  1. Hi all! My LTR husband from the UK and I a natural citizen of the US recent received an inquiry from his little brother (18) about what it would take for him to get his degree here in the US. 

     

    I was just curious what process would be most appropriate for him if he was to choose to do so?

     

    Is there any way for us to sponsor him or would he have to get a student visa?

  2. He entered the country Jan 9, 2012 -- But does that matter if he had his green card for 2 years?

    His green card expired July 2015, but we submitted a packet then. We got said packet returned with the denial in November of 2015 because of the fee waiver. Now we have saved the $600 (I got a job in September), and we want to submit it. I'm just trying to prepare myself for what is to come.

  3. So I'll try to make this as concise as possible,

    My DH (An immigrant from Scotland, UK) and I submitted his packet a year ago, everything was included PLUS a fee waiver (we've had really bad financial problems the last 2 years with both being students, and only one of us working).

    The returned our packet because they denied the fee waiver. We accepted this and started saving. We almost had it all saved when another tragedy struck, long story short we have it now, 1 year since they sent it back to us. We are ready to submit with the fee.

    My question is, what should we expect? Of course we've been in the game long enough to know that some of it comes down to who's hand's it in. But does anyone else have prior experience with this?

    - Should we expect instant denial? If so, should we expect deportation or having to start the whole process over again?

    - If they deny us, will we get our money back?

    - Lastly, any tips for what we should include besides an apology letter, proof of our financial troubles (they said there wasn't enough proof included for the waiver last time) and several affidavits of confirmation about our financial situation?

    Additionally, do we send back the original packet that they sent back to us?

    Thanks for any info, gentleness is appreciated as this is a very vulnerable subject.

  4. My husband and I submitted his I 751 in november, which was already a few months late with a fee waiver because currently we only have one, minimum wage income. Our packet was returned to us, stating there was not enough documentation of our financial situation and they would need the $600 fee. We finally have enough since getting our tax return but we are going on one year of his green card (2 year) being expired (July). How screwed are we? Should we be expecting a letter that says he's being deported? What will happen if he is sent home? Will he be able to return?

  5. No I don't think it's rude. This is a step in the process we all are aware coming up. It's just as important as previous steps.

    Alaska just because I'm aware of it doesn't mean I could change it. Saving over 600 dollars in 2 years is impossible for us. Which we proved in our packet. I don't have to prove it to you.

    The point is people think we will have to jump through some extra hoops. Okay, thanks for everyone's input. Close this thread!

  6. Hello there! Nice to see another Brit filer! In my opinion (which is all it is) you should be absolutely fine as long as you submit your husband's orders in time. Try to be as punctual as you can and be prepared for the possibility of another interview. If all of your info is genuine and you do have a valid marriage, you have absolutely no reason to worry. In all the time i've been doing this process, it seems that Brits have very little problem with immigration (as it should be! :P)

  7. He didnt overstay his visa, he was 90 days late filing ROC, AKA filing for his 10 year green card. most people have said a small lapse isnt a big deal as long as its not years late. Also there fee waiver is a form you include with your packet, not a special treatment we are asking for, we were just unaware it existed until recently. Thanks for your input though.

  8. Hi there VJ ROC Community!

    My lovely husband and I have finally filed our ROC forms due to the fact that we couldn't afford to file the papers (both going to school and working min. wage jobs). Glory Hallelujah we found out that there was a fee waiver if you could prove you cant afford the fee, which we noted in our packet was our reason for filing late. Should we anticipate any road blocks or even speed bumps along the way? We filed on 10/27 and haven't received our receipt yet but I figure that's average.

    What do you guys think? We included all our fee waiver evidence (Low income evidence), and letter explaining why we were late. Should we be okay?

  9. I'll make a long story short. British expat hubby is airheaded to say the least and it has come to our attention that while he insisted his green card expired in AUGUST, It truly expired in JULY!

    It was a two year card based on our marriage (I'm sure my rage would have served as proof of a viable relationship! lol) and we were filing for removal of conditions when the discovery was made.

    WHAT NOW!!??

    I know there are a bunch of worst case scenario users on here but according to them my hubby was going to be deported on the spot three years ago, so i'd like to hear the truth about what our next move should be.

    I'm sure they wont deport him, but what possible fines or procedures have we unknowingly incurred.
