  1. My wife passed her naturalization test about a month ago and the USCIS rep administering the test said to report to the SS office to update her citizenship status. She has had her SS card for a while now. However, looking at the SS-5 I don't see anything that would update her status after just passing the test. Shouldn't we wait after the ceremony to update her status? I'm thinking she misunderstood the rep that was administering the test.

  2. So we finally got a piece of mail back from USCIS per filing my wife's I 751 and they are asking for more evidence to establish a bonafide relationship between me and my wife. "However, you have not established that the marriage upon which you were granted conditional status was entered into good faith."

     

    Per the application the following was sent in that shows both of are names on the information:

     

    Marriage certificate

    Bank account statements

    Loan statements

    Three years of tax returns

    Car insurance idntification

    Copies if driver's licenses that have the same address, of course.

     

    My wife is not on the mortgage statement because I was told by the bank I would have to refinance our house to do that...crazy.

     

    Either way, what else should I send in to prove that we are married in good faith?

     

    I'm so pissed off that we waited this long for an RFE.

     

    And, we applied for green card renewal 15 months ago and still don't have that....wonderful.

  3. Well well well...after numerous calls to the USCIS telling them that after 4 months we still have yet to receive the 797 stating that my wife's conditional resident status has been extended for 1 year (her I 551 expired in Sept 2016) we received the extension notice in Saturday's mail.

    Not sure if they actually 'admitted' their oversight and sent it or it actually took 4 months to get the receipt after filing in July.

    We were due to drive 10 total hours to the Jacksonville field office on Tuesday to get the Ad-it stamp to her passport but can cancel that.

    We were on are way to Colombia for her brother's wedding and without this 797 receipt notice or the Ad-it stamp she would not be able to re-enter the US.

    Now we are good to go and can cancel the Jax appointment....good stuff!

  4. Thinking....I'm trying to get an appointment at the Jacksonville office but they have no openings for the next 14 days (max they give you to look) and neither do the other FL offices.

    If we do not receive the 797C notice of receipt that extends her I-551 for one year, do not receive her new I-551 before we travel (longhsot anyway) to Colombia in December, and can't get an appointment in time....how would she or could she reenter the US?

    Her Colombian passport is still valid, has FL driver's license, work authorization card (little value for reentry), SS# card, and marriage license.

    My issue is that we get back into the states and she can't enter.

    Can cancel the trip if needed.

    Any thoughts?

  5. Does anyone know the phone number extension numbers when you call the Jax office?

    I have the main number of 1-904-245-7899 but the voice prompt give you no info on talking to someone there but does give you the option of "If you know the extension dial it now."

    We never received the 797C receipt notice after the 2nd interview that grants her another year on her I-551 after expiration while we are waiting on her new card.

    We are traveling to Colombia in December and either need the new card, which I doubt will get here in time since the Aug interview, or the receipt notice 797C that states the card is valid a year after expiration.

    Again...anyone know the extension #s to talk to someone there?

  6. Well...after talking to the USCIS rep they told me they have no record of sending me the receipt notice from the 797C with the 551 extension info. I thought I recveived one but that was propbaly me remembering the one from the fist interview, not the second. So we have to drive to Jacksonville to get the original 797C NOA stamped with something or other. Apparently, they can't send the late 797C receipt or send a copy of the 797C receipt.

    Joy..10 hours of driving for a 1 second stamp,,,

The rep told me that on the I-797C form that gives us directions for the interview, states on there that the interview process and the stamping of this interview form after the interview extends the I-551 card expiration date for 1 year.



    I don't see anywhere on the I-797C form that extends her I-551 date by 1 year. I called USCIS because her new card is not here yet and we had the interview in mid-August.



    The rep told me that to get back into the USA she still needs her expired I-551 card and to bring the I-797C form to show the immigration officer.



    But again, I don't see anywhere on the form that states the extension of the I-551 card for a year. They are supposed to call me back per a set-up call back appointment so a second level officer can talk to me.



    Any thoughts?

  9. My wife is from Colombia and she now has my last name on her driver's license, SS card, work authorization card, and green card. Her Colombian passport is still in her maiden name. Today is September 12 and we just found out unexpectedly that we are going to a wedding in Colombia on December 7.

    I have been 'told' that the wait times to get her passport changed to her new (my) last name is about 3 months. We can't afford to that be 4 months at this point....need info on how to do that also.

    Soooo, can she still travel to Colombia and re-enter the US with her Colombian passport that has her maiden name which is different from all her other US issued identification? I am pretty sure that the airline just wants her ticket info to match her ID info on that end but it is the passport info that I am concerned about.

    If she can't travel with her Colombian passport, what can be do and if possible expedite her Colombian passport name change?

  10. 100JH thanks, that's what it looks like.

    Incidentally, when looking online the info says call the State Department. Did that and they told me to call USCIS. Did that and they told me to call US Customs and Border Protection...no answer and emailed, no answer yet. However, everything looks like, and from what a British coworker told me, just need a Green Card but will have FL driver's license, her W2, bank statement, etc....that might be all meaningless but will have it either way...

  11. My wife received her Employment Authorization Card yesterday.

    Under the Terms and Conditions it reads : None

    On the bottom of the card it reads: Serves as I-512 Advance Parole

    Expiration: About a year from now.

    I know this card:

    Grants her the legal right to work

    The I-485 (AOS) is still pending

    This is a 'combo card' that allows her to travel and re-enter into the United States while the I-485 is pending

    Question:

    She is considered a permanent resident and not a conditional resident, correct? (No to be confused with 'citizen')

    This question might have to get re-posted in the social security number thread:

    When we applied for her SS# it was too late to have her last name shown on the card as my last name. Can we now have her name changed on the SS# card to my last name with this card? The card does show her new (my) last name correctly.

  12. When filing forms I-131, I-765,I-864, I-485, and G-325A how should my new wife's name read as? She has her social security card with her pre-married last name. We can't change her last name to my name at the SS office because we were married with less than 14 days left until her K1 expires, at least that is what they told us.

    Either way, what form(s) should her pre-married last name be used and what form(s) should her new last name be used? By pre-married last name I mean her last name as it appears on her I-94 when she entered the US.

    I am thinking we will not send in the I-131 until her last name is officially changed to my last name. Traveling out of the country with two last names would be an issue. Correct?

    The I-765 application for employment has an entry for her new last name and other names used (maiden name) so I am thinking we can use her new last name and pre-married last name here.

    The I-864 affidavit of support, use her pre-married name?

    Form G-325A, use her pre-married last name?

    Form I-485, use her new, my last name?

    Sign each form accordingly to her name used on the form.
