  1. Hello all and happy 4th of July!!!

    I was just wondering if anyone have heard or received anything from the Nairobi consulate. The waiting is driving us crazy....did anyone get any kind of feed back from this consulate..anything at all...reject or better yet approved....please share. I need any kind of news but most of all good news....please share. :whistle: :whistle: :angry::crying::angry::crying:

  2. I am so sorry about the negative decision. It is always easier said than done but you must stay strong and use all your energy toward resolving the problem you have at hand. As they say, God only gives us what we can handle. We were also rejected and the rejection letter indicated the rejection was based on the relationship not being Bona Fide although they never looked or took all the supporting documents of our relationship.

    I wrote a detailed email to the consualte of what my fiancé encountered during his interview which brough about the decision. I also requested an explanation of what kind of proof they want for a long distance relationship. We had pictures, Airline tickets, DVD and phone records as proof. Our case was placed in AP by the next day. I'm not sure if this is a good thing or not but I'm hoping they are taking a second look.

    I would suggest you also write to your consulate but remember to not accuse or yell even though this is upsetting, you must not write with emotions. Remember those reading are only doing their job as far as they are concerned. Try to convey your confusion without anger and plead for explanation and direction from the consulate because this is and will be your husband regardless of what they decide.

  3. That is correct, USCIS is not involved at this point.

    Senatorial inquiries are a long shot and it is the CO that has the last word. The general VJ advice to contact your senator during AP is truly overused because they can not stop AP. There is nothing else to do but let it run it's course.

    Some senators will be able to shed a little more light on it than yours has but the consulate prefers the process to be

    non transparent and shrouded in mystery with no end in sight. Supposedly for national security and to keep people from trying to "fix" anything that is being investigated mid stream and also to protect the privacy of the beneficiary.

    On top of that involving a senator after only a short time of AP increases the work load for the CO's by having to pull

    your file and answering the senator within a certain time. Sometimes your case file loses it's place and ends up underneath

    the "stack" by being pulled. It has been observed that some get approval within days of a senatorial inquiry and some get denied. Coincident ? Who knows. Don't rock the boat unnecessarily but instead try to understand what the reason for AP may be, a clue being something the CO may have pointed to in the interview. For example if they ask for a list of friends etc. they may want to conduct a home investigation. If the questions center on a specific date/event on a from they may want to verify it or the document.

    Then there are the name check hits etc.

    After 15 months in AP I just go on about living my life, what else can I do ! I exercise, talk with my friends, do what I do ....I refuse to live like a stressed out zombie for any process in this journey.

    I have written my senator about drafting a law for more transparent AP process with a time limit recently but have not heard back yet.

    Sounds good and I have actually started to exercise, now if I can only find a way to give my mind a break from thinking about it 24/7. :bonk:

    It’s getting very complicated and stressful. My fiancé is Eritrean but as I stated before the American Embassy in Eritrea doesn’t process K1 visas. We transferred the case to the Nairobi consulate because Eritreans did not require a visa at the time (was able to obtain it at the airport once you arrived in Kenya).  Unfortunately for us, Kenya has changed the requirements for Eritreans, now we must request a visa prior to arriving to Kenya.  My fiancé left Eritrea in September of 2011 for the purpose of this process and is unable to return back to Eritrea. The process was only to take 6-8 months; our timeline was actually ok but with the current AP  status .. :whistle: ?  His visa to Kenya expired several times but he was able to leave to neighboring country and re-enter with no problem. This is not an option any longer, he left Kenya and due to the change returning to Kenya became an issue.  We are working on it but he may not be able to satisfy the requirement for the visa to re-enter Kenya.   :help::help:

     

    Hopefully the Nairobi consulate will approve us and request his passport for the visa.  If so…

     

    Questions:

    1. Can he mail the passport from another country? Is that even legal? Would they accept it?

    2. Can we request to transfer his case yet again while it’s in AP?

    3. If we have to transfer, any recommendation where?

  5. Sorry to hear about your AP. Have you called USCIS and requested a service request? And have you also involved your congressperson, state rep or senator? How long has your AP been by chance. I know they usually give people the standard it could be 180 days before you hear anything but was wondering. Also where do they say your case is at? Embassy, USCIS?

    I have contacted a senator and the Nairobi consulate replied back to him in the same manner they do me," case is in AP and all cases are different..blah blah bla ..."but added that they were unable to provide more information in regards to my Fiancé because he is not one of his constituent".

    As far as I have been informed, I can only contact the Nairobi consulate for status at this stage, the USCIS has nothing to do with it. the waiting is driving me CRAZY !!!!

    We have been in AP for 15 months!!! :wacko:

    You can call DOS every 2 weeks to check on your status. # 202-663-1225 Have his name, case number and DOB ready.

    OMG..sorry to hear that. I have been emailing every 8-10 days to check on status. I want to have documentation to all communications. I hope we hear soon :unsure:

    It is so good to find a site with people who can relate and sure my frustrations and eventually happiness (hopefully). We have been in an " Administrative Process" for almost 4 months, it is driving us crazy. My fience' is Eritrean who had to travel to Kenya for the K-1 visa (Embassy in Eritrea doesn't do it there). I have been trying to find a timeline of how long it might have taking others in the same situation. I am still new to the site, if it's already here, I would appreciate direction to where it could be found.

  8. I woke up to TWO approvals this morning. Originally I thought Nigeria still allowed the K3 visa so I went the route of completing the I-130 which was forwarded to the California Service Center. When I received the NOA1 from them, I completed the I-129F as instructed for marriage (not fiance) and received an NOA1 from them with that petition going to the Texas Service Center.

    Both peititions were approved EARLY THIS MORNING! I woke up to text messages and emails! (Yes, I registed on the USCIS website for electronic notifications).

    I'm ECSTATIC!

  9. My husband and I are 18 years apart - he's 25 and I'm 43. Don't think it should matter.... at least I hope not!

    Hi, we are currently in AP and one of the reason, told to me by friends and Lawyers is the age difference between us. I am older than he is. It was explained to me that although it's not a problem for the guy to be older, it's an issue when the female is older. Do you mind if I ask what is the status of your case? I do hope you are right, age is just a number.

  10. I am a new user just reading to understand the phases of the process and also read some suggestions that could also be helpful to my case. I have read almost all of the post and I can truly say that everyone on this site is only aiming to help and support each other. I for one, am very greatful to have found this site. I would rather hear all the possible questions and doubt here than after the fact. I wish I had found this site before I was placed in "administrative process". Having said all that, pleases keep up the good job VJ !!
