through that process before although in my case the circumstances are quite different.

    Just be positive it will be good and also keep warm.

    I'm from Illinois, I applied first week of december for my SSN, but until now my card is still not deliver. Unfortunately my state is kinda slow in terms of SSN. :(

    So sad, coz I need to get my SSN first before I can open a bank account, verified my paypal or even get the drivers license. I feel like, what is the purpose of the EAD you know, if I will be waiting anyway for my SSN this long. Like you kababayan I just applied for EAD, now I wish I applied for the AP also, atleast I could go home and see my family. That's what I am trying to do, I am looking for a possible jobs that will keep my mind out of thinking the AOS, but they all need SSN even online jobs. geezzzz.   12. It really depends on the USCIS office who is processing your case. California is processing faster compared to others but no one can really tell. There's one member in here who was scheduled after 2 months of filing and some also waited for 6 months. In my case I received an interview waiver so its a waiting game again

    Anybody here tried the e-request inquiry of the USCIS website? I want to send them an e-request but I don't know if that will messed up my papers or something. Anyway I've done my bio metrics last october 17, but my status in their website is still stuck saying "On September 22, 2014, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status"

    I am getting frustrated, because they send my EAD first but I can't use it yet, because I applied for SSN and even my SSN is taking forever to arrive :( so if anybody knows if it is okay to use the e-request I would truly appreciate it. I just want some answers from them, at least let me know whats wrong with it or what.

    I am wondering if anybody here have the same dilemma I am facing, right now. My EAD just got approve last november 25.YEY!!!

    Anyway, I was thinking if anybody got any luck, applying a job with just an EAD without the greencard. If you were able to get a job.

    What kind of jobs? and what paperwork other than EAD do they need?

    I'd love to hear some of your experiences so I could get any idea, and what to expect on finding a job with just my EAD.

    I didn't had the money to pay for my paperwork. My husband and i took a loan that we are repaying at the moment. I am not working and he is doing truck driving. He also had a previous credit card debt that we settled with the money from the loan. If we would have waited for his job to get us the money I probably wouldn't have file until now. At least now I know that in some months I will get my EAD approved and in production.

    Im glad your husband thought of your papers first before anything else..We have few debt too, and he already got a loan from the bank for the renovation of our house, I wish I have foreseen this issues 3 years ago.. I was just so blind and don't know what to be done before, that I let him handle everything. Now I am the one who is suffering from it :( Im not so smart (sigh)

    your timeline says you arrived on a K1 visa.

    1. did you marry your original petitioner? if so, then yes, you can successfully adjust status now.

    2. did you marry within the 90 days that you were given from your arrival? if you did not, you will need to file the I-130 as well.

    there is no time limit to file adjustment of status. there are many people who have overstayed in the US from their original visas, gotten married, and then adjusted status down the line. i've heard of people who've overstayed for decades, and then successfully adjusted status.

    that being said, without adjusting status, you are here illegally, and accruing unlawful presence. should you ever leave the US, you will not be let back in without the proper visa and may have to serve a ban first. so - don't leave the US until your greencard is in hand. without filing for AOS, you will also not be able to work. if you are stopped by border control or law enforcement, and it is found that you are out of status, you could be deported (there is a higher risk of this happening if you live or travel close to the border, as GirlfromCelebes pointed out). hence it's best to get your AOS filing done ASAP. good luck.

    why do you "guarantee" she will be denied? there is no time limit to file adjustment of status. sure, she is late, but she can certainly still file now.

You are aware of the rules im sure,like what others have replied to ur question u are now in big trouble whatever reasons you've had on why not filing it still you should have filed that long time ago,maybe you need to seek the help of an attorney goodluck to you.

    I actually don't know a lot of details about filing the AOS, we married before the 90 days period. It is financial issue,.. My husband doesn't have that much money like everybody else.. and it was more difficult because the fee was big and need in cash. :(

    Your profile says you came on a K1 in 2011, did you get married within those 90 days? You should have filed immediately after marrying! I agree that you should consult a lawyer as you are probably out of status and have complicated things by waiting.

    I am impressed no one has replied to your post yet.

    Are you right now in any type of visa?

    If your visa/permission is expired for one you are here illegally, and that can't be good. If you are ever driving and you get pulled over you could have problems because you are out of status. If you are legally married to a US citizen or resident and came in the country with a valid visa you shouldn't have any reasons not to file. I know money is sometimes tricky, but I did my AOS filing on my own, as I didn't have money to pay for a lawyer. I only had to pay the $1500 for concurrent filing (I did AOS from a J1 visa not a fiancee visa). There are many guides and people that can give you advice in this forum to know how to file.

    Can you explain your situation with more detail now to know why you don't want to file?

    I guess this is a old subject or maybe this was already been answered somewhere before, I just can't find any direct answer to it so I decided to post my concerns.

    anyway I don't know how to drive yet, so I don't have that problem in the future until I get my GC.

    I came here as a fiancee visa last july 2011 and we got married before the 90 days. We just been struggling with money to pay for the fees. Plus I can't help or do anything about it because I can't work. Good for you that you we're able to pay it on your own.

    I wish I could do that, or at least help a little bit. It is not we don't want to file, it is just a money issue. It is more a problem because we need cash :(

    You probably can get detained especially if you live near to the border- there was another post about that-. Remember, married to the US citizen is not a guarantee you would be free to live here without adjust of your status. I don't know what hold you up not to file for AOS yet, but you should know that you came to the US with fiancé visa, married within 90 days, and you have to adjust of your status to get the lawful permanent resident.

    I don't think so I live near the border, but It is pretty scary still to go out without any legal documents other than my passport... I married my fiance within the 90 days period.

    You are illegally present in the US and are accruing overstay. Worst case scenario, you could be detained by ICE and, theoretically, deported.

    I heard a lot about this ICE people and be deported. (sigh):(

  19. So sorry to hear that you can't find a Filipino community. I live in St. Louis but not Filipino but my suggestion is to go to the supermarkets around st. Louis. There is Jays International on South Grand, World Wide International Foods on Lyn Haven by 270 and Lindbergh. Let me know if this helps. Good Luck!

    I am actually losing hope, I guess I would never find any filipina around unless I go out and see more places other than every room in our house :( maybe I'll just wait until I could drive. Thanks for the idea tosh love. :thumbs:
