  1. Thank you very much @Shub that is exactly what I have been reading I've spent all day yesterday researching and everything seems to indicate exactly what you're telling me. I just wanted to make sure and ask others before we start moving things along. He was born in 1992. And yes he has always been in custody of both his parents, and He was legally admitted as a Permanent Resident at the time.

Just last night we found out that my cousin might be a US citizen which is the reason I'm on here asking to see if he is indeed a US Citizen, what can he do to come back to the United States and what steps to follow. First of all, His father is a born US citizen. He met and married his mother in Honduras but didn't bring them over legally until he was 6 years old. He has been a LPR since he was 6, his mother naturalized when he was 12. Although he never naturalized, I believe he might be a US Citizen since both his parents are right? At age 18 he got in trouble with the law and was convicted of Armed Robbery w/ gang enhancement. He robbed someone for the "benefit of a gang" is the exact wording. He served 3 years and was subsequently deported with his green card taken away. Is he a US Citizen and therefore he can come back as a US CItizen? Was he wrongfully deported? Thank you all for any and all advice.

So last week i posted on how my husband had applied for an I-131 since November, we applied for AOS but didnt submit the I-131 with the Green card instead we filed later in November.He had the green card interview in Late Janjary but we received a RFE which we will be respondig to in a couple of weeks. We opened a service request so they can expedite the application last Thursday,and they said wait 5 days for a response. Today I checked the USCIS case status and it said On February 25 this application has been transferred to your local USCIS field office for further processing! I dont understand my attorney doesnt understand it either why would it be transferred to the local field office. On the other hand he said it might mean that it was approved ans sent out but that the computer mustve mixed uo the codes. Any one have any ideas?

  4. Wait... I'm confused by the timelines, it seems you only became a LPR of May last year but your husband already had his interview for a green card? On what basis is he applying for the green card? Regardless the first thing you need to do is satisfy the RFE, what was the RFE for and why haven't you replied to it yet?

    He EWI , but i adjusted my status under 245-I , he was a derivative to my petition. So even though he was under removal proceedings, it was terminated and we had an interview on January 28th. The RFE was for me to prove i was here on December 2000, but i asked for my school records so that they can see i went to school at that time. But it takes 4-8 weeks for them to process my school records. So i have to wait to have those in hand.

  5. Your husband is the applicant for the EAD, so he has to contact them.

    US privacy laws extends to spouses. Often, one spouse cannot get the private information of the other spouse from a third-party.

    Man my husband gets home by the time they are closed. I guess ill be waking up with him tomorrow morning and hopefully well make it by the time they open!

  6. You know that AP takes 90 days, yet you plan a vacation less than 90 days from when you apply for AP.

    Actually i calculated it for exactly 1 day later than the 90 days because i saw that most people received their advance parole under the 90 days. Maybe people will see this as an example.

    I live in Orange County and I couldn't find any appointments for L.A., Orange, Riverside, Ventura, nor San Bernadino counties when we needed one in November 2013. Found an appointment the next week in Imperial in San Diego county, a 2+ hour drive each way. Small office, no one waiting and we got what needed. We were travelling the following month so it was worth the drive.

    Really was the appointment for the same reasons as ours?

    Call USCIS and ask for an expedite.

    The US does warn applicants not to make travel arrangements without the proper paperwork in hands.

    Hopefully, USCIS will be able to help.

  7. You can still do two things:

    1 / Keep checking for Infopass appointments. Something many open up if there are cancellations.

    2 / Call the airline and check what the penalty an the deadline are for re-booking the tickets. You will not get a refund but chances are you will be able to book the tickets to a later date and pay a fare difference in addition to a re-booking fee, if you take action with sufficient notice.

    Thank you i will keep checking. In the mean time I'm calling the Airlines and see if anything can be done although i had seen that there was no refunds i might be able to re book ill see. thank you.

  8. Hello everyone, my husband has already been interviewed for his green card. He received a RFE shortly after. We haven't turned it in yet. Anyways, he applied for Advance Parole with a receipt date of November 27th. That same day we bought tickets to Mexico with a leaving date of February 28th. Still no Advance Parole in sight and the online case status still in initial review. We paid $700 for those tickets we don't know what to do. PLease any advice on how we can get this Advance Parole going ASAP or expedited what can we do or who do we call ? were desperate we only have 2 weeks before our leaving date .

  9. So we were initially going to adjust his status through the court, as a derivative beneficiary to my 245I. But instead his removal proceedings were terminated and we are waiting for an interview with USCIS. We had already filed for AOS through Texas service center. His advance parole was denied because he was in removal proceedings. So basically my questions is if he can just reapply for advance parole and sen it with the letter from the judge stating his removal proceedings were terminated? His attorney said that we have to wait for the file to get moved but i dont see why they cant just reapply for another advance parole,and would we have to pay a fee? Thank you.

  10. Well the petitioner still has to fill out a I-864. But i strongly suggest a consult with a immigration attorney. Since looks like they never really lived as a married couple i don't know what they will do as far as bonafide evidence.

    Once in the US you are expected to live together. This is an interesting situation. I am sure more knowledgeable people will come and lend a hand.They did live together for

    Thank you for responding,now to clarify,we do have an attorney and hes optimistic everything will be ok,but he is an attorney,and they are supposed to say that anyways lol so i wanted to see if anyone else had seen or been in a similar situation. They Did live together for over 4 years before and after getting married,they had my brother shortly after getting married. He did get incarserated a couple of times in county jail but only for days for minor stuff then hed be right back home if thats what you mean by them not living together.

    I don't have any advice as I have no knowledge in this area....but I want to wish your family the best of luck. I hope and pray it all works out for everyone. Sounds like a rough situation.   11. The big issue is the I-864 (Affidavit of Support). Because regardless he will need to fill out one and she will need a co-sponsor. So what will she do about that?

    Yes my stepfathers cousin will be co sponsoring, theyve been more than supportive of us throughout the years as well. She sent in the paperwork late march and have the interview Late July.

  12. this is a tough one to answer but them bottom line is she entered the marriage in good fate and, it doesn't matter if the partner is incarcerated, after-all they got married before the incarceration and i think she might have a good case with all the documents u mentioned they both have. may be your brother should write a supporting letter and giver her wife when shes going for the interview this is my own personal opinion and remember am not a lawyer

    Thank you for answering, the letter from my brother is a good idea but unfortunately hes 12,and Autistic,he doesnt know how to write yet, but he will be going to the interview, i forgot to mention theres a lot of pictures too from when we go visit , we always take pictures.

  13. So my mother EWI in 1993 from Honduras. She met and married my stepfather (born in Tennessee) in 1999,had my brother in 2001 and he filed an 1-130 petition for us. We werent able to adjust status then because my stepfather has been in and out of prison. In 2004 he got convicted of attempted murder and received an 11 year to life sentence. So this whole time she thought we couldnt fix our status but with a consultation we figured out we could under 245i. So i just got my green card,but the Interviewing officer didnt ask anything about my stepfather. But i know that with her it will be different because he will be expected to be there as his spouse. But she has proof that theyre still together regardless of the circumstanse (thousands of letters,yes thousands idea9dv.gif they write each other every day,the visiting logs that go as far as 1999,she visits every 2 months because hes 4 hours away,call logs,money receipts shes sent,of course my brother,another thing im not sure will matter is she has his name tattooed on her leg,so does he on his chest. And paper trail of before 2004 that prove they were living together such as rent receipt and car insurance under both of their names. So basically our question is how do you guys think this will go? He has a life sentence so its not like they can postpone until he gets out,so were hoping they dont deny her. Its an unusual case so basically id like some opinions of how things can go or how to hanlde this. Thank you for your time.

  14. Its been a while sinse i posted. My name was stuck in name check sinse June that i sent my AOS, i guess it mustve been because i was arrested as a minor. I was interviewed in October. Ive been to 2 infopasses,and yesterday i decided to ask to see the IO that interviewed me personnaly. She told me that she would look into my case and if my name check was cleared shed sent me the Decison within 30 days. Wow i guess she mustve done it right then and there. Unless it was some kind of computer glitch (hoping not) but i received an email and a text card has been ordered. Thank you lord.

  15. Name check is the black hole, no telling. At least you have them calling, that's in your favor to get it done. We finally after waiting 10 months for our AOS contacted the USCIS Ombudsman office, seemed to work. But we were not in name check at that point..

Maybe some of you remember me i havent been on here for a while, i still havent received a decision on my case,so yesterday i went in for my second infopass which they told me the same thing,that my case is still pending review. On the first infopass i went to i went upstairs to see if i can ask the IO the question personnaly and turns out she was on vacations,that she would be back in 2 weeks. So yesterday after the fruitless infopass i thought id go upstairs and try my luck. So i went up to the window and asked if the officer was in and they said yes and if i had an appointment,i said no. Then they said IO's cant take walk ins they either have to call you to come in or you have to have an appointment because theyre schedules are super bizzy. I was really bummed and as i was ready to leave this hispanic guy comes up to me and asks me if i speak spanish and english,i say yes and he asks me if i can please interpret for his wife who is in the interviewing room,i said wth i dont have anything else to do! I couldnt believe who his officer was! Yep the same officer ive been wishing i could talk to for the longest,my interviewing officer lol words cant express how excited and overjoyed i was here was my opportunity to personnaly speak and ask my unanswered questions to her!!! So as soon as i went in i said "hello officer S" she said how do you know me? And i porceeded to explain to her that she interviewed me October 10 and ive been anxiously waiting her decision,she said "oh my God i cant believe its been that long and i still havent adjudicated your case, she said shes very good about keeping her files updated and adjudicating as soon as possible because she doesnt like to have outstanding cases. She asked me my info and looked for it on her computer,called someone and said "can you please bring me file so and so" she said as soon as were done with this couple im going to work on your case!(i was jumping up and down inside thinking "wow this is really it") and she started apologising about the delay in my case she was sweet as ever! Then i was sworn in and signed some papers so i could interpret for the couple,lets just say it wasnt a good place to be in,the officer was ver strict and stern and even kicked out one of the couples because they kept talking to each other in their lamguage,so i was uncomfortable. But i got to see first hand how marriage interviews are about.Anyways after the interview was over,she got my file and started looking through everything,she said everything looks great,but unfortunately my name check was still not cleared,that my background check was done,but she couldnt adjudicate without my name cleared. She called the FBI and left a message saying she needed so and sos name check expedited because my petition was way out of processing time. Then she called someone she said was in charge of name clearances within USCIS and told them to look into my name check because she was ready to adjudicate. She also called her supervisor and asked him if he could sign off on an arrest i had when i was 12 for robbery,that i hadnt been in trouble sinse,he said yes. (I really was falsely accused by a family member and i explained to her that) then she said she was going to expedite my case and keep it out so she would stay on top of it. I cant believe i went through all of this by a chance encounter! What are the odds of this happening!im so glad everying is good pending the name check. Can anyone tell me about how much longer the name check might take and why is it taking so long? How does that work?
