  1. Hi guys

    Just wondering if they will want to see the US Citizens 2012 tax return at the London embassy? We filed 2011, 2010, & 2009 when we submitted the AOS but 2012 wasnt due while we were at NVC. However the tax deadline will have passed by our interview.

    If it makes a difference we did not use any income for AOS, applied on assets only.

  2. In case it helps anyone, I recently submitted my AOS with assets-only. I did this because I lived outside the US previously, had zero reported income for the USA, and could not easily document my overseas wages.

    I own a rental property in the USA worth $63,000, with no loans. That, plus about $7,000 in the bank is what I listed. I included a letter stating the reasons for my lack of documented income. Not sure if that letter made any difference.

    Our DS230 was recently requested. I assumed that meant the AOS was approved and we were allowed to proceed to the next step. Is that correct?

    I am providing for 2 and also came up wit the $57,000 figure for minimum. If my assumtions are correct, then $70,000 was enough.

    We also filed I-864 with assets only, as our income streams are both UK based and will stop when we leave. We received a checklist stating that we "do not appear to meet the minimum income requirement". Apparently the ultimate decision is with the consular officer at the interview to accept your asset level or not, despite pretty concrete guidelines at NVC.

  4. NVC keep telling me that its not on the system yet. Its been a month.. :angry: Grrrrr!!!

    Im sending a new set of IV packet again tomorrow.

    Doesn't your IV packet include your original birth certificate and marriage certificate? How would you be able to send another copy?

    I am terrified they are losing mine as we speak.

  5. Okay I'm confused! The checklist says they reviewed our IV package and need my original birth certificate. But on the phone the woman says that a supervisor will be reviewing the package (at the request of my husband) and that they won't know if they have the original until it is reviewed?? I'm sooo confused! And freaking out a little because we definitely sent it so we are screwed if it's lost! :(

    Is the birth certifiacte you sent the short form version? I had to get a certified copy of my birth certificate as my original birth certificate was the british short form type which did not contain my parents names.

    F - FINANCIAL EVIDENCE:______________________________________

    The NVC has received the information you have submitted in reference to the Affidavit of Support. Please be advised that

    the Affidavit of Support information you have provided does not appear to meet the minimum income requirement

    according to the current poverty guidelines to sponsor the intending immigrant(s) for this petition. The consular officer will

    make a decision regarding this requirement at the time of your interview. In order to avoid delays, you may wish to submit

    an additional Affidavit of Support (Form I-864) for a/another Joint Sponsor to the National Visa Center to assist in

    sponsoring the intending immigrants.

    We are both living abroad so our incomes will stop when we move. We are using all cash as we've sold all our assets and living with my parents in anticipation of moving (really didnt expect it to take a year). We submitted current bank statements showing a combined total of $135k, anyone know if that would be sufficient for London embassy? Its mostly in my name (beneficiary). We are a household size of 2.

    On the other hand we were expecting some trouble proving domicile with just a driver's license, bank statement, credit card statement & plane ticket. No problems with that at all :thumbs:

  7. We got a checklist today from NVC (well 2 technically).

    The first was for

    ______F - FINANCIAL EVIDENCE:______________________________________

    The NVC has received the requested Immigrant Visa Application (DS-230). However, we are still

    waiting for the Affidavit of Support form. Please submit the Affidavit of Support form according to the

    instructions on the Department of State website at the following address:

    www.ImmigrantVisas.state.gov.

    From there, you can fill out an Affidavit of Support form online, then print the completed form and mail

    it to NVC.

    When responding to the National Visa Center, please include the bar code sheet that came with this

    letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

    code sheet should be placed on top of all documents being submitted for this case and mailed to the

    address provided.

    Which I'm going to guess is just because while we sent them in together the DS-230 desk is working a few days ahead of the I-864 desk. We'll give it a few days and check back.

    Please submit court or prison records indicating the nature of this person's conviction and sentence.

    These records should bear the official seal of the issuing authority.

    This one worried me so I called NVC. On the DS-230 in the police/criminal info area I put that I had 2 speeding tickets, in 2006 & 2007, in USA, both at less than 10mph over posted speed limit.

    The lady at NVC said if there was no other criminal activity/convictions/court processes, I should just write a statement to the effect of "The only convictions I have are for speeding tickets, as was stated on the ds-230, therefore I have no court records"

    What do VJers think? Something I'm missing?

  8. Assuming your wife is the US citizen petitioning for a visa for yourself. She will need to back file tax returns, at least last years, to have a tax transcript to send in with the I-864 (even if she owes no tax). I do not know if the IRS will mail them internationally, we had the transcripts sent to family in the US and they forwarded it to us.

    She shouldn't need her birth certificate (you will need yours) but you will need your marriage certificate for you to send in with the DS-230. You will also need a police certificate which if you havent applied for yet, do it as it can take some time.

    She can download form I-864 and its instructions online. The original documents that need to accompany it she must acquire (eg you cannot download a tax transcript).

    Also as your wife will be living abroad she will need to prove domicile in the US when she sends in the I-864. There is a ton of useful information in the first two posts of this thread

    Specifically in the FAQs in post 2 it says what can be used for her to prove domicile in USA. So ideally your wife will have brought her US driving license, Voter registration card and any statements/accounts that cannot be printed from the internet.

    Good luck in your application, hopefully when she goes back in June you get to go with her!

  9. You had your NOA2 Feb 28th correct?

    You can keep up with NVC while abroad, as long as your wife brought the required documents to send in with the paperwork with her.

    Your next step would be to get your NVC and IIN number from NVC which can be done by phone call. Also at that point you can give your email addresses to receive correspnodance by email.

    Once you haved paid appropriate fees you will need to send in I-864 (from petitioner/USC) and DS-230 (from beneficiary/applicant). As long as your wife has the documentation to send in with her I-864 it will be fine (the only thing I can think off top of my head is needed and not easy to get abroad is tax returns, but your case may vary).

    Also on all the documentation I've seen it takes a year for the NVC to drop your case because of receiving no response.

  10. Mine just showed as "paid" today. Now I gotta wait til the ds260 becomes available. How long does it take for the IV bill to show?

    IV bill will show when DS-3032 has been received and processed by NVC.

    At least thats the case for most IR1/CR1, it might be different with electronic processing.

  11. we didn't get any RFE. It's very frustrating to see people who filed way behind us and are getting approved.

    We share your frustration Jackie. 8 months since NOA1 for us yesterday, no word. We submitted a service request over a month ago and was told the usual line of "you'll hear something in the next 60 days".
