  1. i apply for vawa (i-360 only) not i-765 or i-485) and i do not wish to continue i think i can save my marriage,deep down in my heart thats what i want to do, but if i get back with him am i gonna get deported? what if he applies for me i-130, please help me

    What was the outcome of your situation? Did you work it out with your husband? If so, what did you do after the I-360 was approved?

    So, what happened to your case? I have a similar situation. I brought ex-wife on a K-1 visa and we had too many problems that I ended up divorcing her and she filed for VAWA. I was never charged with Domestic Violence although she made a report that went nowhere. She never got a green card from me as I withdrew the affidavit of support. I accused her of fraud when did that with USCIS.

    A year passed and I saw her again and realized the feelings are still there. We are trying to work things out but we're not sure what we're up against in the future since her VAWA petition is pending.

I brought my ex-wife on a K1 Visa, got married, applied for a green card for her(which she never got because I withdrew the affidavit of support) but then, we had too many problems and ended up getting divorced. It's been a year since we separated and 8 months since the divorce. She applied for VAWA 10 months ago, got a work permit (EAD) and her case is pending. A lot has changed since we got divorced. I still love her and we started recently to date again. I would like to re-marry but I know that doing so will be an automatic denial for her green card under VAWA. How can I help my ex get a green card.

    I feel terribly bad because I think all of this is my fault. The love of my life is going through immigration issues because of me. I love her with all my heart and want to work things out with her. I know also she loves me the same way. We're going through counseling. I want to have a family with her but I don't know what is going to happen to immigration or what is the best way to attack the problem. We could remarry and her VAWA goes out the window. I could reapply for her green card myself but I'm afraid it'll be denied because of the whole abusive behavior on my part as part of the VAWA.

    Help please!!

  4. From an immigration standpoint she would be eligible for AOS if you were to remarry. What you must bear in mind is that you can't un-say nor un-tell all the stories and facts you reported to immigration at the time. Unless you have actually proven fraud, alleging it alone would not be prejudicial to her, but you may be asked to explain your reasons.

    At worst, you may find an IO willing to revisit her case and you may need to explain what actually happened and the truth behind accusations.

    IMHO, concentrate on the relationship first, and if it works out, then you worry about her greencard and dealing with the USCIS.

    She wrongly accused me of violence with our local police after I showed her the divorce paperwork. She was the attacker and I told police that. That's why I concluded that she was only after the green card.

    2. How do you know she isn't being nicey nicey just to get the green card?

    3. Yes it will lead to much scrutiny since you reported her for fraud previously. How can you prove the relationship is real now and not just for the green card? on both her part and your part (you may be getting paid or other benefits to help her obtain a green card.).

    You would follow the guides at the top for concurrent filing.

    1. I am not sure what kind of visa she is in. All I know is she has some type of visa. My guess is that since she alleged violence in our marriage(which never occurred), she got some type of visa for victims of violence from immigration. She told me her visa is good through the end of the year.

    2. I do feel she loves me. Her life has been a disaster due her depression over the last year. When I had her in my arms, I feel she loves me.

    3. We are going to wait it out and work out our differences. We'll date for a while before we decide if we are ready to marry again or not.

    I brought my ex-wife from a Mexico back in 2012 on a K-1 Visa, applied for a green card and ended up withdrawing my affidavit of support after 10 months due to all the ongoing fights we had. She never got a green card. During the withdrawal process, my ex-wife made allegations of violence and I told immigration most likely all she ever cared about was a green card and was a fraud as a consequence and wanted them to deport her.

    I ended up getting a divorce and we battled at the courthouse as well. It's getting close to a year and a half since we got separated and my ex-wife and I saw each other again. I realized that I still love her and I dream of working out our differences and be together. She is still in the USA on a visa. We already had a date and we are happy :). I realize how stupid we both were getting a divorce and telling immigration what we told them.

    My question is if my relationship with her was to work out, what would be the process to adjust her status and get her a green card. Also, will I have any issues with immigration since I alleged fraud on her part previously? I love her and I all I want is to work out my differences with her and be happy.

    Of course, right afterwards I went out and bought some lottery tickets....Nope...no winners.... What I am trying to say is that I feel that our quick approval was just a stroke of luck.

    Not really. You are not an interview-waived case. People who have interviews are getting their green cards in around 3-4 months like always. The issue as stated in my comment above is those of us who don't get interviews and NBC has to process us. It used to take 6-9 months and now nobody knows. Nobody has been approved yet that I know since August.

    Nobody knows actually to tell you the truth. USCIS changed the way they process applications as of August 1st. Applications for which interview was not required used to be processed at the California Service Center but now they're at the National Benefits Center. It used to be 6-9 months but now nobody knows since I have not heard of any August filers getting approved.

  9. Has nothing to do with cases going to a local office for interview. Some people are chosen to get a visa without interview. Their cases were transferred to CSC, who processed the case and mailed out the greencard. USCIS is shifting the workload around and not using CSC for that purpose after Aug 1. It will be the National Benefits Center that processes the ones who don't interview. so the August filing folks will be the ones to watch and see who and how long to get approved if chosen to be approved without interview. Too early to know yet. If anything it should free up CSC to complete other duties faster.

    As of April 2013, August 2012 filers who were waived for an interview have not gotten a green card. So, the wait is now over 8 months as of today.

    some one had posted a link that showed the number of DACA petitions processed by month - I wish i had saved it - it was from the uscis website. Very interesting that Aug 2012 was when large numbers of those started to be processed and that is the same time that i485 stopped being worked on. just sayin

    I have not gotten a response on my service request that I put in almost a month ago.

    Since interview-waiver applications were transferred from CSC to NBC starting on August 1st, 2012, my guess is that they still haven't figured out who's gonna take a look at these applications. Maybe they're in the process of hiring that new staff who'll look at them. I bet it's kinda like when you're really busy with your current workload and your boss comes and tells you, here's a gazillion I-485 applications even though you've never seen it before. Take your time, those AOS people are really patient.

  11. I have been trying to track approval for AOS that were sent or held at NBD/MSC since August 1st. I have not seen even one person approved that was not transfered to a local office for an interview. Is there anyone out there who has seen or gotten approval since August 1st at MSC/NBC?

    Now I see that Dream act applications are also being sent to NBC for processing. How are we ever going to get AOS approval at NBC at this rate. Very frustrating to be at the 7 month mark.

    I was looking at this link and I think you're right. I'm seeing people from April, May, June 2012 and July getting approved but nobody from August 2012 :(

  12. Same has happened with my case. Salt Lake went from processing 12th August yeasterday to 11th October today. We had an original NOA of 1st September, then an NOA of 28th September for them receiving our documents for the RFE. I've send an e-request to find out what is happening.

    Hopefully that just means they're moving faster. I still hope that I get the green card sometime this month. I'm at the 7th month mark now.

  13. Just out of curiousity...at this point, wouldn't you have already been notified if you were going to have an interview at the local office? Seems like most people who get interviews are notified somewhat quickly if they will be sent to a local office, even if the interview happens further down the road.

    My congressman made an inquiry on my case and said my case had been identified as a "interview waiver" case and that regular processing time for these cases is 6-9 months.

    From what I've seen, if your case is at NBC and it's been over 4 months, most likely it's a no-interview case.

  14. Thanks for letting us know - so you're looking at May at the latest, which means October filers can realistically expect to hear back in June. I'll probably call in May if I haven't heard anything.

    Yah, but, it depends on your local office even though it may say National Benefits Center when you check your application online. Check this website for your local office whenever it comes back online. It's down for maintenance right now: https://egov.uscis.gov/cris/processTimesDisplayInit.do

    Don't worry about the update date of January 31st at the top of the table. It seems that it's irrelevant. Those are the current processing times.

  15. Processing times have changed for Tampa. As of January31st, they were handling September filings. You cannot go by that though. We filed in the early part of August and still nothing although we recently put in an E-request.

    Perhaps the change in processing times is hopeful......

    You filed on August 18th and the cut off date for last month for Tampa was like August 1st. I think something might happen for you in the next few weeks..

    When I called 2 weeks ago - I was told they were still processing August and that I was not out of normal processing times but I wasn't told what normal processing time is - just that I could not do a service request yet. Unfortunately I called from work and could not spend a lot of time on my phone call

    The USCIS processing time table got a few updates today. The Processing Timeframe for Kansas City is now September 9th, 2012. I think we are next. My guess is middle of April we'll have the gc in our hands based on other cases I've seen for Kansas City. It took them 7 months and a half.

  17. Our field office was already processing cases a week past our date as of Jan. 31. To date, we have heard nothing. I'm thinking NBC is just very slowwwww.

    It just got updated today. That means you and I are next. The Kansas City office is now processing applications all the way to Sep 9th as of Jan 31. I don't know what Jan 31st means but it seems to be irrelevant. You and I should have a green card soon. How soon? My guess is that less than a month and half. It all depends on how many people they have.

    We filed for her AOS along with EAD & AP August 8th and got our EAD/AP card on October 15th. However, there is no sign of the green card (AOS approval or any updates). We are going to be in seven months tomorrow? I think the application is in national benefits center or something like that.

    Just wanted to anyone was out there in the same boat? or anyone has any suggestions? Should we contact our Senator or something like that?

    They're processing applications all the way to August 18th and you filed on the 6th. Hopefully something happens this month.

  19. I had my biometrics on Feb 7th of 2013. Any estimates or help I can get?

    You will wait for a greencard anywhere from 3 months to a year. Yap, a year for some people. If you get an interview, around 3 months. If you are one of those people like me who don't get interviews, then, over 6 months easily. I've been waiting close to 7 months and it's normal.

    The only local office in New Jersey is the one in Newark NJ. According to the link below, they are processing applications with timeframe August 24, 2012. You filed on 2012-09-04. You are next when they finish with August filers but not yet.
