    Actually, I don't understand too, It happened during the late 80's, she was very young and naive I guess, she didn't even graduated from elementary, and yes I know ignorance of the law excuses no one... It's just sad that this will affect my intention to file a petition for her... My Father knows that she is already married, sigh...

I'm planning to file a petition for my Mom, but the problem is she is still married to her first husband when she married my Father. 🥺When she was 14 years old she was sold by my grandmother to her first husband. After 2-3 years she had managed to escape the first husband and then she met my father, and got married without annulment with the first husband.

     

    Now I'm worried what required documents should I be sending when I file a petition for my Mom. Will she need the following documents?:

    • CENOMAR OR CERMAR
    • MARRIAGE CERTIFICATE

     

    I really need her here with me.  If someone could share some answers, I would highly appreciate it. By the way she is from the Philippines.

    :thumbs:, and i will answer some of your questions.

    I saw my mom's marriage certificate with my sister's father (better to name him MR. A) and the certificates shows she's only 15 years old and 10 months at the time of marriage.

    To answer the questions if she was ever convicted because of Bigamy. NO :no:. she was never convicted.

    After 2 years of marriage with Mr. A she left him and never had a chance to see him again, he never filed any cases. He did not even made a move to make her come home.

    (After 25 years,i think they're OK now).

    After 3 years, then she met my father, and married him. During those times, you don't have to present Cenomar to get married.

    I'm thinking of getting a Philippine lawyer, i asked my professor in Law, and he said "marriage at the age of 15 in 1986 is void. The prevailing law at that time was the Civil Code, which says that marriages contracted under the ages of sixteen and fourteen years by the male and female respectively, even with the consent of the parents, are void from the beginning (Article 80)."

    However because he married my father without final court declaration that the first marriage is void , that makes the second marriage also void :bonk:.

    Thanks you guys for your answers, maybe it's better for me to go home to the Philippines, before filing the petition for her. :idea:

  4. Hi Everyone,

    I have a serious question here.

    I'm planning to file a petition for my mom soon, the problem is she has a previous marriage before she married my father when i was 7 years old, her first marriage is not terminated yet or annulled when she married my father.

    When she was a teenager she was forced to marry my 2 Elder sister's father, my grandma sold her to their father, now i'm afraid that this issue will affect the said petition i am planning for her.

    Second, I don't have Job as of today, only hubby works for us now, Is that fine if his income is above the poverty guidelines? I need my mom so she can take care of my LO, so i can work. hmm :(

    I really need advice :(

    - Two passport-style photographs (2" x 2")

    - Copy of bio-data page of unexpired passport.

    - Original Birth Certificate plus a photocopy.

    - Original Marriage Certificate plus a photocopy.

    - Original NBI/Police Clearance plus a photocopy.

    I'm worried about sending our i-864EZ, my husband was been unemployed for 2yrs., he was not able to file ITR for 2011, because he got his new job last march 5,2012. We are planning to send his 2010,2009,2008 Tax Transcript because that's what we only have, but i worry that it might be useless because i think what nvc needs is the latest tax year (2011 transcript).

    Do you think Employment Letter, Paystubs will be enough as proof of his current income. He wrote a letter that explains he was unemployed for 2 years that's why he was not able to file ITR for 2011.

    and to question no. 19 [FEDERAL TAX INFORMATION] because 2011 was the recent tax year and as i said he was not able to file for 2011.

    I really need help and advice VJers. :(

  7. Surely there's a reason why she was acting like that, not just because you think that she is cheating on you, you could just send her back to the Philippines as if nothing happened.. Beers, Bars, Staying out on 3am and a guy from Facebook can't prove the she is cheating unless you caught her in the act,suspicions could not help you resolve your problems. Talk to her about your relationship's issues, Ask her straight to the point,ask her if she still loves you and listen to her..then after that,that's the only time you should make a decision... but think for a million times.. Ask your lawyer what's the best thing to do ... When marriage have problems, the first thing that a person should think is how to save it, not to find a reason to end it... the day you put the ring on her finger, that's the day you promise to love and to stay with her no matter what happens..

My Husband has been unemployed for almost 3 years,2009 til 2011 he got his new job last march 2012, we're thinking about sending his 2008,2009,2010 ITR Transcripts since it was his only recent transcripts, and explain it on cover letter, do you think nvc will accept that and would not send us RFE? And i would like to ask what is the minimum household income for this year?

  9. No, you would have sent proof of his citizenship and your marriage to the USCIS already with the I-130.

    You need to provide his 2011 IRS tax return transcript, they prefer if you include 2010 and 2009 as well. If you have his tax return transcripts, there's no need for W2s. There is no need for 6 pay stubs, we just included my wife's most recent pay stub (they say YTD earnings on them).

    You do not need his passport pages, marriage contract, bc or anything of that nature.

    If you're using his current income to meet income requirements, this is what you need:

    - Bar coded cover sheet from NVC payment portal.

    - Filled out and signed (by petitioner) form I864.

    - 2011 IRS tax return transcript. (1040s or W2 will work, but transcripts are much easier, and preferred by both the NVC and consulates)

    Recommended to include:

    - Petitioner's employer letter and/or work contract.

    - Petitioner's most recent pay stub.

    - 2010 and 2009 IRS tax return transcripts.

    We sent the above and it was accepted by the NVC.*

    *If you filed taxes married filing jointly, I would include a cover letter to the NVC explaining why the personal income stated on the I-864 is different from the combined income on the tax return transcript - We did get an RFE for this.

    he filed his last income tax return as married, but it's not combined income because i'm only his dependent, do i need to explain that to a cover letter? and he only have 2010,2009,2008 because he was not employed for 2 years, im thinking to explain that too in the cover letter.

    - Tax information* of petitioner (either just the last year OR the last 3 years)

    - Employment letter of petitioner (optional, but good proof of CURRENT income)

    - Pay stub(s) of petitioner (optional, but good proof of CURRENT income)

    With joint sponsors:

    - All of the above of the petitioner

    - Completed, signed, and dated I-864 of joint sponsor

    - Tax information* of joint sponsor (either just the last year OR the last 3 years)

    - Proof of US citizenship/residency of joint sponsor (ex: copy of US passport, US birth certificate, US naturalization certificate, or front & back of green card)

    - Employment letter of joint sponsor (optional, but good proof of CURRENT income)

    - Pay stub(s) of joint sponsor (optional, but good proof of CURRENT income)

    If the joint sponsor is a household/family member, also include proof of that relationship (example: if a parent is a joint sponsor, include the petitioner's birth certificate with parents' name on it to show link).

    *You have two choices here of what to send in:

    - Tax return transcripts ordered from IRS (preferred by NVC and of most consulates/embassies) RECOMMENDED

    OR

    - Tax returns (1040) and W2s and any other schedules (if applicable)

I know when my husband submitted his email he got a bounce back email from the NVC it was a generic we have recieved your request email anyway did you get that when you submitted your DS3032 that would be a good indicator that they have recieved it also it took about 7 days or so for us to get the email I was appointed agent...

    i send my ds3032 choice of agent via Email(written according to james's shorcut) last week.

    it's been a week and im starting to worry, thinking now if do i

    really have to send another choice of agent through Mail,

    or should i wait for NVC to respond on my email.

    Please i need some advice i really don't have an idea what to do next...
