  1. Before you just do that, Have you called the USCIS and ask?

    Normally, if your case has not been completed in 5-6 months, the operator will put your case as "processing longer than normal" and will send you an email stating that it will be completed in 60 days or you will get a notification of the reason it is taking longer than normal processing time.

  2. My husbands interview is near PLEASE HELP ME i don't know what to do.

    1.)In W-2 FORM WHERE CAN I FIND THE EXACT TOTAL INCOME?

    2.)Is it in no. 18.)LOCAL WAGES, TIPS, ETC.? OR IN no.1.) WAGES,TIPS,OTHER COMP.?

    I send my AOS TO nvc before and i computed as my income the No.18.) which is the local wages,tips,etc.

    If i am wrong what should i'm gonna do...knowing that the interview of my husband is near and I am gonna fill up

    a new AOS and gonna send to my husband.and he will gonna show it to the CO during his interview. PLEASE PLEASE HELP ADVICE ME.

    Relax- The NVC has processed, reviewed and accepted your AOS, If there was any mistakes when you filled the form, it would've had been corrected by the reviewer. If it was not accepted, your case would've had a RFE asking for the AOS again.

    The question you asked, on the W2 - the wage that matter is box 1.

    - residency is a permanent address - not a visitation address

    - He was unemployed for 6 months

    2. You need to show continuation as clearly as possible throught the form.

    - Yes - using "refer to LINE is an acceptable way to fill the form"

    3. When you fill the form, use the address you are living at, not where it is convenient or in our opinion is more safe for mail. USCIS will process your case a lot faster even if your mailing is unreliable. You can easily call USCIS to check your progress and the mailing address nowdays is almost irrelevant as they do not ever send anything but notices which they CC to your email anyhow.

  4. I have been staying in Indonesia since August, 2011. I got married here in September, 2011. There is no USCIS office here and DCF is not an option. On the I-130 I listed my US residence but wrote a very specific and detailed letter about my circumstance; I even noted that it was stressful and expensive but that I would rather stay with my wife during the process. They did not expedite our case and we had to wait 5 months, and got approved in April 2012. We were at the California Service Center. (I am still in Indonesia waiting for the NVC to complete our case). This is the first I've heard about any expedition due to being abroad.

  5. Packages leave NVC everyday. This way of tracking packages has worked better for people filing K-1, People filing CR-1 don't seem to get results tracking their packages this way.

    What I meant to say is that, That it is very likely a shipment is there, but the dhl website limits the result to only 10 unless you are more specific.

    For eg, on june 4, the first result didnt include malaysia. When I put destinantion Malaysia, there was one package there.

    I'm looking for some ideas as to how to contact the embassy in kuala lumpur, malaysia via phone or email. I want to inquiry if its possible to have my wife's interview date, which is scheduled on the 19th, be conducted earlier?

    We have no emergency. We just figured, it won't hurt to ask. My wife is getting restless sitting home in Malaysia waiting for this process to be over with. We have been extremely proactive in putting all the documentations and proof together and She even completed all her medical the day we received the interview schedule.

    Anyone had any luck before or can share experiences perhaps on how to get an earlier appointment with the Consular officers?

    I don't think there are many visa applicants in Malaysia, not in the spouse category anyways, so interview slots maybe available based on this?

    We are applying for I-130 and we checked to USCIS websites on sunday we got confirmation that the status now changed to post decision activity and they have mailed us but we still haven't received it. Can anyone please adv us whats the meaning of this ? it said that we have approved. Understand that learned from everyone here that the next step is will go to NVC then interview ? is that true ?

    What you need with you for the entire process from the petitioner standpoint.

    - Proof of your residence or citizenship

    - Your Drivers license, or ID

    - The Marriage certificate

    - Photo of the beneficiary (spouse) - passport size

    - Biographic page of their passport

    - Birth certificate (spouse)

    - Police clearance for spouse - this Takes anywhere between 1-5 months depending what country the spouse is from

    eg. Malaysia takes 6 weeks.

    - DS230 part 1 and 2 completed and signed by spouse

    - DS3230 - completed and signed

    - tax returns with w-2 recent year only. If you are petitioning for 2012, your returns for 2011 will be the most recent, regardless of which month it is.

    - If you haven't filed taxes yet, returns for 2010 and the last paystub for the 2011 showing the total gross must be sent with all the other supporting finance including all 2012 paystubs or JUST GO FILE YOUR TAXES!

    USCIS & NVC, requires a lot of documentations of you and the person you are filling for, if you have all of the things i listed above- you are in good shape. Only send COPIES to USCIS and Originals to NVC

    As soon as you submit all the forms and fees for the initial I-130 form - do the following.

    1. Get the person you're filling for apply for a police clearance immediately (this may not apply for indonesians). No country has this "certificate of good conduct" available immediately. This is a letter of any criminal history from the country your spouse is residing. It takes 1 - 5 months to be completed - Important scale 10. Have it mailed to you and keep this.

    Get the ds-230 from state.gov filled and signed by the person you are sponsoring and have them sign it but do not date it yet and mail it to you. You keep this until further notice

    When your case is 100% completed in USCIS (5-6 months), you will receive a notice a.k.a (NOA-2)saying your case is now with NVC and they will soon contact you.

    Step 2: The NVC (2 months)

    Wait for about 5 business days, and call NVC (the number is in the letter) and read them your USCIS case number and see if the NVC has assigned a case number for it. The Case number from NVC will start with a City code and the year (for eg; Kuala lumpur, Malaysia in 2012 will be KLL2012*******) Get this number for your case. IMPORTANT!

    What do you do after you get the case number? Assign agent immediately

    Wait few days, and you will get a response and via email and there will be .pdf file attachments that will have the AOS (affidavit of support requirement) - pay that and send it in

    Wait a day or so - the status should change to PAID - Fill the affidavit of support form and submit the documents supporting your claim in that form (w-2, pay stubs etc)

    This will take between 2-20 business days. Just your luck.

    Now you will receive another email asking for you to pay and submit the ds230 part 1

    Now, go ahead and pay the fee, print the cover letter from there.

    Now get the ds230 with the following all originals or certified copies.

    - The Marriage certificate

    Once everything is reviewed, you will receive another email either asking for more documentations or stating they have finished the case. 2 - 20 days later your interview will be scheduled 40 days away.

    I would really advice you to compelte the ds230 and send the needed documentations now as well. It is June 10, and usually the cut off date for scheduling next months interview is next week. If you can complete your case by this friday, you will likely receive an interview in july. If not it'll be much later in august or mid september. NVC is at a crawl right now.

  9. OK, thanks! Just wanted to make sure. Income from Line 22 (on 1040) then? Are tax transcripts acceptable for years 2009 and 2010 (with W-2s)?

    Tax transcripts are not required unless you believe your 2011 federal returns will not confirm to the poverty guideline.

    NVC only needs to see your current income (last filed returns).

    Anything else if 2011 is suffice would be a waste of time.

  10. Yes. NVC process your AOS is by using your federal income taxes. If you filed jointly then you send it as is.

    The W2 you attach with the 1040 will help the NVC determine how much you made as an individual those years.

    However because of the complicated US Tax codes, you must use the correct figures from the 1040. Regardless if it was filed jointly.

  11. If recieving disability, do you mark unemployed and write in "disability" next to it on Line 22 on the I-864?

    No, just the date of when you started to become unemployed, the reason is not relevant.

    In line 23, you can state your annual income. Further in the form, you will have to list all your federal income tax to establish income figures.

  12. I just need a clarification. For income for the past 3 years, I filed jointly with my wife and before that, my ex. For filling out the I-864, do I fill out the amount on my W-2 for each year in lieu of my adjusted gross income or total income, which would reflect the wife's income too? Thanks!

    The completed 1040 with all the w-2 for last 3 years.

    Last 6 months pay stubs as these will reflect your newer income for 2012 if they need proof.

    The figures you will use is the same as whats on your joint returns. It is irrelevant how you filed it as the income there accounted for the household size, and the calculation will be based on the household size Vs Poverty guideline.

Thank you!! :) By the way maybe you guys can ease with this worry i have in my mind, we have a daughter (1 year and 3 mos) old, i gave birth here in Philippines, and she is now an American Citizen and have her American passport issued by the US embassy here in Manila. My question is, does my husband have to include our daughter in the affidavit of support?

    Oh he is trainable. :))

    He has to include her in the household count.

    You must file the tax first, and request transcript from the IRS. A copy of your disability statement for the year should be included as well.

    If disability is your only source of income, then you would still have to send the tax returns.

    Bank statements is not a proof, but won't hurt to be sent in.

    I'll however advise you to call IRS and get your returns ratified first.

    Unemployed unless you have reached the age of 66 then you can claim retirement.

    Fill and send in with the 1040 with all supporting w-2.

    I used the I-864EZ http://www.uscis.gov/files/form/i-864ez.pdf

    As i only needed to send my current tax return and nothing else.

    In the AOS package,

    1.Receipt of the payment

    2.Generated barcoded cover sheet.

    3.Completed I-864 or I-864 EZ

    The address to mail it should be whats on the barcoded coversheet.

    Also, please write down in pencil on top left the NVC case number incase they misplaced your papers.

    Thats all.

    4. All tax returns

    5. Supporting finance statements (paystubs, etc.)

    1 - wht is this OF-169? ????

    2- medical examination .. do they tell me when and where or should I get that on my own?

    I have gotten the police certificate but it expires in 3 months :/ so I will have to get another one ..

    The OF-169 is generally an informational document specific to the embassy other requirements. This is mostly for consular stage once your visa interview has been scheduled.

    It has nothing to be filled- just info. If bahrain has it, it will be emailed to as part of the (P4 FOR NEOPOST DS-1200). You will receive this email when your interview is scheduled in bahrain.

    In the same email that NVC sends to you when an interview date is set, you will have all the information in that email about the medical exam. You will have to wait for this step as the Dr. may need to see the appointment letter.
