  1. When applying for a GC And then USC. Are the interview questions the same? What is the difference?

    What kind of background check is ran for both status?

    No the questions asked at GC and USC interview are not the same...and the background check is a FBI check via finger prints and pictures.

    I suggest just you start and finish one process before worry about the next.

  2. I know it is more frustrating waiting once the interview is behind you...this person hold the next step of your life in a drawer in their desk. I was told by someone to relax that it had only been 2 days but this person already have the green card and already had that sigh of relief the USCIS is behind them.

    Anyway I am trying to be patient and just go with the flow...still not sure what we want to do regarding the EAD so very confused.

  3. According to USCIS site this is what the decision phase means

    Decision

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    For baltimore the processing timeframe for I-485 is August 26, 2011 our PD is December 29th 2011 does this mean we are looking at a 4 months wait or so?

  4. EAD is free to apply for if you applied for I-485 and I-130. EAD takes 30 to 90 days to receive, I think it would be wiser to just wait for the decision.

    we did not submit the the forms together.. the I-130 was approved since 2010 and then we did the AOS..when i was looking at it it the work permit application was $300+

    oh well I guess we are stuck in the waiting game

  5. I had my interview on March 13 2011 and I am still waiting. I called them and they said that I have to wait 12 more days and If I don't hear anything from them, then I need to call them back and they will tell me them why it's taking more than the processing time. Hang in there my friend

    yasjay001 was that 2011 a typo or you have really been waiting over a year...omg I hope we dont have to wait that long.

    We decided to try save some cash by not applying for the EAD as I was foolishly advised that is can be a waste of money because the AOS is moving so fast that most people are getting the EAD and then the GC only a few weeks later.

    If we are going to wait for that long can we still apply for the EAD after we have had our interview?

  6. Some IOs are not allowed to approve interviews and have to report to their supervisors before approval is authorized. It depends on the nature of the interview. If your question is regarding interviews that went well and the beneficiaries were told that everything was okay, then the normal time for status change can occur as soon as a few hours later to a few days.

    At the end of the interview she said everything looks great and that she will review it again....she placed our file in a drawer with some other files.

  7. Hi all

    Had our interview today in Baltimore...Adjusting from B2.

    Interview lasted about 10 minutes with mostly routine questions that were found on the application.

    My husband who is getting the green card was asked most of the questions which included:

    My birthday, my mothers name and where does she live, when he came, POE, has he left since he came and how we met.

    I was asked his parents name and his birthday.

    She asked if we wanted to give more evidence of marriage, and we gave her pictures, bills, insurance and lease. Said we will review the case again and we will get a decision.

    Went on to say that green card is usally mailed within 3 - 6 months but people get it sooner.

    Based on that we are assuming she is going to approve..keeping our fingers crossed.

  8. Hi all well the interview is behind us...

    Appt was for 9am and we arrived to fallon building exactly 8:30am to find a line wrapped around the building. It was freezing cold so the security allowed all people with children to come inside and wait, but only one parent the other had to stay in line.

    While waiting the security scanning machine decided to stop working which slowed down the process even more. So at 9:10am my husband finally got in the building.

    We took out letter to the receptionist took a seat and waited about 5 min and our name was called. I was surprised because the waiting room was full.

    We got sworn in and straight into the interview. took our ids and at this point my husband the who is the one getting the green card was asked most of the questions. Verified the yes and no questions from the application. He was asked my mothers name, where does she live, when did he get the US, where did he enter..when did we get married, when was my birthday and where did we meet.

    I was asked both of my in-laws first and last name and my husband birthday. She asked if we had anything else to add and we gave her our lease, bills, insurance and photos. She looked at the photos and gave them back and asked if she could keep the other stuff and of course we said yes. Said everything looked good and we will get a decision in the mail and that the green cards are usually mailed within 3 - 6 months but people say they get it sooner.

    I asked if she would update our online status and she said she was not the one to do that but we can check in 2 weeks.

    She put our file in a drawer next to the desk and showed us out.

    For those of you interviewing in Baltimore my suggestion is to get there more than 30 minutes in advance to clear security especially if you have an early morning appointment.

    For those adjusting from B2 she did not ask any Visa type questions which i thought she would have as my husband and I have been married 2.5 years before submitting the AOS

  9. Our Journey…

    Husband and I met when we were 17 years old and we never looked back since.

    After years and years of waiting out of the blue I got my green card through by Dad. This was in 2006. Even then my intention was to go back and forth between the Us and my country just to maintain the green card.

    2 months later hubby and I were in an accident and I travel back to the US to seek medical attention and that’s when I decided to stay and start school. We stayed together I was home every holiday and he could come and visit me.

    2009 he came for my First college graduation and that’s when I bugged him enough and he decided we should get married.

    August 2009 married…the plan was I would finish school and then move back home…but he came to visit few months after the wedding and in no time I turned up pregnant. That’s when I said maybe we should try to get his green card.

    We applied and the 130 was approved it said he was not eligible for AOS. I was not sure why until a few months after when someone told me that LPR can not do AOS. So we were back to our plan. I move home when I was finished with school. Hubby came back and forth during the pregnancy and was here for the baby’s arrival.

    Again life plans for you when you least expect. About to graduate 2nd college and I got went to a random career fair and landed a great job…so we then changed our plan…I work for one year get experience while saving money to build a house in our home country.

    During that time I had gotten my citizenship and was happy because I would not have to worry about being out the country for too long once I leave. In Dec 2012 hubby came and was expected to leave in April after my birthday. I was showing him my new passport and certificate and all the other stuff from my naturalization envelop to him…so happens my sister was on skype and said hey you are a citizen you can do AOS now,

    And so it begun….my AOS journey from B1/B2

  10. Even at 4 mo. it can be hard, we took her down to one of the better photo shops (portraits) in the PI and the guy had us lay her down on a blanket took 3-4 photos and changed the background. One blue and one white, for both her passports.

    Our son was 3 months when he got his passport...the guy at the post office just put a white blanket behind his head in car seat and snap the picture, as a matter of a fact he eye are closed in his passport picture. Hubby and I laugh because he looks so different now than in that picture.

    But we have traveled a few times with no problems

  11. Here might be a bit long, but please stay with me. I am starting to get tired and headache now.

    1- I am LPR. Filed I-130 for wife.

    Priority Date: 03/30/2011.

    I-130 approved 09/22/2011.

    Paid AOS, sent DS-3023 04/02/2012.

    Received IV Bill for $404 04/04/2012 (not paid yet). I am here at the moment.

    2- I am LPR since 05/03/2012.

    Filed N-400 for myself 03/02/2012. I took advantage of the 90 days before the 5 years period.

    Received by USCIS 04/06/2012.

    Fingerprint done 04/04/2012.

    Here are the question.

    I am at the stage of gathering my wife IV civil documents. The only thing I don't have is police certificate.

    I have a relative come to U.S on 06/02/2012, so I can have her police certificate with my relative. BTW, Police Certificate in my country only valid for 3 months(called and verified).

    - Should I paid $404 and send all IV application without Police certificate ? Then when I get my citizenship I can update my case status to immediate relative, along with police certificate? Would this complicate the case when I have missing doc (police certificate)? or what should I do ?

    - If I have my N-400 interview before 06/01/2012, even if I pass, IO will put a hold on my application because I am not LPR for 5 years yet. Is it true?

    If it is exactly 90 days prior to your years your application will be processed as normal. Once you become a citizen you simply send a letter to your processing center with you case#, wife's information, your information and a copy of your certificate and US passport requesting that your preference catergory be updated.

    Regarding the bill I would just pay it and be done with it. For the police certificate I dont remember if I sent one with my husbands AOS application but I am leaning toward no I didnt and we did not get a RFE asking for one either.

  12. I didn't expect any interview notice in the near future until I saw this:

    There are 28 cases reported for the month of January.

    2 have already been approved, 16 more have been scheduled for interview. That's total of 18 cases out of 28 that

    has either been approved or got IL. That's 64%. Only 36% waiting for IL (and if you look further, out of those 10 remaining pending some haven't updated the trackline since 7th of March so some of them may already got IL).

    Of course this data has very little statistical reliability and can't be used to make accurate conclusion about

    individual office processing times, but could Baltimore. MD be so much behind? Or could it be that all the people who post timelines on trackit share some hidden variable that explains fast processing of their cases?

    I called USCIS , was told to wait at least 60 days after receipt of RFE before making further inquiries, so for now will have to just wait and contact them only second week of May

    if IL not received by then.

    If more Baltimore, MD filers shared their timeline we would have a better picture of current processing times at our local office.

    It really depends the information provided, while we want to trust that it is true is something not accurate. Example. I filed for citizenship in baltimore already did it passport in hand voters registration card, but USCIS status update site says test and interview. Even then I filed in August 2011 and according to the processing time frame the Baltimore office is reporting that they are working on june or july 2011 cases. So at the end it all depends and which immigration officer desk your case lands on and how efficient they are working. Sorry to say the next step in our lives depends on if this person feels like being productive or not.

  13. Mine is still relatively early in process ( Baltimore, MD shows July priority dates with last update on December 2011 , so assuming they have the same time period now my interview could be scheduled anywhere by May and it's only March now).

    But I was curious if a poster above got an email update before IL , because it seems from the timeline like they had 'card ordered into production' email/text and then got EAD and IL in mail , with the interval of couple of days and without any email/text notification.

    In any event, my local office is in different district and it is not likely to schedule an interview anytime soon. Just being curious and impatient, like a lot of applicants are :)

    P.S. Any Baltimore, MD filers on this board?

    I filed at the end of Dec application received on the 29th...had a RFE took a month to send that back (had to wait to get a joint sponsor) and 9 days after it was sent received interview date for April 12th in baltimore. Now all I need is a way to get around the expensive parking in the city.

  14. Did he intend to immigrate when he came in December? If so, you are potentially looking at visa fraud. What, if anything, was he asked at the border?

    I am not sure what he was asked when he came...but once he got here i decided to do the AOS. had no clue about b1 visa having issues..after reading only usc can do aos i assume it did not matter the visa tpye. he has legal stay until june but was scheduled to go home on april 1st and our interview is on the 12th.

    just wish i found all this information before starting this process...i just went from the basic stuff i got from uscis site and did it myself seeing i cant afford a lawyer

    I dont even know what the right step should have been seeing that staying here was not the first plan
