My husband's case has been sent back to USCIS and when i called Dept of State for a status update this morning, I was told that I should be recieving a letter from USCIS with further instructions. She also said that they will either ask for more evidence of relationship or they may have me come in for an interview at the USCIS office. It's not set in stone yet and I don't have a problem doing this but i was just wondering if this has happened to anyone else and what it was like.

    It was a nice way to say you will be under admistrative review. this means you will have 180 days to gather all the evidence you can to prove that your relationship is bonafide. This letter they talk about will be mailed in the 180 period and is titled Notice of Intent to Revolk. You will have 30 days after you receive this letter to submit your evidence. After they receive this information they will take 60 days to review it and let you know if you are re-approved or denied. Then if you are reapproved it will be sent to NVC to set up another interview. This is where we are at waiting to see if our evidence is good enough.

  2. On July 16,2012 I called the NVC for the first time and was told that i had been assigned an mnl number on July 13, 2012. I have since been calling the NVC each week since on Monday, Wednesday, and Friday asking about the status of my case. Each time I was told it was under "additional processing". Today on my Friday call, I was informed that my case was under "administrative processing". Can someone please explain the difference and what additional steps have to be preformed now. I am so trying to remain patient but the process seems to be one delay after another. Please help me to understand.

    Usually this means that the USCIS will review your case for around 180 days then you will get a notice of intent to revoke. Then you have 30 days to submit any evidence to prove your relationship. Then after you submit this evidence they will take 60 days to review your evidence and give you a reply of denied or re-approved. After that it goes back to NVC to the consulate and another interview is given. This is what time frame we are on and waiting to see if our evidence is good or not.

    Ms. case is currently on hold under Section 221(g) of the Immigration and Nationality Act (INA) for administrative processing. The department of State is continuously working to improve processing and expedite visas, and we appreciate Ms. patience. Please be assured that we will contact Ms. as soon as the processing is complete.

    180 days from the notice you should receive a notice of intent to revoke which you have 30 days to reply to with proof of your relationship. Then an additional 60 days for them to review that evidence. Then 30 to notify consulate for interview if evidence is accepted. Then 30 days to prepare for interview.

  4. Does anyone have any tips for getting through to a live person at the consulate in Casa? I've been calling for 2 days and all that happens is it goes straight to a voicemail greeting that says the voicemail box is full (without even ringing). I've tried the main number, and I can't seem to get out of the auto attendant loop. Any words of advice would be appreciated!

    The only way I have been able to contact them is via e-mail. I have never been able to talk to a live person. They are very quick in replying to e-mail, usually next day.

    You don't need an immigration lawyer to do the process. I am an American woman married to a Moroccan man for two years and we have done all the paperwork ourselves. Good luck.

  6. Hi everyone. i need help on what is exactly needed for me to go to the medical at st. lukes. I already paid the visa interview fee and made and appointment. the NVC has sent the approved petition to Manila over the weekend and it is now en-route to USEM. does anyone know if we have to wait for Manila to mail an official letter to us before we go to st. lukes? also what else is needed? please advice. we are just trying to do the medical asap since my schedule only allows me to do it in the next week. thank you!!!

    Some countries want the medical done within a 30 day time before the interview.

    It took 200 days for a response from CSC for us. They don't seem to keep to their timelines.

    You need to have a medical examination dated within 30 days of interview.

  9. I was talking to my stepsister who got married to a guy while he was in the US on a tourist visa... they got married and simply adjusted status, no problem. A coworker of mine called a USCIS office and the person he called actually TOLD him to get his Russian Fiancee here on a business or tourist visa, marry her, and then file for adjustment of status.

    I feel like a moron now. I've been without my fiancee for almost five months now, may have to postpone our wedding (and thus ensuring her parent's can't make it because they already bought tickets for that date) because the process is taking so long. I just responded to an RFE and am still waiting for the NOA2. Why didn't I just marry her when she was here on the visa waiver program to visit me? Why is it easier to do it the wrong way? Separating couples like this is a hardship on relationships, finances, and plans for the future. We need to fix this already...

    Anyway, this is just outright whining, I'm sorry, I just had to vent. Every day I check my email for something from USCIS, even on the weekends when I know it's useless. I just want to see her again but I can't exactly afford the 2 grand it costs to fly to Holland and back.

    It is a very hard process. It will be two years in August that we started our paper work. I was lucky enought to take three weeks off in March to April to spend with my husband, but it is hard to raise the money to go there and also have the vacation time. We were separated for 1 year and 8 months by the time I could have the time and the money. This system needs to be worked on. I understand how you feel, but I beleive you are in for a shorter ride than I. Good luck and keep the faith.

  10. I looked for the answer here but could not find the answer. Does anyone know how long it takes a petion to be returned to the United States from the Embassy. I called UCIS and they do not have it. They told me I had to wait 120 days. Does that mean it takes 120 days for the file to be returned or do they have 120 days to review it?

    It is 120 to 180 days for them to review it. Depending on the consulate it may take between a month to 3 months to return it to USCIS.

  11. Just got an email saying "On July 16, 2012, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E)"

    I am dying of happiness right now!!!! However I do not know what to do. I planned a trip to go see my boo for a week at the begining of august (have the tickets already) and now that I receive this email, I do not know if it's best to postpone that trip. How long is it taking from this stage to the interview??

    I wouldn't postpone your trip. Time frames differ so since the tickets are already purchased go and celebrate with your finance because you don't know when the process will be over.

  12. My husband was denied his visa at the interview. Can anyone tell me how long before Islamabad will send our file back to NVC? AND the procedure which will come next? Trying to find all possible information on appeal.

    HI I can give you a rough idea on the timeline. After the case goes back to USCIS they will take 180 days to send you a NOIR. When you receive this you have 30 days to send any proof of an established relationship. Before , during and after the inteview process. In the NOIR, it will state what doubts or questions they have about your relationship being legit based on your spouse's replies or lack of responces. You need to address the issues they had and send in any proof that you have been in contact with your spouse all the time. When you traveled or perhaps when they came here. Telephone records, pictures and of course e-mails. After they recieve this package they will let you know that they received it and tell you that they will let you know in 60 days if your proof was good enough or not resulting in a denial or re-approval. Hope this helps right now I am waiting for the re-approval or denial based on the evidence I sent in. Good luck

    I'm new in this forum and was looking for some suggestions. Any advice/comment/suggestion is really appreciated.

    I'm a USC who petitioned IR1 visa for wife. We were married two and half years ago and is our first marriage. We have never applied for any other visa before. My wife had her interview on 3rd July 2012 at the US embassy in Nepal. The interview went on smoothly. She was asked only basic questions like when did you married, what does your husband do? etc. The CO also went through our wedding pictures. It only lasted for 5 minutes and at the end the CO congratulated my wife saying that her visa is approved. Then they returned all the original documents, kept her passport and was told to come back 5th July 2012 to collect the passport and visa packet . My wife was given a small slip (size of a business card)where it says '5th July 2012. Please come to collect your visa and passport on this date.' But when my wife went to the embassy on 5th July, she was returned back saying that the visa and the packet is not ready and the embassy will contact her when to come back.

    Its been nearly two weeks and the embassy never contacted her. When my wife emailed the embassy to check, she was replied saying that her case is in Admin processing and will inform when its complete.

    What might be the reason for them to send our case for Admin processing? If there is anyone in this forum who has gone through same situation please please share your experience.

    The administrative review is where you have 180 days to gather all your evidence supporting your relationship. Usually chats, phone conversations, ect... My husband had his interview September 15, 2011 and they didn't openly state they were sending it back until I emailed the consulate the next week and then two weeks after that because we didn't get an answer. What happens now is you wait a period of 180 days then they will send you a Notice of Intent to Revoke. This notice will define what they found out during the interview that brought up questions or doubts of a legitimate relationship. You need to address those issues. You have 30 days to answer that with copies of whatever proof you have. This proof should be everything from when your relationship started, during it and after the interview; proof of a continuous relationship basically. It should contain information on when you traveled to visit, and how often etc. After they recieve your proof you will get another notice stating they received your proof and will get back to you within 60 days with denied or approved. This is where my husband and I are. We will be married two years this Friday and this process will have taken two year at the end of August with maybe the end in October.     It is beter to go over and beyond than not go far enough than have your interview go into administrative review for 180 days then be requested for more evidence of relationship. It will save a lot of time and money in the end.

    I have sent 2.5 years worth of e-mails and being a married/engaged couple there should be some intimate discussions in your e-mails and you should not be embarrassed about it. They ask for proof, prove it to them that you have a legite relationship.

    What probably happened is Casablanca sent it back to NVC for additional proof. It will go into an admisitrative review and further evidence will be asked to be provided by your finance. My husband had his interview on September 15 2011 and the consulate basically said the same thing. They will keep your file at the admistrative review point for 180 days then they will notify the petitioner to provide any additional proof of relationship. They will have 30 days to submit this information and if they do not submit this information it will be revoked. Hopefully your process won't be so long since it is a different type of visa you are applying. Ours is the I-130. Good luck and hold on.

We filed in August 2010 and it looks like he could be here at the end of September or October based on 60 days here to wait and 30 days here and the 180 days that ended up being 200 for the administrative review section. I wait and know that when it is all over it was worth the wait to have my soul mate with me. Be strong and plan your spouse's home coming, do little things to prepare yourself, create a home for them, just doing these little things pass the time away. Think of things you need or would like to have when they are finally here. I have Christmas presents waiting from last Christmas wrapped and ready. I took his birthday gifts to him when I visited him. For every holiday buy a little gift and wrap it so when they come home you can have a big celebration.

    It's been 9 months since my husband had his interview at Casablanca and they put his case under administrative processing. I have contacted my congressman after 6 months, but he told me the same thing that my case is still under review. Every time I called DOS they say it's still under review. On monday I sent an email to the US consulate at Casablanca this is what they told me:

    "Thank you for your email inquiry. Unfortunately, your husband’s case is still under review by USCIS. Once the review is completed, we will continue processing the case". I remember on february when I contacted the NVC they told me that my case was under review at the consulate, so now why is it at the USCIS level? What does it mean? I need help and advice please.

    My husband had an interview in Casablanca in September 2011 and it was given back for an admistrative review. It took 200 days from December 2, for the USCIS to give me a notice of intent to revoke. They gave me 30 days to get my proof together and send it to them. I took 9.5 hours getting this together and mailed it off the next day overnight. My status has changed to evidence being processed and will have to wait another 60 days to find out if it is acceptable or not. Hope this helps. I know my husband won't be here for our second anniversary, but maybe shortly after that. Good luck

  21. Is there anyone reading this post that has gone to Islamabad for their CR1 interview and the CO gave a refusal without interviewing the us spouse, myself and I am older than him. The CO asked him who is older, your wife or your mother. Don't you want to have children? Then she told him to sit down. She called him back to the window and gave him a refusal stating "During an extended fraud interview, where the petitioner and applicant were interviewed separately and the answers were compared, the couple had numerous discrepancies and exhibited a lack of basic knowledge about each other. The consular officer is certain the relationship is for immigration purposes only, and there is no petitionable relationship. Therefore the petition is invalid under INA section INA section 212(A)(5)(A).” She also did not check the box for us to appeal. This took place on June 21, 2012. We have been married since Sept 28. 2010 and together for a year prior to that. THE CO NEVER, NEVER CALLED TO INTERVIEW ME!!!!! I have my phone records to prove it.

    I am desperate for some advise, suggestions, an attorney is not really an option financially at this time.

    I am also looking for hope that someone else has overcome this. My husband is upset too and just wants me to move to Pakistan but I have my kids here so that is not possible.

    I have cried so much. The stress has started causing me to have panic attacks. I can't live without him and like the other posts that I have read here, I am sure that he did not marry me for a GC. He never asked to come to the US and would be happy if I came there and he would not have to leave his family.

    Hi, I recieved a NOIR June 29, 2012, I was devastated, but I got my papers together and sent everything out yesterday it took me over 10 hours to the papers together to send. You have to pull yourself together and get all your documents together. You will have 30 days to send it in after they notify you, don't give up. Copy and paste your communications via e-mail to a word document, get phone records to show you are in contact with your spouse and any other documents that have your spouse's name. Insurance cards anything. I don't have lease agreements or bank accounts with his name on it because he isn't here to sign for them. They are going to want you to prove that your relationship is legite before it is flat out denied.

  22. Wow, way to cut it deep. I'd appreciate if you tone it down a bit since I'm just here to help a friend who said her fiance's visa's expiration is August 4. When you mentioned the "calculation", I checked it upon myself so it turned out it's August 2 instead of August 4. For the record, I took her word for the expiration date since she's the one getting married, not I.

    I have a question about the G-325A. my fiancee filled the form out on my last trip to manila and printed her name on the bottom but did not sign or date the form in the signature section. can i send in a scanned copy that has her signature. (think i just got my answer by reading further down the step by step page. :( anyone ever send in scanned docs and got approved before?

    yes because to mail documents takes three to four weeks each way
