  1. He and his wife tried to get an expedited AP, but they were given the run-around at the immigration office. I think during this emotional time, the wife was beside herself with worry for her mother and made an emotional decision to leave without the documentation. They had not yet filed for AOS. Given the circumstances, I guess this is in their favor as I think that they would have forfeited the fee when she left two days ago.

    I have a friend who recently brought his fiancé to the USA on a fiancé visa and they married in August. The couple's daughter was just approved for a visa to join them. She planned to immigrate very soon, but until then has been staying with her grandmother (fiancé's mother.) This past week, the grandmother had a stroke. My friend's wife apparently had no luck getting an emergency approval on advanced parole, and she felt she had no choice but to leave to be with her mother and child. I wish they had talked to me before that decision and I would have consulted this forum first..... But they didn't know to, and she returned to Brazil two days ago.

    Is there any hope for her to not have to start the process over, or will they be forced to go the spousal visa route? I am meeting soon with my friend to find out more details (like if the AP application is in progress, or if it was flat denied). I am afraid I do not currently have any specific details...

    I appreciate advice from all you knowledgeable VJers. I know the outlook isn't promising. Sadly, my friend spent much of his disposable income on the first visa, his daughters visa, and airline tickets..... He is absolutely crushed right now, as is his family.

  7. Hello!

    My husband (Brazilian National) and I (USC) were married in July of 2013. We are just now getting around to registering our marriage in Brazil (largely due to confusion on the process and difficulty getting any response to questions from the Brazilian embassy in Washington).

    We would appreciate any advice from Brazilian/American couples who have successfully registered their marriage in Brazil.

    We have collected and completed the following forms and documents:

    • Marriage Registration Application Form
    • Statement that I (USC) have never married and divorced a Brazilian National before. (Instructions say: "- Declaration of marital status signed by the spouse, who is not a Brazilian citizen, must be notarized by Notary Public of the Consulate jurisdiction. " So I cannot have any Notary Public sign? If this is paperwork that we send in BEFORE scheduling a consular meeting in Washington, how do we get a Notary of the Consulate Jurisdiction?
    • Husband's Brazilian passport
    • My US Passport
    • Birth Certificates (Though, I believe I need to get more recent ones as they were issued more than 6 mo ago. I see an option for having 2 witnesses confirm that he is not married in Brazil if the birth certificate is older than 6 mo. Has anyone done this? The form is slightly confusing....

    • My decree of dissolution from my first husband (USC, not Brazilian)
    • Local Marriage Certificate
    • Consular Fee ($20 + $5 for additional copies) The website says to submit all materials by scanning and emailing them to a given address. If I do that, how do I PAY the consular fee which has to be done by a US Postal Money Order? I don't see a mailing address. Surprises me that they would want payment separated from the documents. Am I misunderstanding this?

    We would also like to schedule to give the final signature when the Brazilian consulate travels to our area rather than travel to Washington DC. (I hear the Consulate visits my city quarterly. Has anyone arranged this before? We cannot seem to get any response from the brazilian consulate. We get automated emails that a response can be expected in a couple weeks, and then we never hear back. (sigh)

    My husband (Green Card holder) and I are about to send in the RoC paperwork, and we would like opinions from VJers on whether we have sufficient evidence. Here is what we have prepared to send:

    • Cover letter, Check for $590, completed Form I-751
    • Copies of his Green Card, Brazilian Passport, and Ohio Driver's License
    • Copies of the Final Decrees of Adoption designating my husband as the legal father of our two sons.
    • 2013 and 2014 tax return transcripts showing our joint returns for the past two years.
    • A copy of the deed to our house showing joint ownership.
    • Copies of bank statements for our joint checking and savings accounts and our credit card statement.
    • Copies of our auto insurance policy and health insurance cards showing joint policies.
    • My husband's 401k listing me as the primary beneficiary of his account, and our sons as secondary beneficiaries.
    • Photos of our family dated from our marriage through the present time. (3 pages of pics -- 7 pics per page with descriptions and dates -- each page is organized by year.)

    Our credit card was mine before we were married, so I added my husband as an authorized buyer when we married in 2013. Statements only list me, so I submitted a screen print of the Authorized Users page. This past month, our credit card company began listing purchases by users. So Sept 2015 shows purchases under his name, but all other statements lump us together and only list my name as the primary user. Do you think this will be a problem?

    I have included the summary page of 7 checking statements and 7 savings statements ( September, January, and April statements for the years 2014 and 2015, as well as September 2013) I am hoping this shows that our account has been joint since our marriage. Should I print a statement for every month, or does a few from each year seem sufficient?

    I do have life insurance policies of which my husband is the beneficiary, but I do not have the paperwork showing this easily accessible in the next few days. (I had hoped to submit on Oct 22.) Do you think my evidence is strong without life insurance information? (Particularly the fact he adopted my children, making him legally and financially responsible for them. I would think that evidence would be pretty strong.)

    If more evidence would be prudent, I could delay our submission to collect more, but if this is strong enough, I would like to not delay.

  9. 1) I am a Brazilian living in the US for almost ten years. I definitely recommend that he files the "Comunicação de Saída Definitiva do País". I did it after one year in the US. The rules are on the "Receita Federal" website. http://www.receita.fazenda.gov.br/Aplicacoes/ATSDR/IRPFSaida2013/index.asp

    2) I have both a checking and a savings account in Brazil. It is extremely helpful to keep them. He would probably have to include the interest as part of his global income on the US tax return, but if the amounts are low, those would have a minimal impact on his taxable income. You should consult with a US tax specialist.

    3) I don't think so.

    4) I kept mine and I have no problems. Be sure he files the "Comunicação de Saída Definitiva do País" though...

    5) He will most probably have to pay taxes "in advance" when he files the "Comunicação de Saída Definitiva do País".

    I highly recommend you carefully read the information on the "Receita Federal" website.

  10. Hello Brazilian VJ'ers,

    My fiancé is preparing for his move here to the US, and we have some questions for those of you who have already made the move successfully. I have listed the questions below (some related questions, some not).

    1) I know that Brazilians living abroad do not have to pay income tax to Brazil since only residents must. Is there anything Brazilians must file with the Brazilian government to note that they are no longer residing in brazil? (I came across something called: IRPF - Comunicação de Saída Definitiva do País but I cannot figure out if this applies.

    2) My fiancé is considering keeping a bank account open in Brazil in case he needs to ever deposit money for his family to access. The account is a savings acct that does not assess fees even if we maintain a very low balance. Is there any negative to doing this? Could it affect him being seen as a resident and therefore cause him to owe taxes on global income? I have been told that IF the government considers someone as a resident, they must pay taxes on income from the US. I would hate for a technicality, such as maintaining a bank account there, to make him a resident in the eyes of the Brazilian Government.

    3) If he maintains an account simply for himself to use during times of visiting Brazil, is there any problem with this?

    4) We have been advised in 2 contradictory ways about whether to suspend or maintain his CPF. We have tended to think that maintaining the CPF is more desirable since suspending it could cause a multitude of problems with regards to renewing his brazilian passport, being required to vote even while abroad, and making purchases via online brazilian retailers. Any advise on this? Also, how does he keep his CPF from suspending due to inactivity?

    5) Will my fiancé need to file paperwork to Brazil at tax time (even if he doesn't owe the brazilian government anything). If so, what will he need to file?

  11. Hi, have almost the same situation, NVC send my case to embassy since June 20, I track it via and find it has been delivered on June 24th. The embassy still told me they don't have my case yet.

    can anyone teel me how long before the embassy send you packet 3? why they told me they don't have my file when it has been deliverd to them on June 24th?

    Well, it took about 10 days for them the acknowledge receipt of my paperwork via email....and they NEVER acknowledged it on the US Dept of State. When they said it had not arrived (when I knew it had), they commented that it takes a while to go through security scans before being delivered to the immigration sector.

    We never received a hard copy of the Packet 3. They only emailed us the packet information after we emailed THEM requesting it. They send this link:

  12. What a horrible little mix up! Especially when you are so close to finally having him here! I am so sorry to hear about this and I feel the same way about the line of communication with the consulate. To me it seems like their emails are worded and sent to only get them to stop bothering you, not to help. Because of that we had a mix up with some documents as well even though I had asked for specific clarification from the consulate! Luckily once they had all of our documents it all went really quickly! I wish the best for you as well!

    My fiance flew in to LAX last night at midnight! He's now spending some time with his sister before he heads my way! I am just so relieved that he made it! Finally he is on US soil! He's mine all mine!!

    Yes, let's hope that things move quickly from here on out. And my fiancé clarified for me that the Dr office ALWAYS had his home phone (rather than the cell phone he'd canceled, which I thought was the problem). But they had input his home phone incorrectly into their system... Ugh! Incompetence left and right!

    What a pain! I'm glad you are on your way to being done. Does you fiance actually live in the same city as the doctor? In our case, it would have been a huge hassle, since the nearest approved doctor is a 3 hour plane ride away. Having to go back after 2 weeks to get something resolved would have been awful! Hope that everything goes well and you are together again soon!

    He lives in São Paulo, so the Dr is just a bus, the metro, and a short walk away... It takes about 30 min to get there. So, in that way we were lucky. The problem should never have occurred to begin with. And when it DID, the Consulate should have notified my fiancé. It is insane that it required me getting my congresswoman to email them to get straight answers. We could have had this taken care of weeks ago. Our wedding is in 16 days....let's hope we dont have to reschedule!

  13. Well, My congresswoman's office replied today. The Rio Consulate told her that yes they received our exam, but the Dr had left out 2 papers and my fiancé would need to go to the Dr office to sign something. Apparently the doctor was notified of this weeks ago, but the cell phone number didn't work and he never tried to mail my fiancé. It isn't the Dr's fault that my fiancé didnt change the phone # on file in their office to his home number when he cancelled his cell service. However, if after two weeks the cellphone doesn't work why not send a letter to the address on file?

    I am grateful for my Congresswoman´s office worker who was diligent in getting information for us. I have to wonder, however, why the Consulate kept replying to our emails that all documents were received and we need to only await their decision. This system is broken! If they had simply replied to our emails that the exam was missing documents, WE would have contacted the panel physician and had this ironed out long ago!

    Well, my fiancé is on his way to the Dr's office now, and will send the missing documents via Sedex 10. At least we are on our way forward again.

  14. My fiancé had his medical exams done at the end of May, and his results were due on June 6. He went to get the results and the Dr told him that he needed the xrays again since the image wasn't clear. He went back to the lab, paid again, and redid the exam. All came back well, but unfortunately, the paperwork was not available in time for the interview. The doctor assured that this would cause no delay, but of course it would. We were certain that our case would be approved at the interview, but of course with a pending document it couldn't be.

    We had our interview in Rio de Janeiro on June 11, 2013. I went to the interview with my fiancé, and it went very smoothly. The lady who interviewed us was nice and asked a few questions. She said that all was approvable and we clearly had a real relationship. She canceled out my fiancé's tourist visa and told him that as soon as the medical exam arrived and was analyzed, and assuming the exam paperwork was fine, she would approve the visa and return the passport. I asked her how much time it usually took to approve once the document arrived to them. She said once they got it, the turn around would be quick, a matter or days. It all depended on how quickly we sent in the pending document.

    We received his medical exam two days later on June 13, and we overnighted it to the Rio Consulate. Sedex 10 confirms delivery in June 14 at 9:33am. We contacted the Rio Embassy for some time after and they said they had not received it. They said there were security scans that could delay it being delivered to the immigration sector. Finally on June 24, the embassy replied to our email as having received the documents. It is now July 3, and we have heard no update other than "wait for us to contact". I called up the US Dept of State and they looked up our case. They say the account has no note of having received our documents, they still show as pending.

    There is no way to phone the Rio Consulate immigration sector. They will only respond through email. Their response is vague, simply "await our decision". People I met at the embassy the day of our interview (who were in the same situation of needing their medical sent because, the same Dr as ours, did not have the exam papers ready in time) have already received their visa last week! And they sent their exam in after us!

    I do not know what to do. I have asked my Congresswoman's office to write the consulate via the "congressional use only" email. We have written emails to the Consulate asking if they require anything else and if there is a problem. We get no response. I worry that the computer (having not been updated to reflect that our documents are there) is causing a glitch where nothing gets done.

    Does anybody have any idea what we can do to get help? THe US Dept of State said they can't talk to the embassy either. They can merely look up our case and see whether the visa has been issued or is still pending. I am considering having the inspector general look into it. However, I fear that if we are on the verge of being approved, this might delay things further?

  15. My Fiance had to send back police certificates. He was given a green form and the address listed on the form is:

    Consular Geral Dos Estados Unidos

    Setor de Vistos de Immigrantes

    Av. Presidente Wilson, 147,Centro

    Rio de Janeiro RJ, 20030-020

    Fortunately he was still in Rio so he could personally bring the documents back. But that is the address they told him to mail them back if he chose to do so.

    Oh and this was last week so i'm sure the info could not be more accurate! Now you can breathe a little bit more. woooh! And CONGRATULATIONS!

    And what did they say to you exactly about the paperwork getting there later, any extra delay etc? i'm obviously very nervous too!

    Thank you! We sent the paperwork today. We were told they could not guess how long it would delay, but the officer said that it would not take long once she received our documentation. We sent it Sedex 10, so it should arrive there before 10am tomorrow.

    One thing I am worried about is that we were never given a green sheet. I only learned of this sheet from VJ. I wrote the embassy but didn't hear back. Wouldn't you know, that I return from the post office, and the just THEN received the email from the embassy. It says that the green form must be sent back with the documents. :( They emailed me the wording, but not the actual form. And the documents are already on their way. Hopefully this won't cause problems....

  16. Thank you. I read online that if pending documentation (such as medical) is needed, we should have been given a Section 221(g) "green form" detailing everything. We were given nothing. When you sent paperwork to the embassy, was it after the interview? Did you have any form given to you by the embassy to return with the documentation? Perhaps I am worrying too much....but I have read here on VJ that a form should have been given....

  17. Hello VJ'ers,

    My fiancé and I went to our interview on Tuesday. All went beautifully except that his medical exam paperwork had been delayed in the lab and we had to go without it. The lady who interviewed us said we are set to be approved as soon as we send the medical exam. We are picking up the exam envelope this morning and plan to send the documents via Sedex 10, but realized that we were never given a specific address. Has anybody here had to send documents to the RIO embassy? Should I just use the general address listed on the website, or is there a more specific address that will get the paperwork to the correct department more efficiently? I have emailed the embassy, but they have yet to respond.
