    Can you give some more details:

    1. How long were you married? how long you lived together?

    2. What evidence did you provide, please provide a list.

    3. Did your spouse parents were at your wedding and you hanged out together? Did you provided pictures?

    4. Are you from the same country and how much is the age difference?

    5. Did you provided a statement letter at the time you file I-751 waiver explaining what happened?

    Please provide these details so we can understand?

  2. I Originally filed joint I-751 in Oct 2011 and then in Oct 2012 I filed for a waiver (based on divorced) because we separated and I filed divorce as she left our home.

    In Apr 2013, I went for interview for originally filed in Oct 2011 , which was filed jointly. The officer was nice and my attorney converted on basis of cruelty and officer said that he will merge the two files , he has to wait for the other file and I should be getting my 10 year card in about a month.

    But I am still waiting and I went with an info pass 2 weeks back , the person there told me that I am scheduled for another interview based on divorce waiver. I am confused and thinking what do to. Should I wait more or open service request.

    Please Advise

    I will appreciate your help.

  3. I originally filed Joint I-751 in Oct 2011. Sent another I-751 waiver in Nov 2012.

    I had interview in April 2013 for Joint I-751 , my attorney got it converted to waiver based on cruelty and the officer said that I will get my 10 year GC in a month and he is ok with everything and he will wait to Merge two I-751 . My attorney congratulated me.

    Today i went in for a infopass, and the person there told me that I have another interview for the I-751 waiver I applied in Nov 2012. I described that I had it approved in Apr but the person told that me that this interview is for waiver I-751.

    I am very confused about the whole situation. Please Advise. I will appreciate.

    I had an interview for my I-751 waiver today. My wife made false compaints on me. We were together for 3 years.

    Originally filed together in Oct 2011, My attorney filed another I-751 in Oct 2012. The interview went pretty well and I got approved based on cruelty.

    My attorney made a mistake and filed another I-751 instead of converting, so the officer has to wait for the last I-751, which he says it will take 3-5 weeks.

    My attorney also says that based on Cruelty I am eligible to file for N-400 based on 3 years, dont have to wait 5 years. Does anyone know about it?

  5. So my interview is this week.

    My Attorney really turned out to be a very unprofessinal guy. He is trying to hide and I have no contact. According to him : "If we get a response back from local office then our interview is rescheled and if not then its rescheduled too. I think he is lying.

    I am going to the office on thursday anyway to just appear and if they wana interview , i will go ahead. I cant go like this. I have nothing to hide. I have all the evidence and I am very confident.

    Please advise and thanks for your answers.

    We were together for 3 years and I filed jointly initially and then sent waiver last year. I have interview next week . I have very strong evidence and paper. My divorce is not final yet, but hopefuly will be done in a couple of weeks.

    My Attorney initially agreed to come along with me to the interview, now he is saying that he cant as he has a different case to go for at the same time and he then sent a Rescheduling letter.

    Then he found both interview are in the same city and same time, so he sent letter last week to reschedule the interview for the same day but different time.

    I have got no reponse from USCIS till now. I went to local office and they didnt give a clear answer if it will be rescheduled and i have interview next week. I have following options;

    1. Should I go to the interview next week and appear for interview even if my Attorney is not able to come along?

    2. Should I not go to the interview and let it get rescheduled for another day.

    3. Should I go to the local office at the time of interview and request rescheduling?

    Plese advice , i am really confused.

  7. Hi All, I am originally Nov 2011 joint filler. But I sent waiver in nov 2012. Now interview is in mid Apr.

    My Attorney has already sent the request to reschedule yesterday and it was delievered today. Now I have no choice but just wait. I am also thinking to go to local office to talk to someone and get this sorted out incase the officer doesnt recieve the letter.

    I think they interview alot more than only 2 , last time i was there were 20 people in the room for interview at one time.

  8. I have a I-751 interview date, my application was converted to waiver from joint filing. My Attorney was initially able to make it , but now he is saying he has another urgent date and wont be available on my interview. He wants to reschedule the date. If I do, how much it will delay my case and when i will have another interview.

    Or should I look for another lawyer? I am confused. Please help.

    My attorney filled I-751 waiver with information about previous jointly filled one and a copy of it. May be they have to sync files OR may be they send same generic interview letter to everyone no

    matter if its a waiver ot joint.

    I have a final court date of Oct 7 2013, if my wife does not come to an agreement. If we agree, it can take 2 weeks from now on to get final divorce decree.

    I am just worried , my attorney is saying i am in good shape , I need moral support may be :-).

  10. I recieved a letter for interview (Apr 21) from local office. I converted my application to Waiver in Nov 2012. The Interview letter asks for bringing Spouse and evidence.

    I cannot do that as our divorce is pending. How to deal with this situation, any experienced visa journey members, please advice, I am worried. Thanks.

    Got First 2 years GC: 01/16/2010

    3 years turbulent marriage because of my in-laws, daily interferenc, wanted me to cut off with my family. Other issues with wife.

    Went to 2 marriage consulars. They gave me written statements.

    Filed Joint I-751 in Nov 2011 with following evidence:

    -> joint tax returns -> Joint Lease -> -> Joint Bank statements -> Affidavit from friends -> Joint Medical and dental insurance -> Auto Insurance

    -> Rental Insuarnce -> reciepts from Cruise trip and other trips --> Driver License copy showing same address --> joint Electric, Phone and Cable bill in her name

    -> Tons of Picture from 2 years on different occassions with family and friends.

    Now things changed this year, my wife told me in Aug 2012 this year that out of anger she has filed a false complaint on me to USCIS, while my I-751 case was in process.

    I inquired about my case, its pending and waiting interview, still no word on interview.

    In Sep 2012, i was out of town, she left our home with her belongings and does not want to return. I filed for divorce stated she deserted me.

    Divorce is pending.

    I filed Waiver I-751 in Nov 2012, with accumulated evidence form this year. I recieved another extension letter for one year.

    I filed I-751 first in Nov 2011 jointly and Bio on 12/13/2011. It was pending ,but in 2012 we had serious marital issues. My spouse family was interferring in our lives. lived 3 years together. I also came to know that my spouse has made false complaint to us-cis.

    i filed for divorce and filed waiver in Nov 2012. They sent me a second NOA on 11/14/2012. But no Bio yet.

    I called them today and they issues a service req and will reply in 15 days.

    I am not sure how my case will proceed? Any input will be appreciated.

    Is it ok to travel out of the country for 2 weeks now?

    If anyone has been through waiver like this, any advise ? I am stressed :(

    Thanks for the reply. I spoke to an divorce attorney. He is saying that it will take 6 months to process divorce.

    Its taking a while to process I-751 , I may get divorce papers till when my turn comes after at VSC(VSC 10 month processing).

    My immigration attorney is going for this option:

    -> That one entered into the marriage in good faith, and that one was subjected to physical

    battering and/or extreme mental cruelty; and/or

    According to him I will get another extension letter and will submit affidavits and copy of audio and other evidence.

    I dont see another option right now.

    I need urgent advice.

    I got my conditional green card in Jan 2010. I have been married for 3 years now.

    My relationship with my family revolved around her parents. They degraded me so many time and interfered in every single thing. They have treaten me many times that they will deport me and I actually have recording once time when I had argument with my wife. They treated me like ######.

    -> Actually my wife lied and complained against me to immigration in july last year, accusing me of fraud. But I have tons of eveidence that is not the case. I spent 50K on my marriage and everything was out of love.

    -> We applied joint I-751 in Oct 2011.

    --> She got a call in May 2012 from immigration regarding the complaint, she said everything is fine and that we are together.

    --> I got a letter from immigration for second interview and then she revealed about the complaint. we had a argument and she left the house.

    I consulted an attorney and he is saying I should go for waiver as she is not reliable . Any advice regarding waiver? as I am not divorced yet. Thanks in advance

  15. Hi Guys,

    I have an update on my case. I opened a SR on Mon 17th Sep. I got a letter from local office saying that my case is delayed because they are scheduling a second interview .

    This is out of blue and I am shocked , as I submitted a lot of evidence like:

    1. Lease Agreements

    2. Tax transcript joint filed 2 years

    3. A lot of Picture

    4. Medical, Auto, dental and rental insurance copies from last 2 years

    5. Joint Banks statements from saving and checking for last 6 months with lot of transactions.

    6. Mexico criuse trip pictures and reciepts.

    7. Both Driver license showing same address.

    8. Affidavits of 2 citizen friends attesting to the marriage.

    We are from the same country and same age. I am surprised why they need a second interview?
