  1. In the PAST yes... but that is not how it is done now. And now is what counts

Hi! I wonder if it differs depending on the POE, and whether it's a land or air entry. I entered December 2012 by land, which seemed fairly recent to me - but they may have changed the use of I-94's since then. I also received a new I-94 stapled in my passport the first time I used my advanced parole card at an airport in June 2013 - but not when I entered by land in July 2013. It may be inconsistent for K-1 entries too. :)

  2. Hi! I would add to this FAQ http://www.visajourney.com/faq/k1k2visa-aos.html#6.10.1
in section 6.12 re: taxes that it is important to contact/get information from your country of origin regarding whether you need to file a tax return in the US or your original country or both, and if you need special forms or instructions. For example, I needed to use the general tax form for Canada, but had to write extra information in the blank margin to the right of where you usually write in the amounts.

Most of the process seems good.

    Some is not:

    ...

Note: A K-1 Visa holder can enter the United States only one time with this visa. Upon entry, the K-1 visa is cancelled, and the I-94 form issued upon entry becomes the controlling document. If the K-1 entrant leaves the U.S. before marriage to the original petitioner, re-entry into the U.S. might not be allowed without a new visa. Also, if the K-1 entrant has applied for and is waiting on approval of an Adjustment of Status petition, the K-1 entrant should not leave the U.S. without also having applied for and received approved Advance Parole -- doing so could result in the inability to re-enter the U.S., and it indicates abandonment of the petition for Adjustment of Status. (Note that even approved Advance Parole does not guarantee re-entry into the U.S.)

I-94 IS NOT ISSUED UPON ENTRY, INFO ON THE PROCESS FOR RETRIEVING IT FROM THE CBP WEBSITE SHOULD BE NOTED.

Some people are issued a I-94 form on entry...I was - it was stapled into my passport.

  4. Just for the sake of that "some serious of waiting", we prepared for our I-765 renewal form already and the date we will be mailing it. tongue_ss.gif

How far ahead (i.e. before our current one expires next Feb) should we be mailing in the renewal form for the i-765/131?

I used my advanced parole for the first time today - and am glad we allowed plenty of extra time at the airport! It went fine, but we would have missed our flight if we'd just arrived 2 hours ahead. Now I have a new i-94 and a lovely big stamp saying "Paroled" in my passport. smile.png

It looks like the NBC may be getting into the sept/oct filers now, from what I see on different timelines (not field office interviews, not CSC cases)! Soon!

  5. AHA! I was hoping to find a group for this! I'm still at NBC as far as I know, and the USCIS site still has me on the first stage of 'Acceptance'. I assumed that the Chicago office would process our case since we're living right near it, but I'm not sure... I'm having a hard time figuring out how quickly people are getting interviews/GC's. Maybe people are so relieved and busy they don't think about updating their timelines afterwards :)

In the meantime, I'm happily choosing and trying out different paint colours for our living room walls, etc... :)

  6. Hi!

I've searched and searched in the forums for answers on this, and am getting mixed messages.

My fiance and I plan to drive my car across the NY border (POE), marry, and drive home to Illinois after our honeymoon. Then go up to a registered importer and to CBP office in Michigan to import the car asap after we get home. Toyota will not give me a compliance letter, so I have to use a registered importer.

How long do we have, to import the car? Some threads say 90 days, some say 1 year, and some say 10 years! I think that it needs to be done to be properly licenced/registered in Illinois, so I wondered if our time frame would be more like 30 days because of the need to switch my insurance, etc.

    Help, please! :)

    Thanks!

  7. Hi!

I'm looking for any input on our upcoming K-1 POE at 1000 Island Bridge near Gananoque.

How long is it likely to take?

How much extra time if we're bringing a trailer of my personal belongings?

We're planning on having a reception in Ontario (with wedding dress/party, but not a legal wedding - the marriage licence is for the state of NY after we POE), then meet a Justice of the Peace that evening in NY state to do the official/legal marriage. Does it matter whether or not we change out of our wedding clothes to cross the border (it's not very far away), since we won't be married till we meet the JOP in NY after we POE?

    Thanks!

    :)

  8. So how did all ya'll meet your other half??

Well... I don't remember when exactly we met for the first time - probably about 20 years ago. We both have attended lots of Bible conferences/ youth retreats in both Canada and the US every year, and we would have met at one of them at some point. I would say we became more than acquaintances - became friends - about 6 years ago when we were both volunteering at a Christian outreach in Newfoundland. We both have worked together there for part of the summer most years since then. And then last year... well... in the fall we became more than friends, and were praying very specifically about whether or not we should be married, and looking for wise counsel from people that know one or both of us. And in May - he proposed (HAPPY DAY!!! :D ) and I said yes, and ...

    SOON!

... we will be husband and wife, if the Lord wills. We have been so thankful and amazed over how we've been blessed in this relationship, and how it has made it possible for us to reach out to others in new ways.

So - that's our story (well, the very brief version of it - you know how hard it is to summarize a relationship!)

    :)

  9. Hi!

I have a MTL case #, and have everything together for Packet 3. I called DOS and they said Montreal has my case, but they haven't sent out Packet 3 to me yet. Can I send in Packet 3 before DOS says Montreal has sent my Pkt 3 to me?

And can I complete the last part in the DS-160 form now, where you sign it electronically... and print off the confirmation page now, or will it end up sending an electronic file to Montreal too early somehow?

So itchy to send this stuff in, but don't want to create a problem for us.

    Thanks!

  10. I'm confused - why are people tracking DHL deliveries? Are you following your i129f from the NVC to the consulate? Or somehow... the Packet 3 deliveries leaving the consulate? I just called the NVC, and they were able to tell me when they sent our stuff to the Montreal Consulate, and that Montreal had received it the following day. Still have no idea when Packet 3 will be sent out though - I think we're supposed to allow a week before calling DOS to ask. Am I missing something? :)

  11. Hi!

We are trying to get all the forms, etc prepared for Packet 3 and the interview as much as possible now.

We need help with the letter from my fiance's employer. My fiance's income is hourly, and the total income for the year is just a few thousand above the 125% of the poverty guidelines, although he has significant savings.

Our question: He works at a Christian non-profit organization that partly bases wages on the individual needs of the employee (e.g. wages are increased if you marry, or are buying a home, having a child, etc.).

Soooo... should the letter state his 'new' wages he would receive if he married, as well as his current wages, or would that somehow make it look like he's marrying just for the wage increase, and jeopardize our K-1 visa?

Should it just list the current income only? (which is just a few thousand above the minimum required)

Should it state that the wages are partly determined by need, since it's a rather unusual/unique way of doing business?

    Thanks! :)

  12. Hi!

I'm new here, and have spent lots of time investigating the guides, flowcharts, forums, etc... for K-1 visas. I don't have a timeline yet, as we're still getting the I-129F package together.

My question: In the K-1 guide and other places, people seemed to recommend that you attach any pictures on a separate page in ziploc bags (e.g. as part of evidence of meeting and/or evidence of ongoing relationship).

What if I just insert a digital copy of my pictures right into the Word document where I'm typing my 'evidence' info... and even just scan and insert boarding passes, etc, instead of using a separate page from the text? Then add captions under them describing who/what/when the picture is of?

It seems more streamlined and sensible to me... but does anyone know if the CSC (where I think our petition will go) and the Montreal Consulate have any preferences/issues around this?

I've really appreciated the helpful, encouraging, and constructive feedback VJ people give to each other... and looking forward to starting a timeline soon! :)

    Thanks!
