  1. this was the reply given to me by the US embassy when i emailed them that i wanted to apply for an extension for the approved fiance visa petition:


    what should i do next - just schedule the medical exam and interview this month? but what if there's no slot - file it next month and it will still be ok anyway? i filed the petition in oct.2012 and got the NOA 2 april 24, 2013. it expires on aug. 26, 2013... thanks for the input.




    As you are aware, an approved fiancée (K1) nonimmigrant visa petition is only valid for four months from the date of its approval. Consular officers may revalidate the petition several times. Each revalidation is good for an additional four months.



    The petition is routinely revalidated provided the officer concludes that the petitioner and the beneficiary remain legally free to marry, and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.



    However, if the officer is not convinced that the U.S. citizen petitioner intends to marry the beneficiary, including instances where no action has been taken on the application for a year (i.e., a visa interview for the applicant and submission of required documentation), the petition may be returned to the approving U.S. Citizenship and Immigration Services office.



  2. my thanks to all for the helpful tips. i emailed the Manila embassy this Saturday via their IVManila email address. Being a holiday and a weekend back in PI i would not expect a reply till Monday, when hopefully they will be able to read my email. And have a detailed response to my request in about 7 days. Will they send another notice to my fiance and to me as to a new priority date? i will definitely post any updates as soon as i hear from USEM. God bless!

  3. so we had an approved petition dated april 24, 2013 and the 4 month approval period is up till aug. 26, 2013. problem is me and my fiance had a falling out as in break up but i did not cancel or withdraw the petition. we finally fixed things up around july of this year, but he was still undecided whether to resume our plans or not. finally today he made up his mind and said we'll go with our former plans. problem is i haven't started any paperwork for the next phase of the journey which is for the medical exam and interview phase coz he seemed undecided and on my part, i was a bit emotional and heartbroken to even focus on our petition. is there a way to apply for the extension of this petition or should i just withdraw and start all over again? i'm at a loss on what to do at this point and i know i had a fault in this! i need some suggestions or tips. thank you all in advance.

  4. i just have a question: we have a MNL case number already but when i inquired at NVC, they said that the case still has to be forwarded to the US Embassy in Manila, we're still undergoing administrative processing - when does this petition usually get to the consulate? also, is packet 3 being delivered via email nowadays? when should i start calling USEM in Manila to ff up our case? i checked our status online on the USEM Manila website and it says the petition is in transit to the consular section and that NVC has provided us with an interview date. we were approved as of April 26. we got the hard copy in the mail around May 2. sorry if i ask some silly questions. but thanks for all the info in advance.

  7. i filed for our fiance visa in october 2012 and was received by the USCIS and assigned to VSC on Oct. 2, 2012. I got our NOA 1 dated Oct. 4, 2012. I called up USCIS sometime 2 weeks ago and they said that they were processing oct. 1st filers. i told the customer service representative that i want a service request put in coz it was beyond processing times if i checked on the website it said the processing times were at 5 months. i was told to call back in a week. i called up this morning and the CS told me that as of today they are processing papers that were filed last week of september 2012. we're still in initial review. i wanted to tell him that on the website it said that it was at 5 months. so i'm gonna call up again next week - which is the first week of may and we're entering our 7th month since filing and still no word yet on the status of the case. i hope that we can get even an RFE just so we know what's going on with the petition. congratulations to october filers who got approved... good luck on the next steps in your journey!

  8. will the k1 visa application be affected if for example there was an application for the fiance (i.e. immigrant petition filed by a permanent resident parent for a child more than 21 yrs of age?) my fiance's mother had applied for him and i believe the petition is still active. it's for an immigrant petition for an unamarried child of a permanent US resident more than 21 years old. will this have a negative impact on our petition?

  9. i'm flying off to see my fiance next month to celebrate easter with him - after 7 months of not seeing him. we're gonna visit my relatives back home and i get to meet his father too in their province. i hope by the time i come back in april from this vacation we could hear some update from VSC in this case, our NOA 2. even if we get an RFE that's good news - at least we know that someone is reviewing our case.

  10. thanks for all those inputs! it's just that lately there have been a lot of "suspicious" chest xray results at St.Luke's and i guess before our beneficiaries go there for the medical exam steps should be taken not only to have a negative result, but in all in all, stay healthy and keep regular check ups so that TB can be detected early and treated early if needed.

  11. i've noticed that in most forums, there seems to be a high rate of positive TB screens at St. Luke's. how can we detect TB at it's early stages? we can go to our local hospitals and have a chest xray done, however, even if this is negative, if you submit to the St. luke's xray testing, and it shows that you have infiltrates they will suspect it is TB thus submitting the applicants for sputum testing and culture. so the question is how can act early to detect it before the medical exam so that if there is something suspicious, we can have it treated early and then go to our medical exam with peace of mind? however, divulging our medical history can make them suspect us of TB or other third word related illnesses that need to be treated before giving a visa to travel abroad. i remembered when i went for my own medical exam at st.luke's - being a nurse and exposed to the medical surgical ward of a hospital in the Philippines can make me susceptible to such diseases. it is expected however that pinoys will have TB whether it is latent or active in one's system because we are exposed to it. if our resistance is low, extremely low, the disease can kick in since it is an opportunistic bacteria. our government sure has health programs to detect, prevent and treat TB. but then like i said even if you're negative from the cxr results taken from an outside hospital, once you have your medical/physical exam at ST. Luke's this hospital will accommodate the cxr that they did on you, even if your films from outside showed negative. any thoughts about this?

    i meant that being a nurse working in a philippine hospital i too was worried that if i had cxr done at st.luke's they might see something suspicious. but everything came out negative. that was in 2003.

  12. thanks! so we were planning to have a copy of the i129 packet, NOA1 letter, and also a letter from his company certifying that he is scheduled for a vacation and is expected to return on a specific date. and it's just best to be honest about the nature of his visit, and emphasize that he knows we're not supposed to get married during this visit, but we will get married when the k1 visa petition is approved and he has that visa in his hands. isn't it disappointing that due to a lot of people who have committed fraud, people who are genuinely in love can't be together even for just a short time? oh well he'll just try it once and see what happens. i really don't have high expectations, but i can't stop him from doing this. que sera sera.

  13. hi, so we have our NOA 1 already. still waiting for NOA 2 which may be in April or beyond April next year depending on the pace of the VSC. My fiance wants to try his luck applying for a tourist visa for the US while our petition is in progress. will this affect our petition if he does apply for a tourist visa? he had been here before in 2011 for 6 months on humanitarian parole and went back home in time before his visa expired. we just need some feedback from you guys before he can actually apply for a tourist visa sometime in january. he does have a job and he is really needed by his company as a marketing officer. in fact, their company is quite busy during the first quarter of the year due to annual physical check ups of different companies which are their clients and which are my fiance's accounts. he has been denied tourist visas before he had been approved for the humanitarian parole. thank you for any suggestions or advice you could give us at this time.
