    At last, USCIS is starting to pick up the pace. A week ago, 10% of March filers received NOA2. Today, we're at a solid 34.5%, Now if only the service centers were on the same timetable....

    You have failed to grasp just how serious this backlog is. It is nearly a half million petitions. USCIS really let this get out of hand. Do you still think this qualifies as a "little backlogged"?

    Really? You're not stunned based on that figure alone?
    You insist on more? Okay. There are a little over 2,000,000 pending petitions, and our backlog makes up 25% of that. One single type of form makes up 25% of the backlog. I suppose that this is "only" 25% as far as you're concerned. Well, I-130 petitions are make up 5% of all submissions.

    We need support from all members here for the best effect. The original outline:
    1. There is statistical and documented proof that the USCIS let I-130's for citizens pile up in order to faster process I-130 waivers and DACA's
    2. This also happened last year with I-129's and DACA's
    3. Congress must investigate, as this is a violation of the INA
    4. Congress must not pass an amnesty bill which will hurt legal US families
    5. Congress must ensure that the USCIS does not return to its old tricks of putting one group on the backburner, in particular in order to help illegal aliens in this country.

    Some of us strongly oppose no. 4 and probably part of no. 5. Hey, we're not too far apart on this. We still make a strong case if we remove no. 4 and edit no. 5. The downside is that we would lose the support that anti-amnesty lobby could bring to our cause. The upside of course would be that we would have everyone on VJ bringing their full support. We all did this together, and we can do it again.

    I agree. We managed to get a PR response, which is quite an achievement, but we cannot be so sure of the end result. With amnesty possibly in the pipeline, someone who is trying to get immigration benefits the proper way may have to pay the price. Everyone here knows just how that feels.

    I, personally, think that there should be a path to citizenship that doesn't involve half a century of waiting for your normal person. I even support DACA. However, I do not for one minute think that they should be prioritized above US Citizens who are bringing their family members in legally. That was a decision that the USCIS made, instead of any number of other ways they could have dealt with the situation.
    They did not have to stop processing stand-alone I130's. They could have spread the work load out by taking adjudicators from all divisions, and then hiring more people. They could have continued shipping the I130's to the field offices. They could have announced the problem to the public so that we could have made better plans for our families, or delayed our filing dates until they dealt with the influx of DACA applications. They could have revived the K3 visa and actually processed it in a decent amount of time. (Like the K1's who are blazing through in under a month, or the LPR's spouses who are under 5 months.) They could have, at any point in time in the past several months, told us the truth and gotten their asses in gear fixing the problem. They could have given us accurate processing times. They did none of these things. Instead, they tried to convince us that increasingly long amounts of time were normal processing times, and we should be happy for the privilege of waiting to be with our family members for years, despite their main goal being FAMILY UNITY.
    THAT is what we should focus on. If they are incapable of following the law, and responsibility that they have, and instead spend all of their time trying to figure out how to get around their own rules, then they should not have that power anymore, or more severe penalties/actual recourse for the petitions needs to be inserted into the process. They need accountability, and at the moment they have none. And they have worked to counteract any kind of recourse we might have had simply by changing their priority date, not updating their processing times, refusing to provide actual answers. We need to pressure congress into removing the absolute power that they have over the cases and inserting some kind of actual oversight and accountability. (And the fact that the USCIS was caught with agents claiming overtime hours while sitting at their desk watching Netflix instead of working on cases, while we sat here without our spouses, is disgusting. Seriously, whomever approved that overtime scheme should be fired. Immediately.)
    Stating that the DACA applicants were prioritized above us is true. As were fiance's, and the spouses of LPR's. However, I think attempting to pressure the government on the topic of Amnesty is missing the point entirely and will not at all fix the underlying problems that exist inside of the USCIS. Which is what we want. It's not the DACA applicants fault that the USCIS did this. It's not Obama's fault either. The USCIS, independently, decided that stopping the processing of the I130's in the field before the NBC was open was a good course of action. (Seriously, go read the FOIA documents.) The blame rests solely on them, and THEY should be the one we hold responsible.

    Yes, we can never be certain that USCIS was not planning on making an announcement in the coming days or weeks, or that next month they planned on updating I-130 processing times. Have they ever updated processing times twice in the same month? I doubt it. We got their attention. Now they know we exist. We are on the radar now! They know there are a LOT of I-130 petitioners out there, and if we connect with more of them, we have some serious numbers behind us!

Have they ever updated processing times twice in the same month? I doubt it. We got their attention. Now they know we exist. We are on the radar now! They know there are a LOT of I-130 petitioners out there, and if we connect with more of them, we have some serious numbers behind us!
