  1. I would advise her not to lie about why she is in the the UK. Just be truthful. The immigration guys are trained well and if she's nervous when she lies they'll pick it up. We had big issues the first time she came,when we first met originally. They nearly sent her home. They called me and asked all sorts of questions.

    If you have funds maybe send a bank statement to her? That way they know you have funds to support her. Cause they will ask how she can afford to not work for 6 months etc.

    Tell her to have the NOA1 etc.

    That's what we were thinking. The downside is obviously we're unsure when our K1 will come through entirely, but a return ticket will help her get through as I can't be with her. We can always just change the date on the ticket if need be.

    So it's a good idea to be totally upfront about her visiting her foreign fiance? I know offering up this information can be risky for a foreign fiance visiting the US, so is it equally as risky for an American citizen to do this? I imagine that if she shows documents relevant to the K1 it shows that she's bringing me to the US and not planning to overstay, right?

  2. Sorry for the delayed response. Been a busy few days.

    She wasn't working. She didn't have a return ticket at all, Only a one way. I think me being there at the port of entry was a huge help.

    Just have her show all of the documents for the K1 application and a return ticket.

  3. Shouldn't be a problem. My fiancee has been in the UK with me since last October waiting it out. We left and went to France for a week in December which restarted her 6 months.

    I came back with her from the states through immigration which i think helped. They could send her back though if she has no ties to the states. If she comes with a big bag, with no return ticket,no job in the USA and no house, it will look like she want's to come and live here.

    We explained that we had applied for the K1 to the immigration officer and just basically said we were waiting out our time here until the visa arrived.

  4. So she was able to go to Australia before the NOA2?

    I can always have my parents forward me the NOA2 if it comes while I am away. It just really sucks spending time apart, especially as you both just want to get on with life together you know?!

    We went to Australia before we filed. We filed after we came back to the US.

    You don't even need the NOA2 until you file for the AOS ( after marriage). We still haven't even seen it. It was sent to her sisters house in the states.

    I know what you mean. That's why we haven't spent any time apart for 2 years :D

  5. Thanks everyone. Am I able to go to the UK with him before the NOA2? I do have the NOA1! :) so far so good.

    My parents are co-sponsoring us so I'm not too concerned with the financial situation, I would have them file the appropriate forms and have bank statements etc.

    How did all of you arrange your wedding dates? It's difficult when you can't know for certain when you may get the visa. We are hoping January will be the date!

    We did exactly the same thing you are doing. We were in Australia together for a year and then i went to the US for 90 days with her. That's when we filed. Then she came here in October and has been here since. They gave us no issues when we came back. (We explained that we had applied for a visa so we could settle in the US). We even went out of the country in December for a week and came back.( she got another 6 months) Again, no issues. Just explained the situation to them.

    We also had her Mum sponsor us.

    Don't stress too much. Make sure you go to the passport control desk with him,though!!! It helps a lot!!

    We are having a court wedding with just us two and then doing a full ceremony later in the year when my family can go. It's impossible to plan anything in this process. :wacko:

  6. So me and my fiance filed our petition August 13th and STILL haven't got our NOA2! Not only that, but 10 days ago our baby came prematurely! He will be in hospital for at least another month, but just wondering where we go from here? Father is on the birth certificate, so can baby be classed as both US and UK citizen? Also, do we have to inform anyone? US embassy or CA office?

  7. Alas it is so. We all have/had the option to move to another country to be with our spouses, yet we chose to have them take the role of immigrants.

    I am yet to see anyone here confess to their absolute exhaustion with the USCIS and declare him/herself an emigrant.

    We make choices and they have consequences.

    I never had one.

    Since you are being smart, I shall leave it at that.

  8. I think that is where you acted differently from most. You knew it was a long wait and you went for it in that frame of mind. That is a sign of a mature relationship.

    I really question the integrity of any relationship that is threatened by or succumbs to the wait of a bureaucratic process. If one can't weather the visa process, how can one expect to face an entire lifetime together?

    I love when people say this. How can you compare living with your husband/wife to waiting in different countries,time zones etc for the visa.

  9. One question I ask. I'm planning on Seeing Nadia in Belarus this Summer. I'm only allowed one Visa a calendar year to Belarus, unless we were married. We wanted to get married before filing this I-129f, but understood the waiting time was less for a K1 visa. I wanted to know if we got married, what effect it would have on our petition. He said he couldn't give me legal advice. He did have a list of lawyers that could advise me, if I met the income requirements, Funny, if I met those requirements. I wouldn't be able to sponsor Nadia.

    You would have to cancel the I-129F and file for a CR1. Basically, you would be back at square one and have to wait months for that as well.
