Can we petition under special circumstances for my husband's 17yo brother to come to the USA to live with us? His brother's father died two years ago and their mother died last week. The brother now has no parents alive and is living with his 23yo sister who is not taking care of him or ensuring he finishes school. My husband was legal guardian of both his sister and brother about 10 years ago until the father got his act together.
I brought my husband in 2013 on a fiance visa and we have changed status to a 10 years green card holder at this point. We are beginning his citizenship process right now.

I changed mine from a lawyer to myself after sending off the first packet during a fiance visa process. I love this forum, they are very helpful and you can typically search the forum and find answers to most questions that you can come up with.
I'm not sure exactly what your question is. If you want to do the process yourself, then get rid of the lawyer and do it yourself. I also suggest filing taxes asap since you will need those as proof of income during the process. I am not sure how to go about getting a Tax ID # for your wife. Maybe ask the lawyer before sacking him/her or possibly someone here has a suggestion.
Good luck!

The US embassy in Costa Rica allows the significant other to go with the applicant. Reviewing the consulate reviews would have told this and also helps with suggestions and things that may not have been thought of. Just a thought for the next person who may read this. I hope all went well! They were a pretty easy embassy from some of what I have read of the others. I did go with my husband to the CR embassy and I felt that it helped.

congrats. please update your timeline.
thanks
I was waiting to use the computer since this isn't the easiest forum when using a smart phone.
Thanks for the reminder I guess...

Since they haven't updated the form I would send it out ASAP so that you are moving forward with the next step. Also, I see on the page on USCIS that they say what looks to me that previous editions of the form are accepted.
Edition Date02/07/13. Previous editions accepted.
Or you could call and ask them:
National Customer Service Center (NCSC)Call toll-free 1-800-375-5283 or 1-800-767-1833 (TDD for the hearing impaired)
Good luck and good catch on the date!

My guess would be that the minister is not familiar with the process (even if he may think he is). You should follow the directions here on Visajourney and do the AOS. I brought my husband here on a K1 visa and immediately following our marriage we applied for AOS and everything went as it should and two years later we are now Removing Conditions.
Follow the path set out for you here and do not let him confuse you as to the next steps. Congratulations and good luck!
-
I do not foresee this being a problem and think that you will be fine. I myself have a complicated name and am still traveling with my passport showing my maiden name and I haven't had any problems. I do bring my marriage certificate with me when traveling internationally just in case anyone should say anything.
They are not going to make a big to do about the hyphen. The names are correct and that is what matters most.
-
Hi,
I cannot promise I am correct and maybe someone else out there could tell you if I am not, but I would put the correct information on the form. The actual date that she entered and what not, then attach a sheet of paper explaining what happened and why the dates may appear differently due to the fix for the issue that she encountered.
Congratulations on the marriage!

After calling and getting a hold of someone, it seems the case had been missed and they then sent out the letter the following day with a date for the Bio finally.

I didn't ever send the boarding passes, nor did I make a copy of my passport stamps, but I did send the itineraries of my flights... We were approved. We also heavily front loaded the K-1 application with other things too though. I think you are on the right track though, itineraries and passport stamps shows that you were there.

We finally called in for the third time Feb 2 and were able to get escalated to level two and speak with someone, but since my husband wasn't there by the time I got the call back 2 hours later they couldn't help but tell me that he had to call back with a fax number and they would fax the Bio Letter to him... He then called the next day and the woman on the phone told him that they had only started his paperwork on Feb 2nd so he would have to wait a couple of weeks... Sounds strange but at least the NOA1 gives us a year for them to figure it out...
for now it's the waiting game. I agree with Ms Hogan that at least he and I are together for this part.
-
I am sure you have filled these out by now, but you are perfectly fine using 15 meters south of Mas x Menos and addresses such as that. We did the same for my then fiance and everything turned out just fine.
They just want to make sure that there are no gaps in anything and that what you submit this time matches what you submit next time. I kept copies of everything and it has come in very handy.
Good luck!
-
Your information gives me hope that maybe that is what is happening with my husband's biometrics letter. Sorry you are having to deal with the delay issue as well, but thank you for sharing what is going on with us.
-
It is always best to fill in the spaces when possible. I used N/A for not applicable in many of the spaces but in the case you refer to above, when it requires an amount you are best to use $0.
For #11 I wrote that "since we intend to marry, i will be supporting (fiance's name) in all ways until he may legally work in the USA. This will be a permanent assistance until he may legally work."
Good luck!
-
Congratulations! That's great!

Hey there, I have the same situation with the Bio letter. It must have been sent by now but it hasn't arrived. I have called USCIS and spoken with them and they want you to wait until a month from the date that you received the NOA1 before calling and requesting to have a Bio letter sent out again.
-
I can't wait... we keep checking the mailbox daily to see if the bio has arrived but no luck still. The waiting really is the worst part of it.
-
Sounds like a great plan! Congratulations and best of luck to you both in your journey!
-
Congratulations! That is great!

Glad to help a fellow in need. I would definitely look for a support group or a women's shelter and see if they can point you in the right direction. It is always nice to have people behind you for support.
-
Maybe someone with more knowledge could some input on whether they would take it or not... I would think that they would but I don't know for certain.
-
You have made it this far and can do anything you put your mind to. If you don't already have a job start looking and get one, start researching your options and look for a support group nearby. Make some friends that live nearby and develop a support system, but most of all get out of that relationship!
-
You know what you need to do and putting it off is not going to make it easier... It will be hard but you will have a chance to actually be happy!
