  1. Hello,

I am a U.S. citizen.......my 9 year old biological son is still in his country of citizenship. He is still waiting for approval of visa. In May of this year I will be entering the U.S. military.

My question is if I become based at an overseas base will my son be able to live with me without being considered as abandoning his green card privledges?

.......and if I am already stationed overseas when his visa is approved does he still need to enter at a U.S. port of entry?

Thank you in advance for your advice.

  2. Following this topic and all of Manilaraf's posts :)

I'm a dual citizen filing an I130 for my husband DCF US Embassy Manila, and just waiting for our approval and to move on to the next step. I'm worried about the part where we submit the I864 affidavit of support.

    1. I came back to the Philippines in 2004 to finish studying. I've been working at a callcenter for about 3 years thus have not filed any Federal taxes to the US since then.

    2. I have been earning a living via online freelance work which is about $5000 below the poverty line (married - 2 with just 2 in our household) but a baby coming in a few weeks - so I'm not sure if we still put 2 or 3 for the number in our household since baby wasnt born when petition was filed...

    3. We have family assets: real estate, small family corporation with construction machinery, and bank accounts

My question is: what official documents will i need to submit for the assets to supplement my income? When you say just a letter, does it need to be notarized? Etc..

You made a mistake.......As a U.S. citizen you are still required to file an income tax return for the U.S. government. You will now be required to file your tax returns for all of those years that you spent in the Philippines......Good luck to you.

  3. Not sure what is going on when you try to complete the account, are you making sure to choose immigrant visa when doing the setup?

Yep.....the first question it asks is what type of visa......and I check "Immigrant".

I think I will call the embassy call center.........I have only had to do that 1 time before.......not a fun process.....under paid call center workers.

  4. Yes you should have an interview date first before you can register for 2GO.

Are you the one scheduling the interview or NVC?

If NVC sent you the interview letter, you can fill out the 2GO delivery card at the embassy.

NVC schedules the interview date for all immigrant visas......My son has an interview date

But they still want me to schedule an interview date before I can complete the online registration for visa delivery.

    Government websites......yuck.

  5. You are an immigrant visa, NVC does the scheduling so you have to be patient in that regard. As for delivery instructions, I would have thought NVC would have a section somewhere on a form for you for delivery instructions. I do see this concern with other immigrant visas which is why I think NVC does ask. Just the same, once you have your interview appointment update delivery on the account you are setting up, OR at the last window after the interview update deliver to SM.

Yes, I know it is an immigrant visa.....This is my 3rd time petitioning an immigrant visa.....

My son already has an interview date.....hence my problem......NVC schedules the interview

but the delivery process has changed.....It use to be that you request your visa delivery address at the interview

but now they want you to online the visa delivery address through USEM website......and they want you to schedule your interview during this process

I can't.....he already has an interview date.

  6. You do not schedule delivery through 2GO, you do that with USEM/NVC, visa will be delivered to the home address listed unless you specify another address.

Yes, I understand that....I think maybe I wrote the sentence wrong.

I am registering through USEM Manila........It requires that I schedule an interview before it lets me complete the process

My son lives out in the province, so I am worried about delivery

I was hoping to have delivery at SM.

  7. Our petition was approved last May 18. My fiance decided to call NVC for the case number. They told him that it takes 35 days for the USCIS to send the package to them, and it'll take 2-3 weeks for the NVC to process it, we will get a case number by the end of July!! Could this be possible? Is it really that long to send an approved package to NVC...

You should feel blessed it takes 6 months to process an immediate relative through NVC.

  8. So, I tried to register online for the visa delivery address for my son through 2go.....It seems they will not let me finish the process unless I schedule the embassy interview.

Did anybody else have this experience???

    Please help......

  9. I would start by asking NSO what would be the process to get this "created". You may want to talk to the local registar in the barangay where your parent was born or lives.

Yeah, my wife has a very close friend who is retired city hall worker......She actually helped us expedite our wedding in the Philippines. We will start with her to help get a birth certificate registered at N.S.O. I think we can get it done without a lawyer......knock on wood.

The only problem is Tatay was born in Ormoc, Leyte.....but to late register he will have to be born where he currently lives......He doesn't like that.

Sorry I must have misunderstood, I thought it existed previously and was just lost or something. My apologies.

Also when I said request from consulate, I know there is no consulate in home country, I meant from home country consulate in the US. Again, I apologise for the misunderstanding

    No problem.....you're ok.

  10. Another option to obtain a visa other than through marriage is H1B, "available for offers of employment that are in a specialty occupation". Do you have special skills, training, knowledge that would benefit the US of A? You write that you chose to abandon the education you were allegedly pursuing here and preferred to fall out of status.

There is not much sarcasm in this thread, but certainly answers you don't want to hear. You made choices in your past and are now facing the consequences. This is called accountability, and understanding it is part of growing up. And noone on this forum can undo the choices you made in the past. Only you can learn from it, move on, and do better in the future.

Based on what you write, I think you are out of legal options, but should talk to an immigration lawyer to make sure. You can try to leave the US quietly without drawing too much attention or continue living in fear of getting busted and incur a multi-year ban. Once more you are faced with a choice.

There is no way he can leave quietly....even if he could, he will still have a ban for overstay.

I'm betting he does not even have a valid passport anymore....as Philippine passports are only issued for a validity of 5 years.

  11. So, I am the petitioner (sponsor I-864) My wife is the Co-sponsor (household member I-864a)

We file our Federal taxes jointly.....

We got a checklist......It says..." Item 11. Your__2013__ income must match the total income reported on your Federal icome tax returns.

My question is.... Do I enter my wife's total income for 2013 or (since we file jointly) do I enter the total income for 2013 (my wife's income and my income combined)?

    Thank you for your help....

  12. The OP and the 'friend' are already in a relationship.

Often Canadians, especially those in border towns, take advantage of the generous travel opportunities we are afforded. Her attitude doesn't sound or smell like poop, stop being judgmental.

    Good luck

    Nope......

    It smells like poop

She had no intention of marriage (until strangers suggested that)......hence no engagement

She even posted this topic in the NON-family based visa forum.

She was looking for US citizenship based on...???

She was then told to marry her friend of a different sex to obtain a visa.

Like I originally said.....smells like immigration POOP.

......and on top of that a k-1 visa........The visa that can easily be used for illegal permanent entry into the US if the applicant so wishes to use it that way....

  13. This smells like POOP.....

A woman who wants to move to the US and stay with a friend....get a job.....and become a US citizen.

Now all of you are suggesting that she marry her friend just to get a visa......

    This smells like immigration POOP.....fraud.

She NEVER once stated ANY intention of "serious relationship", "engagement", "marriage".........just wants a job and citizenship while living at a friends house.

  14. You have to remember that USCIS processing is only pat of the story; after that comes NVC, then ship the case to the embassy, then waiting for medical and an interview slot...

Exactly......and NVC can take longer than the petition approval.

We have done everything as fast as possible through NVC.......after 6 months at NVC we are still waiting.

I remember when I petitioned my wife....the NVC process was about 2 months.......NOW it is a crazy long time at NVC.
