  1. That is why I suggest looking for a battered women's shelter so that they can help you to take the next step. You do not need his permission to apply for a divorce in California and can do so whenever you choose. If you have been married less than 5 years and have no children you can look into a Summary Dissolution of marriage here: http://www.courts.ca.gov/1241.htm

    He cannot force you to stay in a marriage that you are unhappy in and if he is physically abusing you then you should look into a restraining order on him to protect yourself. Do some digging in the website that I included the link to above. Your state is listed as California so that is the information I am giving you, please let me know if that is not correct.

  2. From what you have written, I would divorce and move on. It doesn't sound like the healthiest of situations for you to be in and you sound unhappy from what you wrote. I don't know all the technicalities of what you next steps would be but if he is "putting his hands on" you, you should look for a battered women's center and look into getting some help before the situation escalates any further.   4. Hi there,

    1. I was able to list my husband's name on the cell phone line that is his, you may try to do that. I am unsure if all providers work the same way, but Verizon did allow for that. Also, I had some trouble getting my husband's name added to some of our bills without a social security number so you may want to reach out to the companies that you use and see which ones are willing to add you to the bill and which require you to have a social security number first.

    Would your husband be able to add you as a user to any of his credit cards? You could do that without a social and it shows proof that you have combined assets.

    Maybe someone more knowledgeable can answer the rest of your questions...

  5. Hi Regan,

    If they are asking you to list all your children then that is what they want you to do. My son also has a consular report of birth abroad and is a US citizen but I still listed him because that is what they are asking for. I left the A# blank because as you stated, the child doesn't have an alien # since he/she is a US citizen. You are not going to mess anything up by giving them too much information so definitely include your daughter's info.

    As for part 5, if you do not have any disabilities that require the types of assistance that they are referring to then you would check "No" in each of the three boxes.

  7. I am going through the same thing with my husband's DUI currently. We are filing on November 22 and I would be very interested in hearing what someone who has been through this before has to say.

    I was in the courthouse a week ago and the woman charged me $25 for 9 pages. 1st page is ther certification of the document, 2nd and 3rd are the charges "Criminal Complaint", 4th and 5th are the enrollment notice for his alcohol program he must attend and "Proof of Enrollment Certificate", 6th and 7th are the "Minute Order" with the particulars of who was involved with the hearing and the plea and sentence, 8th and 9th are the "Order of Probation.

    I told her specifically what the documents were needed for and she told me that this is what they typically needed for immigration purposes.

  8. Basically the same as you did for filing for AOS for the K-1, but they will need to also file an I-130 petition for an immediate relative(spouse in this case) at the same time. Point them to the guide here on VJ that I linked above.

I had sent them to that page in the first place but was worried that I was missing something because their situation was so different from mine. Glad I was not as lost as I had thought I was.   9. I have a friend who married his long time girlfriend while she was visiting him in the USA. It was sudden and unplanned. I would appreciate if someone could tell me do they then file for the K3 visa with the current address in the USA or back in Sweden at her original address. Now that they are married, she does not wish to return home so we were wondering if the US address would be correct.

    Any help is appreciated. Has anyone done this route before?

  10. If you don't have proof of having them all, then they will give them to you at the doctor's visit. Whether you choose to get them before and have the documented proof for your doctors visit or have the doctor do them at the time of the visit is up to you. It may be cheaper to get them ahead of time if you can. My husband did his at the doctor's visit and it worked out just fine. Be sure to get the copy of the form that he uses so that you don't have to go to the doctor again in the USA if you are doing a fiance visa. That form is proof that you have done the medical within the last year.

  11. Seems like a good sign to me. She was talking about the Removal of Conditions process (ROC), basically the conditional green card you (or your husband?) will be granted will be valid for 2 years because you were married less than 2 years ago, which is pretty common for people adjusting from a K-1 visa. During the 3 months before the expiration of the green card, you will have to file for ROC in order to keep your permanent resident status and to receive a 10-years green card.

    It looks like you were right! I got the notice of approval email while I was at work this evening... Thanks for the help in staying upbeat and the great info. :):thumbs:

    P.S. It is my husbands, but I am the one that stresses out. :lol:

  12. There were no missing documents. I had extra copies of everything, she did take some of the new copies. Everything she asked about we had. I might have been a little light on the photos, but I have submitted so many throughout everything that they kept giving them back when I would try to submit more before today.

    At the end of the interview she told us how cute our son was who we had taken with us, and told us that we would get a decision with directions in it if we were approved and that to remember to renew a certain form because the greencards issued were only good for two years. Then she sent us on our way.

    My husband and his ex divorced in 2010, but they hadn't been together for much longer than that, not since 2006. Where he is from people aren't big on all the paperwork, so when they went their separate ways it was their way of divorcing. He and I started living together and when we started talking about marriage, we decided it was time to make the divorce official so that we were free to do as we pleased and get married. So it wasn't until 2010 that he was officially divorced, but on all our paperwork in Costa Rica we were living in a civil union or as it is know there, we lived in a "union libre".

  13. I need to vent/stress! We just returned from the green card interview for my husband today and I feel like it didn't go so well. The agent wasn't very friendly at all and seemed quite jaded. She wouldn't look at my husband when she asked him questions, and though he speaks english fluently he had trouble understanding her because she didn't enunciate and had an accent herself and didnt' bother looking at him to answer any of the questions. She kept asking about his ex wife which was ended a long time ago and even though she had all the documents that she could have needed with all the information she kept asking us about dates for everything. She didn't ask us about our relationship together at all, but about his past and all she seemed to want was dates over and over again... I am so frustrated and stressed out by the interview, that was the worst experience yet... I just hope that we are approved. I came home and checked on USCIS and there is no update so far.
