Today I received a RFE stating that I needed to provide 2 passport style photos. I sent the originals with the application along with my fiances photos, however they seemed to have lost mine. Needless to say, I over nighted the photos which should arrive tomorrow, 11-2-12.
My question is, how long will this request for evidence set back an approval notice?
Will my application go to the bottom of the pile now or what?
thanks in advance for your answers.....
i think that once they receive them, they will go back to ur file and update it. i dont think ur app will go to the bottom of the pile. they'll just go into ur application and update it as soon as they receive it. i've read on here that if ur mailing back an RFE request, u have to put the blue sheet that they sent u on top.
out of curiosity, how did u attach the 2 passport photos to ur application?

Hey, I'm in the same situation. My husband just got layed off his job and I have been paying for everything and today he told me he has to pay 350$ at the medical office and I got soo pissed cause Ive been telling him for months to be prepared financially and I can't understand how he had no $$ saved. I've given up soo much for this relationship and my interview is in about 2 weeks but I feel drained-financial and emotionally!! I love him but is it worth it and everyone is soo negative telling me that he'll just come and leave me
I guess within time well know
..
hi! my fiance got layed off his job as well maybe about a month ago!! and im the one paying for most of the stuff too. atleast ur interview is 2 weeks away! thats very exciting!!!
and dont worry, every speculates the same thing, about my fiance coming here then leaving me!! they're not forward about it, they just ask questions like are u sure he loves u, this and that!
and i just say the same thing, only time will tell

Oh my I can not wait until we have this interview and we get married because this long distance is straining. When I met him I was laid off my job, so I attend cosmetology school and I work in the salon part time and because I had all this extra time and extra money I was able to him every 3 months and everything was perfect but, then I got a new job and with this new job I am not able to take anytime off because I haven't worked long enough to gain vacation time so, I started seeing him once a year usually in January well, now I moved to a new city close to my job and put in more overtime, trying to prepare for the interview and pay bills, and missing him so much that now I stress more then ever. We argue all the time on the phone. Well, not all the time but, more then we ever have and we say we argue. I really mean I start the argument. He know longer have internet so we are reduce to phone conversations which is very hard because I so use to the webcam chat. With all this I hate what I have become because I feel so alone in this situation. It's only 6 more weeks to go but it feels like a year. Wow, I just wanted to vent that's all. lol.
u are not alone in this! im in the same situation! i told my fiance the same thing...that the reason we argue so much is because of the long distance thing. and yea, i mean IM the one picking fights mostly too :'(
but we keep telling each other that the distance is NOT going to win!!!
just be patient and take it ONE DAY AT A TIME! it helps me out, anyway.
just remember though, u are not the only one going through this! and u are soooo close!! keep being strong!! i just started MY process and have a long way to go... :/

i have yet to tell my fiance stephannye in the dominican republic, but this morning i read on the USCIS site that my I-129F fiance visa application has been approved by the vermont servicing center! january 24th-september 25th...the dates between my NOA1 and NOA2. just over 8 full months. so i waited, now i'm elated! haha
i cannot wait to tell her the good news when i call this evening. i guess now the wheels really start turning.
thank you here for all your support and good luck to everyone still waiting.
FELICIDADESS!! =)

Ok, so as I check Igor's list and watch my NOA1 date passing on CSC and meanwhile VSC is 3 months behind, I'm wondering how many people are in the same boat. Turns out, that there's a lot...like upwards of half a million applications for I-130 and I-129F...
Anyway, I've decided to write a letter to my congressmen now, not just for my sake but on behalf of all those who are waiting and will be waiting in the future. I believe in being proactive and that the squeaky wheel gets the grease so here goes...
I'd like to post my letter and get some feedback before I send it. Please read it down and tell me what you think. If your only response is to say "it won't do any good" please keep your comments to yourself. It can't hurt and even if it doesn't speed up my personal application, if it gets things moving for someone in the future then it will still have done something good.
Ok, here's my first draft:
Dear Senators/Representatives:
Lately in the news there has been a lot of attention regarding illegal immigration but I am writing this letter on behalf of millions of American citizens who are trying to LEGALLY immigrate their spouses and families and are forced to wait and wait due to bureaucratic delays.
With the assistance of publicly available records and nonpartisan web forums that provide user submitted statistics, it has become clear that there is a disparity in processing times for immigration applications.
I-130 and I-129F applications account for well over HALF a MILLION immigrants who are spouses, children, siblings, and parents of US citizens. Currently there are two servicing centers, one in California (CSC) and one in Vermont (VSC). Based on available information, CSC is approving petitions that were submitted in June and July, a reasonable processing time frame. I, along with many others had our applications sent to VSC. Mine was received on June 28th, but based on projections, instead of being processed any day now, it is likely I will have to wait an additional 4-6 MONTHS before my application is even pulled off the shelf. The listed processing time on the USCIS website for these applications is 5 months. That is unfortunate, but many petitioners are waiting in excess of 7 months. We need to do something about this.
We all understand the need for security, and for strict policy regarding illegal immigration. And none of us are opposed to being thorough in preventing individuals from scamming the system. But this burdensome waiting period is due simply to mismanagement.
Please consider what it would be like to have a member of your immediate family - even your children or spouse - in a foreign country, unable to visit, while you wait for paperwork to be pulled from a shelf. In that 6-12 months you could be enjoying your life with your family there with you. We have all paid the fees and we would like to see our applications processed in a timely manner so we can be with our loved ones as soon as possible.
I hope that you will take some time to have your offices bring attention to this matter with USCIS. I am currently circulating a petition, but consider that for every one of over half a million visa petitioners per year, there is at least one family member waiting to be reunited with them.
this is great! you can also emphasize the fact we're paying all this money! and not only that, just the fact that we're paying for such a slow process that is not even guaranteed because some official can easily deny a petition if they feel like it!

Thank you for your response. I already have my suspicions as to what caused the red flags. It has more to do with the Chapter 13 question. But that was a situation that had nothing to do with my fiance. It was long before he came into the picture. I never followed through with it and it was cancelled.I mentioned it to him before but didnt think it was improtant. But I could see how that must look to a CO. My fiance presented western union receipts (which I thought would show that I am capable of supporting him when he is here) but I had been in Chapter 13. That wouldnt look too good to me either. Still it wasnt what it seemed.
Now if it did have something to do with the fact that I hadnt taken my children, then that would say to me that there is a major flaw in the system. How can someone who has children and never taken them to visit (some right here on VJ)get approved and we get denied for the same? Makes no sense. Still if that was an issue then that would be something that should be explained by me. Keep in mind, this man has been in our lives for well over a year now. My kids interact with him in their own way. So the next time, we will share the yahoo conversations between him and the children. We will show the daily texts and phone logs for them.
As far as drug rehab. I dont see where that is requested nor required. However, we will do the random drug testing as I feel that is a great idea. By the time the USCIS has received the packet back from the Embassy, the approval will have expired and they will not reopen an expired case. And we are not planning to marry until January. We will then file at the end of January. My parents and stepparents will be in attendance along with a couple of my siblings, my children and my cousin and a close friend. If we had known the things we know now, we would have gotten married last year. This is a learning process. Unfortunately, sometimes life teaches us lessons that we have to pay for before we learn.
Again...thank you so much for you help. GOD bless you. Miracles, love and blessings.
you and ur fiance will be just fine, reason i say this is because u guys are in love and not giving up! in the end, it will work out just fine!
and if u dont mind me asking, what was the question on chapter 13?
-
Yeah it's totally crazy. Aparently it's to make sure a woman isn't pregnant by her ex husband. But in Chile if ur a woman and u want to get remarried right away you have to take a pregnancy test and if it's negative you can get remarried. I'm like wow.... Haha but whatever I'm getting married in NY. Haha I was just so nervous about his divorce not being finalized.
Is it the same reason in DR why women have to wait for divorce?
oh ok! i honestly dont know why that is in DR. i was married before, separated in 2006 (6 years ago!) and i JUST finalized my divorce last month in august. sooo my plans were for me and my fiancee to get married in DR next month but ran into that whole "have to wait 10 months" thing and im like uhhhh NO! lol!!
so we went through the K1 fiance visa process instead. i live in FL and i want my baby here already!!

Hey guys, I just got my email notification!
so yours should be on their way
thats awesome!
!
-
Thank you so much for your reply. I was just nervous bc we only waited for the divorce decree not the divorce certificate so that confused me at whether or not his divorce was registered at the civil registry.
Thank you!
in the dominican republic its the same way. the men can marry right away after a divorce, but the women have to wait 10 months! isnt that crazy?!
but i think, if ur marrying here, there shouldnt be a problem...
