  1. I am a permanent resident. I lost my green card in December, and filed for i-90 replacement in January, with a receipt date of January 26. I have booked tickets for August 3rd (3 months away) . How soon should I make an info pass , to get a stamp on my passport, if I have not received my green card? Also how likely will it be that they will stamp my passport is there a possibility of them denying ? Ive also been missing all my dentists appointments to Tijuana because I don't have my green card, since i travel through land, If i were to ask for a stamp this early so I could travel to tijuana , would they give it to me ? Thanks !

  2. Thank You guys soo much ! We are buying his airplane tickets right now scheduled for early July, he hasn't seen his family since 14 years ago, this is so unreal! We went from the officer saying it sounded like he was ineligible and will need to leave the country for 10 years and a ban , to him being a Legal Permanent Resident all within less than one week! I actually think the officer was just trying to mess with him, because he told us that he wanted to make it clear that "entering Illegaly has its consequences and we had to face them at some point " We sure got the point after that scare the Officer gave us,and all we have gone through these past years with Immigration court ,2 interviews, and we are letting everyone know that!

  3. Hi everyone, I'm wanting to share my experience. I had previously posted on the fact that even though me and my husband had already been interviewed for his marriage green card, we received a second interview in the mail. I was freaking out because you automatically assume that something has gone wrong. While we were waiting for a while on the lobby, the Immigration officer that you hand out your appointment interview paper to came out and said that we were scheduled by mistake, that the contractors that schedule the interviews are not USCIS affiliated and therefore my husbands file somehow got rescheduled, and it happens often. He said that even the supervisor was reviewing my husbands file and said that he didn't understand why we were called in again, if everything was good with his case. The officer did tell us that an interviewing officer would be calling us in either way and maybe we might be getting our case adjudicated right then and there. Good news right? Actually things went pretty bad, My husband when he was 17, during one whole week, he kept getting caught at the border and thrown right back to Mexico. Until he successfully entered. Heres the thing though, He wasn't deported, he was whats called "catch and release". So apparently the interviewing officer said that he thinks my husband is ineligible for a green card because of all those times he was caught at the border, he kept asking my husband what exactly happened, did he see a judge, how long did it take for CBP to send him out, did he sign official deportation papers, or "exclusion papers". Now before any of this we did a FOIA and nothing came up, which means he wasn't officially deported. Now the interviewing officer said that he would be contacting CBP to see what exactly happened at the border. And depending on what happened he would be sending a decision. Now if anyone can answer these questions, so if it turns out he was just "caught and released" and not officially deported, he will get an approval for a green card right ? or even then will he still be denied ? And even so doesn't 245i cover it ? thats the whole point of it right ?

  4. Several of the responses to your predicament are valid. I am a retired CIS adjudicator and have conducted thousands of interviews. The interview could have been rescheduled for a number of reasons. Quite often, officers will retire or be transferred and have a lot of pending cases that are divided among the other officers. In many cases, the first officer may have not had complete notes and the officer that inherited the case may need to reschedule in order to make a decision. The I-864, Affidavit of Support, is usually adjudicated at the National Benefits Center and will not move the case forward until the Affidavit is determined to be sufficient. If your father acted as the joint sponsor then he would have to show that his income was sufficient. How did he earn money in the "joint"? Did he use his assets? It sounds like you may have also gotten a new adjudicator who wasn't sure what to do. If something was not signed, that falls on your lawyer. That's why you paid him.

    Your prior marriages may bring up a red flag. Have you petitioned for other aliens? Has your spouse been married before to a citizen or resident who petitioned for him?

    Prior to the interview, your spouse had to appear for biometrics. Maybe his fingerprints picked up something that he did not admit to. Seriously, I've had people, generally Central Americans, who didn't realize the fingerprints they provided in California are the same fingerprints they have in Texas.

    I can tell you that if he is entitled to a benefit, he will get it. I know that I adjudicated many cases that I had to hold my nose while I approved them.

    Thanks for your reply, definitely makes me feel better that there might be other reasons why we were called for another interview, not just because something bad came up. My father is the original sponsor, not the joint sponsor, since his income is zero, we had to use someone else as a joint sponsor. Ive never been married, I'm only 23,he has never been married either, There is nothing more that could have came up he has never been arrested before and has never committed any more "crimes" We even sent his fingerprints to the FBI check and the California department of justice check, they all came up with what has already been said. I know that for me it took almost a year for the officer to grant my green card , she called me into her office once about 4 months after she had interviewed me because she wanted me to get my fingerprints done again because something came up .

    Petitioner would be the more accurate term, I think that is what caused the confusion.

    Sorry I don't want to confuse even more, when I mean something came up, i meant on her end, she mismanaged some paperwork or someone else did while she was on vacations.

    No the original sponsor which is my father, is incarcerated and has been for 10 years. Just because someone is in prison it doesn't make them ineligible from sponsoring someone, which is why my green card and my mothers green card was recently granted. We just needed to have co-sponsors. So since he's incarcerated obviously he has made no income and hasn't made his taxes so the officer wanted proof that he is incarcerated.

    Thank You, see thats the weird part that I don't even think the issue is the criminal activity, because like I said even the Immigration trial attorney told the judge that he agreed to terminate his proceedings because there is nothing on his record that precludes him from getting a green card, I just don't know.

This could be the best guy in the world, with just bad luck, but I just read it as this guy seems to have police around him way too many times, you might want to acess the whole situation, as how many more times with run-ins with police.,.,.,and he does not work.,., must respect your judgement of him.,.,.,but, it just does not read very well for him.,.,.,.he is certainally not a "star" husband.,.,.,just with what I read, about him, and your words!

    Yes he has had run ins with the police, but he is the best husband and father to my kids I could possibly ask for! Most of the times has been bad luck for him, He is a very hard working person, but it seems like he has bad luck with police always stopping him , obviously his crimes were very petty, which is why Immigration Trial Attorney didn't oppose his terminating removal proceedings he himself said there is nothing that can preclude him from getting a green card.

  8. Your case seems too complex for VJ; but a couple of things that called my attention (which could be the same things that called USCIS attention): 1. Husband is arrested and go in removal procedures in Feb 2012; he then marries you in 2012 (month unknown, Was it after this arrest and the bond?), since you noted that you both have been together for several years and married in 2012, then there is the non-intermingle of finances and his incorrect answer as to when you got married; well, you can see how it would look to USCIS. 2. You noted he lied to the police, but did not state what was the reason the police stopped him or what was the case (if anything).

    Seems like they want to clarify things. With the several issues going, it can be quite easy to get things mixed or confused. But, you got a lawyer and that is the smart thing to do in this case IMHO.

    Yes we got married after his arrest and bond, but lets be clear, I was an illegal as well, So it wouldn't look weird to USCIS because I was an Illegal Marrying an Illegal, and we got married because we were pretty sure he'd be getting deported and I was going to leave with him to Mexico. I got my green card well after we got married, and it was by pure coincidence that his attorney happened to ask me and I told him about some papers my father had submitted for me years ago. We don't intermingle finances because I don't work, I've always been a housewife and he has provided for us, so there is no reason for us to intermingle finances if have no money to provide, he gives me money every week for myself if i ever want to buy myself something, and he pays all the bills,food,rent, everything. He lied to the police when one day his friend was driving and he was the passenger on their way to work, the police stopped them, he asked my husband for his name, he gave them a different name because he knew he had a warrant for not paying a court imposed fine.

  9. Seems to me (an outsiders opinion) that there are many issues and caveats to your case they must be confused n something... Could be the criminal issues, could be the inability for him to remember things... But in any case, they have something they need clarified, thus they called in for another interview

    I had two interviews but that was due to USCIS mishandling of my case, where they screwed up the first time, then pretended that the first interview never happened and so went for a re-do. With a case like yours it could be one of a dozen things, or more.

    They are good, actually they're more on top of things than we are ! I hope its maybe an error of theirs , thats what someone I know told us that more than likely its an error on their part or it might just be something practical like signing something or they forgot a question or want clarification on something, they even told it might be a good thing that instead of sending a NOID or a Denial were getting a shot at getting things done twice! this coming for someone that worked very closely in that Federal building.

    Maybe to do with his Criminal history?

    Im hoping that is why, and nothing to do with our marriage, its just the all the research that I did everyone says a second interview is an automatic marriage fraud interview, but it can also be for technical things such as criminal history right?

  12. Let me start by the beginning. My husband was in removal proceedings because he was arrested in February 2012 for providing false information to a police officer. He was released on bond. I adjusted my status under 245-I therefore he is eligible to receive a green card as a derivative of my petition. His removal proceedings were terminated and remanded to USCIS so they could adjudicate his case. In January we had our interview. Everything went ok he answered his questions truthfully, he was arrested on 4 occasions. 1. He was driving recklessly on the freeway and he had 2 beers,originally they charged him with DUI and he was arrested, but in jail when they took his blood alcohol level it was within legal limits so they dropped the DUI and charged him with reckless driving because he was speeding. 2.He was arrested for petty theft. 3. He was driving his friends truck and his friend left his wallet in his truck,so the police officer who stopped him thought he stole the wallet and charged him with identity theft and possession of credit cards, everything was dropped when his friend showed up to court and testified about what happened. 4.When he was stopped and provided false information to the police officer which is when all of this started. All of this the IO sent us outside so my husband could write what happened in his own words on a piece of paper. But he wrote them in spanish and the officer wanted them in english so she said she would just add it on to the RFE she would be asking of us. The one and only question she asked him was when were we married, he totally got it wrong,3 times, but the officer was joking him with and said its ok I can see you have very bad memory.She asked us if we had any joint documents wed like to show her, i showed her the car insurance we have together, contracts of furniture we bought years ago, and thats it because we don't inter mingle anything, he's not on my lease because the apartments under my moms name. When i asked her if shed like to see pictures of us going back to 2003 when I met him she said no the birth certificates of your 3 children is more than enough! So she said if we provide the RFE within a timely manner his green card will be granted. The RFE was 1.His sponsor forgot to sign a paper 2. the original sponsor which is my father didn't provide his taxes because he has been incarcerated for the past 10 years, so she wanted proof of his incarceration 3. Proof of my being here on December 2000 4. His hand written letter explaining what happened on all his arrests. We provided everything in a timely manner in Ferbuary. My attorney went to an info pass last week to inquire about my husbands case, now yesterday we receive the interview letter for next week. Its addressed to him and it jus says you have been scheduled for an interview for your adjustment of status case. I could understand why, when we first started dating in 2003 i was here illegally and we both knew I had no hope of ever having a green card because I didn't even know I had an I-130 from April 2001,so its not like he married me for a green card, We had our first child in 2005, then our second in 2010 and our third in 2011. We got married in 2012 because we lived together since 2005 and never though about legally marrying since we practically were, just not legally. This is all so frustrating, Ive researched and researched and all that comes up is "fraud marriage" and it just makes me laugh because its impossible they would think this ! Although I know wed pass the interview with flying colors ! Its just the fact that we should even have to be going through this! Can it be for something else maybe they just want to ask him something? Or he forgot to sign something? Im so frustrated so is he what can this be all about? our attorney will be in tomorrow or Tuesday but I'm so frustrated and wondering I just have to ask ! ANy advice comments or suggestions will definitely be appreciated !

    Thank you for your wishes . Even he thinks its good that things happened the way they did, he learned to be more appreciative of his Country and the laws .

    Was he represented by a lawyer at his criminal trial or immigration court? If he was, he should make a complaint about that lawyer (Although I do not know the circumstances - perhaps your cousin was not helpful to the lawyer, or the sharpest tool in the box). It seems negligent to fail to notice you have a potential US citizen undergoing deportation proceeding. Certainly not the fault of the government.

    He did not have an immigration attorney, only a public defender and Im sure in their conversations they never touched the Immigration subject. I do know that my cousin told me that after finishing his sentence they took him into ICE custody and he wanted to be free as soon as possible. He has a lot of plans for the future, plans which don't include his "Gang Buddies". Thank you.

  15. I'm assuming what is going to happen is he will get his citizenship recognised based on a late report of birth of an American citizen. As his father is still around to help him, this should be doable, although proving he's the natural child of his father may take time. If that is deemed to take to long, they could also go to opt for citizenship based on being a child of his mother and in her custody when she became a citizen. Either methods should work, but the child of a USC should be one taking precedence as he was already a citizen when his mother became one.

    katie, I hope all works out well for you all. I am sure it all has been agonizing... everything... arrest, wrongful deportation, trying to get him back.... I am sure he has learned a huge lesson through all of this too. And I am sure your family is tighter now in love than ever. If you can, keep us posted. And God be with you all.

  16. I am just confused, like I would imagine everybody else who has posted.

    I have come across most of these issues individually, but none of them all together.

    Look Im just as confused, imagine me being somebody that doesn't know anything about immigration, being put in this situation ,I just want to help and if there is a way I will find it and help any which way I can but I am the only one in my family that can put this out there and ask for help . Im telling it like I am being told, I'm not adding anything extra, or making anything up, why would I? I know that with Immigration any 2 extra words, or any 2 words less can definitely screw everything up. Hell I couldn't even help myself at some point
