  1. hi can you please help with this situation ,

     

    60 yo naturized US citizen is applying for Permanent resident status his 30 yo son, who is NOT married but has 2 children under age 21.

    He (son) supports children financially and is legally (local country law) considered their father. Both children have his (son's) last name.  

     

    Goal: Son and his two children to be included in application, but for now only son wants to visit. 

     

    Questions

     

    1. how many I-130 forms should be filed? - from instructions I understand 1 I-130.

     

    2. what will be waiting time?

  2. HI all,

    My husband is US citizen and we're in the process of bringing hi parents to the US.

    We are in the stage when we have to submit financial documents (I864) and supporting documents (birth certificate, marriage certificate, military records, 2 photos) to the NVC. I understand we have to mail these to NVC? I'm I missing anything? anyone in the same situation? would appreciate your responses and guidance.

    To answer to the question: We filed in 08/2014 and got biometric app in 09/2014 and I got RFE last week.

    I noticed that they say, that our tax return papers that were submitted are "partial copy, with no evidence of showing that they were properly filed". Can you please tell me how you submit your tax papers, I mean specifically what pages, showing what?

  4. We filed I 751 in August/2014 and got a mail last week that the evidence we submitted does not sufficiently establish that we entered a marriage in good faith.

    They ask not to resubmit previously submitted docs and require:

    1. children , as a result of marriage, - We don't have any children yet

    2. evidence that we reside together and share responsibility for a common residence

    A. leases in both names , showing joint occupancy OR - we don't have a joint lease

    B. deeds and mortgages in both names showing joint ownership)- we don't have mortgage

    3. evidence of combined financial resources

    A. joint account- we have it and we submitted it

    B. joint insurance- we have it and we submitted it

    C. Joint Tax return- we have it and we submitted it

    D. Joint utility bill- we have it and we submitted it

    E. Joint loan- we don't have

    4. Evidence that we made estate, health, financial planning

    A.Will-we don't have

    B. Trust-we don't have

    C. power of attorney -we don't have

    5. Affidavit from third parties - we submitted from last time and we can ask more friends

    In our judgment, it is because of not having lease, loans, or mortgage. We are living at our friends house and we pay the monthly rent to him, that's why we cannot show lease, mortgage. We own 2 old cars. And we don't have children yet.

    We can submitted this years Tax papers, affidavits, and more photos. Any other suggestions? it says if we are able to submit enough evidence interview may be waived .Anyone in same situation?

    the reasons he wants to visit are.

    1. his brother just got married (my husband and me) and he just wants to see his brother's new life as married person (and "report to the parents").

    2. his kids have a hearing problem (the older one is doing great with hearing aid , but still working on a little one) and he wants to do some research if american medicine has something better to offer.

    3. and of course sightseeing

    do you think he should mention all the reasons? if mentioning reason #2 is not going to help him, he'd prefer not to mention it at all, as it's going to stress him for sure.

    any suggestions???

  6. My husband who is USC is trying to help his brother to get B2 to visit us in the US.

    I did some research and i know the steps

    DS-160 -> pay the fee -> get an appointment -> prove strong ties with home country

    I'd really appreciate if you could answer to my questions.

    1. can we fill out DS 160 form from the US for him? his English simply isn't enough to complete the form. what about the electronic signature part?

    2. can we pay the fee from here and make an appointment for him form here?

    3. He has a small business over there, but we are willing to cover all the expenses related to his visit. should we include my husband's w-2 form, as a prove that we can indeed cover the travel expenses?

    4. he is happily married and has 2 children 7 and 4 years old. We'd like him to stay and with us for 3 months. Any suggestions how to make a complete application for him???

  7. 1. No, it is not enough. You must show proof of current income, just as it says.

    2. Not required.

    3. Electronic media is not allowed at all.

    4. Things in English won't help your case.

    THey understand that newlyweds don't have a lot of financial co-mingling. They can always ask you about your daily lives instead.

    I understand affidavit is not a requirement. We have a friend, that is very close to us, we live in his house (that's why no lease, no official rent papers... he knows us as a couple when i first came to the US on work ant travel. and then again when i came the 2nd time on F-1. We are thinking he could be a big source of information if they need any, in the case what we present is not enough. We are students and we cannot really provide proof of financial linkages...

    How many pictures do you think is sufficient??

    What yo you mean by thinks in english wont help my case?

  8. Hi, i'm adjusting from F-1 and my AOS is pending,

    we are preparing the paperwork for the interview and i have few questions. I'd really appreciate your help on this.

    1. The interview notice states, that we need to present- letters from each current employer, verifying current rate of pay and average weekly hours, and pay subs for the past 2 months. . My question is if you submit the Federal Tax returns and W-2's and IRS printouts, isn't it enough? did anyone submit a letter from employer in the past?? or it is just a request for us??

    2. Affidavit from the friends: how many do we need to submit?

    3. Photos: How many photos do we need to have with us. we have so many, but everything is electronic. can we take the photos in the ipad? we sent some (around 10) paper photos with the application package.

    4. we'll have photos, phone bill, joint bank account, life insurance, some birthday cards (which are not in English). We don't have home lease, car, or health insurance. what else would you recommend to have with us??

  9. I got an RFE after my marriage based interview in August. The RFE came 7 days after the interview requesting more evidence of my birth certificate since i was born at home so i did not have official birth certificate hence only affidavit. I have replied to the RFE two weeks ago and it was deliverer two weeks ago. How long will it take them to make decision and any one with similar experience? please your suggestion will be appreciated.

    My knowledge is so limited on this whole AOS application thing. I am just trying to figure out everything on on my own. Hope people who are more experienced will answer to your question. GL

If your AOS is denied depending on the reason you may have an option to either re-open or re-consider appeal, you may be given a date in which you are to leave the U.S if you are already out of status. Someone else may have more detail for you on the subject. To add your timeline you go to settings(inder you name), then click on profile, then Change Signature and you type it in

    I'm currently adjusting form an F-1 and my AOS is pending. At present time I haven an active enrollment and a part time job on the campus.

    I have 2 Qs,

    1. while AOS is pending should I keep my active enrollment with school?

    I've heard, that once you submit your AOS application, your status with USCIS is changing from an F-1 into an adjustee, regardless of your school enrollment. Also, being an F-1 student is considered a privilege (it's not a right), so if you lose your status for whatever reason (denied AOS, criminal act...) your F-1 status will be automatically terminated. Based on this info it doesn't really matter if you have a current enrollment while AOS is pending. Am I right?

    2. can I continue working on the campus without an active enrollment, given that my I-20 is current, AOS is pending and EAD is hopefully on its way?

    i'd really appreciate your answers.

    PS: i walked in for a missed biometrics today and it went well.

  12. I agree with going on Monday. USCIS does not deny the application for at least 30 days after a missed biometrics. The ASC will generally reschedule another biometrics appointment as long as it's within 30 days of the missed one. They require a valid reason for missing the appointment. Make every effort to get this done ASAP. They may just do it on Monday, or they may advise you to come on walk-in day.

    My father in law arrived late in the afternoon for his AM biometrics last month. My wife was already running late and then they got hopelessly lost due to road construction. The ASC wasn't busy so they took him that afternoon. My wife was worried about the abandonment warning, but they said not to worry about it. Of course we haven't got a case status update yet, but at least they told us not to worry. :huh:

  13. In some places, the INFOPASS place and the biometrics place are separate. I would just go to the biometrics place first thing monday morning. I wouldn't wait on hold with anyone on the phone.

    I called them yesterday to ask what is the procedure if you miss your appointment. He told me i need to send a request to reschedule. Based on this, can i assume that my application still is in the process, and no action was taken for not appearing on the 14th?

    i'd really appreciate ur input!!!! still planing to go for biometrics on Monday morning. TX
