  1. From our NOA1 to NOA2 was exactly 7 months and 1 week, and then we waited 4 months till her interview, so just be patient.

    When I was waiting on our NOA2 I remember I used to check the USCIS website daily to look for any status updates and then the first day I didn't check the website I got a text message informing me of our NOA2. Once you get your NOA2 you'll still have anywhere from two months to six months till your actual interview, so all I can suggest is be as patient as you can, which I know is easier said than done.

    Right now my wife and I are waiting for her EAD, AP, and our AOS interview. The good thing is when you get to this step at least your wife is right next to you waiting.

    This whole process isn't for the faint of heart.

  2. My wife got her Justice record / police background check done at her local police station. You'll want to get that started pretty soon because it can sometimes take a while for them to give it to you. Especially if she lives in a small city, my wife lived just outside of Can Tho City and it took her almost two months to obtain this document.

    You will also need to have her obtain a record of never being married if she has never been married.

  3. My case was a little different than yours JRF because I filed for a K-1 visa. But from the time we received our NOA2 to the actual interview date was almost exactly 4 months.

    Here's the timeline from when we got our NOA2 till the actual interview:

    [April 17th, 2013] received text message on cell phone of NOA2

    [April 22nd, 2013] received hard copy of the NOA2 paper in the mail

    [April 24th, 2013] NVC sent packet to Ho Chi Minh City - US Embassy

    [May 13th, 2013] Fiance received packet 3 from US Embassy in the mail
    [May 20th, 2013] Fiance mailed completed packet 3 back to US Embassy
    [July 9th, 2013] Fiance received packet 4 from US Embassy in the mail
    [August 16th, 2013] Interview date / Approved!!!!

    Best of luck to everyone that will be having the interview soon. It's been a long wait but I'm sure you are all anxious to get your fiance or wife here in the US with you.

  4. I would almost bet you are going to have to use a co-sponsor. If it is just you and your Fiance going to be living together alone, then you have to earn at least $19,387 a year. I'm not sure if they will look at what you will be making in the future. You can also use any assets you have to help offset the shortage you have

  5. OP, at this point I don't think you need a lawyer. Most people here did this all by themselves.

    I would, if I were you, withdraw the app and re-file for a CR1. You can wait for the interview and try to explain it, but I don't recommend that since;

    a. consular officers usually have already decided before the interview

    b. a more suspicious consular officer might think you're doing something fishy, slap you with misrepresentation or AP or something.

    Let me ask you something Amy,

    How can the OP file for the CR1 when he isn't even married to his Fiance?

    Are you advising the OP (which is not legally married to his Fiance at this time) to withdraw his current K1 petition, fly back to Vietnam, legally marry his Fiance, and wait in Vietnam at least 3 to 4 weeks for the Vietnamese government to issue them a legal wedding certificate, (which I can tell you first hand anything dealing with the Vietnamese police station you have to pretty much pay them a bribe to get it done quickly, otherwise he might be waiting two months for the marriage certificate to be issued). Then after he is legally married to his Fiance he would fly back home and file for the CR1 and start this whole process all over again?

  6. We also had a large Vietnamese tea ceremony, (which for everyone not involved in a relationship with a Vietnamese citizen, "is not a legal wedding"). It is done so the family and friends are able to see the Vietnamese bride or groom get married.

    Everything you did was pretty much the same as what I did, I did not obtain a marriage certificate with the Vietnamese government, and I also included photo's of the tea ceremony and the receipts from the tea ceremony in the K1 petition. The only difference is when I filled out my timeline I labeled the pictures and receipts "Tea Ceremony", not wedding. The US Embassy in Vietnam knows that this is the typical way that a Fiance of a foreign citizen does this, so that the family and friends are able to attend the wedding, since 500 Vietnamese citizens are not going to be able to get a visa to attend the actual wedding ceremony in the United States. It's all for show, not legal.

    About a month before my Fiance received her packet 3 she went to the police station to get the certificate of never being married, along with her police background paperwork. Because your Fiance will also need to do this, she should be fine with having that certificate proving that she is not married when she goes to her interview.

    I had made a mistake with my Fiances middle name because she has two middle names and I had gotten it backwards on the papers I sent to the USCIS, and once the embassy received our case my Fiance was able to contact them to have them correct it. So if you are concerned about what you have in your packet, you can always contact the embassy to have them adjust it. Or you could also contact an attorney to see what they think.

    My advice is strictly just telling you how it went for me, and hopefully helping you rest a little easier. If you need any help preparing for the actual interview let me know and I could help you out.

  7. I think you'll be fine if you schedule your medical exam once you get your packet 4. You'll have plenty of time to get it taken care of before your interview, because usually they schedule the interview at least 4 weeks from when they mail out your packet 4. Also, I'm not sure but I think you have to take a letter from the packet 4 with you to the doctors appointment.

    We got our NOA2 on April 17th, the NVC mailed everything to the US Embassy on April 24th, and my Fiance received her packet # 3 from the US Embassy on May 13th. She sent the completed paperwork back to them on May 20th. It's been six weeks and we are still waiting on packet # 4, so she hasn't scheduled her medical appointment yet.

    But, in the meantime I would recommend getting your police background check completed, and if your country requires it I would get your Cenomar, because those two things took my Fiance well over a month to get back from her local police station. Take this time to get all your evidence of your relationship that you plan to show the CO ready.   8. After waiting 7 months and 1 week, the much awaited text message from the California Service Center finally came today at 4:45pm (NOA2 approved!!!). After weeks of reading how a few people that filed in Nov & Dec 2012 were getting approved before July, Aug, Sept, and Oct filers I was starting to feel that our case was hopeless, and I had many sleepless nights with all the anxiety this was causing.

    I will say I do feel guilty if I got approved ahead of you, but I just wanted to list this on here so you know that the CSC is at least not stuck on the July 18th date as the USCIS keeps informing people.

    Earlier this week I saw a topic "the 300 club", and I just don't understand how the service center can be making those people wait almost a year or longer for a K1 application, and I wish them all luck and a speedy resolution to their case.

I received a text message of my NOA1 on September 7th, and got the letter in the mail on September 10th and I haven't gotten my NOA2 yet, so I would say you still have a while before you get your NOA2. I know it's hard to wait, my fiance and I are going crazy waiting, I think it's been about 218 days since our NOA1, but we are trying to remain positive.

    I have called the USCIS three times, each time a month apart and each time I've called them they say they are working on July 18th's cases.

  10. I'm just starting to fill out the paperwork for the K1 Fiance visa and I have a question in regard to the cover letter and the letter of intent. The sample of both of these documents on this site has a blank where you fill in the address of the United States Department of Homeland Security

    U.S. Citizenship and Immigration Services. Can someone tell me where I find the address of which location I'm supposed to write on these two documents. I live in Indiana and plan to send the I-129F form to USCIS PO Box 660151 Dallas, TX 75266.

    Any help would be greatly appreciated :)

  11. I'm curious if my income will work for me to bring my fiancee here to the United States. The reason I'm a little curious is because I receive Social Security Disability income and additional income from a private disability insurance policy. Between the two sources of income I used to make $36,504 a year all on my own, but once Social Security kicked in for my twelve year old daughter (that is living with me) my private disability insurance reduced my money by what she is collecting from Social Security.

    This is what I am now making a year:

    Social Security Disability - $21,684

    Private Disability insurance - $3,984

    ---------

    $25,668

    (My 12 year old daughters SS income - $10,836)

    ---------

    $36,504 total - if I can count her SS income

    I know the current I-864P, 2012 HHS Poverty Guidelines for Affidavit of Support has a family of three needing to earn $23,862 a year, which I just barely meet that guideline.

    Basically in a nutshell I'm concerned my income isn't going to be good enough. I'm still getting the same amount of money I used to make, but I'm afraid the US Embassy is going to say that the $10,836 I get a year for my daughter can't be counted as my own income because technically I'm supposed to spend that money on my daughter, but Social Security assures me I can use that money for 50% of my house payment, 50% of the household utilities, 50% of groceries, and 100% of all of her personal expenses, etc. so it does help out quite a bit.

    I guess I would also like to know if Social Security Disability income can even be used in determining my ability to bring my fiancee here.

    Any help you good give me would be gratefully appreciated.
