Nakashima, check the envelop that you received from Delbros. According to CFO, the Immigrant Data Summary should be stapled in your envelop. It is a document printed by the US Embassy t hat's according to CFO). Only CR/IR visa holders are required to submit the IDS.

You may want to call CFO at 561-8321 local 201 or 203 to double check above info.

Hi,
I just became USC last week. I want to bring my parents and younger brother (currently is 20 years old) to the US.

I knew derivative visa worked in the past (4 yrs ago). My oldest brother sponsored for my family with parents and brothers/sisters. Then my parents and under-21-unmarried brother and sisters came to USA with my parents. The older and married sisters had the file separated into another file and they came to USA last year.

Now I’m confused. If your parents and unmarried brothers/sisters are already in the US after having been petitioned by your oldest brother, why would you be petitioning for them again?

Unmarried children of parents sponsored by a US citizen son or daughter cannot "piggy-back" on their parents visa. They have to be applied separately as F1, F3 or F4, as the case may be.

You have the option to petition your brother at the same time as your parents. Your parents would be filed under "IR" (Immediate Relative) and could receive visas within one year while your brother would be filed under "F" (Family) which could entail a 14 year wait based on current Priority Dates processed.

You also have the option to petition your parents first then wait until they become citizens so they can file a petition for your brother.

If you wait until your parents become citizens, below is a likely wait scenario for your brother based on the current Priority Dates:

1 year - time to process your parents' visa

5 years - wait for parents' citizenship

6 years - waiting period for F1 (unmarried son)

----------

12 years - total wait period if parents petitions your unmarried brother

3 years - additional wait if your brother becomes F4 (married son)

----------

15 years

Please note, however, that if something happens to the parent while a petition is pending, the petition "dies" with the petitioner.

I’m not sure if two petitions can be filed on behalf of your brother. One to be filed by you now and another one to be filed by your parent as soon as they become US citizens then see which one gets processed first.

Optional Form 167 (OF-167). This is a form entitled “Evidence Which May Be Presented to Meet the Public Charge Provisions of the Law” and is not submitted to the embassy. It’s just a guideline on how to meet the public charge law. Below is a link to a sample of OF-167. If you look at the bottom right of the page, it identifies the document as OF-167.

I went through Manila Embassy and they took my Affidavit of Intent to Marry. In essence, the affidavit said “I, THE USC, reiterate my intent to marry my fiancee ____________________ within 90 days of her arrival in the USA. Signed this ____ day of _____________. It need not be notarized.

Not sure if Frankfurt Embassy requires Affidavit of Intent to Marry.

Sad to say but there is no "21 years or older siblings rule". Your brother is not entitled to derivative benefit from your parents even if he is less than 21 years old.

A child less than 21 years of age can only get derivative benefit if the parent is the beneficiary of a fiance or spouse visa.

Your brother qualifies as an F4 for family-sponsored visa and currently there is a 14-year wait for that.

patiently waiting when you went to your interview before did the consul ask about the anullment papers..like the (entry of judgement) and the letter from (solicitor general) or just the decision from the judge?

During my interview, the consul already had in his hands a copy of my annulment papers from the I-129F that my fiance submitted. The documents that we submitted with the I-129F are the ff:

1) Decision

2) Certificate of Finality

3) Certificate of Registration

4) Copy of Marriage Contract with annotation declaring my marriage null and void

I still brought with me a copy of everything listed above during my interview just to be sure. I did not have a letter from the Solicitor General (and the consul did not ask for it) but if you have a copy of that, submit those or bring them with you during the interview.

Yes, you may have the document corrected at the time of the interview. Rebelheart’s son had his name corrected during the interview.
