Living apart for legitimate reasons DOES NOT mean there is a high chance that your green card will be denied. Sorry but your lawyer is talking utter rubbish.
You may have an interview but if your marriage was entered into in good faith, you moved to try to save your marriage, you gave up the opportunity for a green card through another avenue, you have solid evidence of a bona fide marriage, then there is no reason for a denial. A long process, yes. A denial, no.
Your next step should be to drop that lawyer. This is a process you can file on your own. Please do not pay the lawyer anymore to "work" on your case. You have more evidence than many who were approved.
Sorry but that lawyer's egregious statement/conclusion REEEEALLY bothers me.

Hello VJ friends.....
my 10yr GC production was orderd....
I just want to share the info about how i assembled my package...
I used ACCO fasteners in the top of my package to hold together my package...... and then i labeled it at the bottom.... as in the pic shown below.

I think you should still resubmit the 2012 tax return with you petition. You need to try to submit it as early as you can within that 90 day period from everything ive read on here. But i see what you are saying. It would be a good extra evidence but you need to leave time incase your petiton is lost in the mail, or if you did not fill out your form correctly and need to resubmit it. They also need time to issue you your one year extension. Alot of couples on here submit only 2 years from what ive seen. I think that waiting for the tax return might be pushing it. But then again there are lots of couples that wait alittle before filing because they dont have there packets finished yet. I think that if you wait till you get your w2 and then you have to wait to get your tax return back it may take to much time.

Hi Regan,
If they are asking you to list all your children then that is what they want you to do. My son also has a consular report of birth abroad and is a US citizen but I still listed him because that is what they are asking for. I left the A# blank because as you stated, the child doesn't have an alien # since he/she is a US citizen. You are not going to mess anything up by giving them too much information so definitely include your daughter's info.
As for part 5, if you do not have any disabilities that require the types of assistance that they are referring to then you would check "No" in each of the three boxes.
