What if my mother is cought by immigration. Then she would be put in removel procedures does she have a better chance in CANCELLATION OF REMOVAL! and demenstrate hardship for her under age child?

My sister is a us citizen she will be 21 this september ..can she file for our mom now or does she hav to wait until shes 21? Our mom lives in the US. she enterd in 1991 so what forms will my sister have to file?

thank guys well i have been calling uscis and my wife has made 2 infopass all uscis tells us that they will send it out they been saying this for like 3 months already but we call nvc and nothig its not there.....this the only thig i got from uscis is the approval notice i have attached

On december 15 , 2012 my i-130 pettition was approved. uscis sent my wife an aprroval notice.but we have not receved a notice that it has been forwared to NVC. Its been over a year now and my case has not been forwared to nvc what can i do to resolve this issue. Thank you

so i got my I-130 approved notice but now what how do i now when it gets transfered to NVC. and is there any thing i can do to speed up the prosses

is this an err of USCIS or is it fine... i got my approved notice and it says this: the above pettition has been approved. the perosn this pettition is for will be notified sepatately when a decision reached on his or her pending adjus ttment of status appication.
i live in mexico not in the US
what can i do to fix this?

if your husban is a US citizen i suggest that your husban file for an I-130.. go to uscis.gov to download the file and after your I-130 gets approved your case will be sent to NVC to get an interveiw at the embassy at Ciuda Juarez if you are found inadmisble you will have to file an I-601 waiver. this dose apply of course only if your married ...good luck

For the fist time Yesterday i called nvc and told them its been almost a year since me i-130 has been approved by uscis

On Dec 13, 2012 USCIS informed me that my I-130 petition was approved but never recieve the I-797 notice of approval by mail. And NVC never contacted me either. So on Oct. 18, 2013 I filed an i-824 duplicate notice of action nevertheless yesterday I found the original i-797 that was sent to me. However I have questions
1. When does NVC contact me or do I have to contact them?
2. NVC has no record of my case in their system? Does that mean its my error or USCIS´s error?
3. What is the next step I have to take now that I have my original i-797 notice of approval?

the i-824 is just so i can get the approval notice...because i got approved on Dec.15,2012 but my wife never received the notice..it might have got lot in the mail.....so now thats why we have to flie I-824 to request a dupicate of the original I-130 approved notice... once we get the approved notice what are the steps we need to take other than to file I-864? ......and will my wife have to be present with me at the interview?

never in a gang or any gang tattos.....i got a tatto but its just my name ........so when does my wife have to file i-864.....right now my wife is about to flie I-824 to get the Notice of Approval. when she gets the approved noticed is that whe she files I864 or can we go ahead and do it now

My husband was brought to the states when he was a kid too. He lived and completed high school here in the states. he voluntery left back to mexico about three years ago.
these are the steps we took so far
i-130 =to establish our relationhip
i-864 =to show i make enough money to support my husband and our son at or above poverty level.(i sent in three years of my income tax return)
DS-220 =visa interview fee that will take place in ciudad juarez
before the interview in CJ my husband had to get his biometrics done (fingerprints) and get a physical/vaccinations from a doctor in CJ. there is only two clinics you can go to.
there was no additional fee for fingerprint appointment but the doc visit i think was around $500 for my husband.
my husband passed the visa interview in CJ but the officer told him the next step we had to do would be the i-601 waiver. the officer will check off why you are inadmissible/ "banned"
for my husband it was because he lived in the states for more than 1 year. you will probably get two marks...one for living in the states illegally for more than a year and your felony.
the waiver is $585 and your wife will have to provide evidence/proof along with a hardship letter stating why she needs you in the states and you also have to write a letter.
when you send in the ds-220 application also include a CERTIFIED copy of your court depostition. your wife will have to go get your criminal record and then go to the court house/city hall to get your court deposition (what happened in court. judgement on the case)

questions
1- for the doc visit was that $500 pesos or dollars

my wife got all the cout records my case is as following:
in my last cout hearing for carrying a concealed weapon i was sentence to 2 years of state probation
after 3 mounths in probation i found out that my friend who was also living illegally and also in state probation lk me. got pick up by ICE after attending his monthly vist to the probation office. at that point i got worried and quit showing up to my monthly vists at the probation office and left florida however after a month i came back. i knew i messed up and wanted to do things right. my probation officer had issued a warrant for my arrest..so i just turnd my self in at a gas station with a police office.
i was in the county jail for 2 mounths and then i got a court hearing. the Jugde reinstated me to my probation as normal. the very next morrning affter i got out of jail i went back to the probation office. my probation officer told me to wait in the waiting room until he got ready for me. that was unusal for me because i was the only one there. he then came out and told me i hade an ICE hold and that immigation had to interview me. after that ICE put me in a detetion center. i fought my case there for 13 months because ICE wanted to deport me. however at my last immigation hearing the Jugde granterd me Voluntery Departure undrer the( INA law)
affter that on Apirl-2011 i tried to enter the US once agian and i was cought by border patrol...i ask to see a immigaton jugde again and aftere 2 mounths in a detention center i was granted volutery depature by the IJ....
now my wife filed an i-130 for me and i hope i still have a chance.

well yea uscis sent my wife Hadey an approval notice at her home address at Brownsville Texas. however she never recieved it....and do you know what kind of waiver(s) I might need?

in May,1991 my mom took me in to the US, at the time i was only 2 years old. i grew up in Clewiston Florida, in 2007 i was convicted with a felony-carrying a concealed weapon: I meat my wife Hadey also (who is a usc) in highschool. on August 16,2008 my son was born in FortMyers Florida and in 2010 i was granded voluntary departure by an Immigartion Judge after being 13 mounths in a detention center. in April, 2011 i tryied to go back to the US without inspecton and i was cought by border patrol. i asked to see the immigation Judge, so i was put in a detention center and on june,2011 i was granted voluntery departure once again..
now i live in mexico and in August,2012 my wife filed an I-130, we got response via internet on December 15, 2012 it said that the I-130 was approved. however the Notice of approvel never got to me, it must of got lost in the mail or something. uscis told my wife to file I-824
Application for Action on an Approved Application or Petition i didnt have the money at that time but now i have it and my wife plans to send the i-824 this month. I dont know what to expect in CJ for my iterview so i wanted to ask yall to give me a heads up of what to expect in my iterview..will i be inadmisible and if so what kind of waiver(s) do i need to look at ......

Hello, my wife filed a I-130 petition and on Dec. 13 2012 it was approved, due to the fact that it was some how lost in the mail and never recieved. I had to work and get a extra 405 to pay a dupllicate copy of the approval notice. Now im ready to file for my duplicate and I would like to know if I could also file the I-212 to reenter the U.S because previously before my wife submitted the I-130 I was order voluntary departure twice by Immigration Judge. And I feel somehow the I-212 applies to me if theirs anyone out there that could help me with this matter. My I-130 process went wrong its been 4 yeas since my wife filed a i-130 and my case cant get transferred to NVC all I got from USCIS is a I-797 Notice of action that say the following " The above petition has been approved. the person this petition is for will be notified separately when a decision is reached on his or her pending adjustment of status application" the problem is I live in mexico not in the US..
all we wanted was to file a I-130 and go though the normal process like everyone else who filed an i-130 while there spouse was out side of the US.
therefore we were expecting to receive a I-797 Notice of Action of our approved I-130 that states the I-130 has been moved to NVC but instead i get " The above petition has been approved. the person this petition is for will be notified separately when a decision is reached on his or her pending adjustment of status application"
Nothing that says any thing about my case going over to NVC! How do I correct this what can we do we tried every thing info pass, iqury after inquiry we called USCIS numerus times and thay dont know know whats going on! we call NVC and they say they dont have anything and that they dont receive cases for adjustment of statues
can anyone help me on this! Thank you
