  1. Hi Bellsbells,

    I am exactly in the same situation. Our intention was that to respond to the checklist after 6 months. But I received an email about the interview time for 7th of November at Madrid. I do not know whether to go for the interview and green card or postpone the interview time?

    The problem is that I can not establish residency there within next 1.5 years because I am doing my PhD here, and I need to finish it in advance. Can you please let me know what have you done? is it possible just enter USA and stay there for two weeks and start the green card process and then come back again ( I can use my uncle address to receive the green card)? Or I have to wait there to receive the card?....

    Actually we want to move there after I finished my study here. But now I have all your previous questions in mind. I am wondering if you let me know how you solved this problem?

  2. Hi all,

    This July I received i-864 checklist for the joint-sponsor(he is my uncle!). As they mentioned in the checklist, joint-sponsor, needs to fill in the form with typewriter (no ink) and joint-sponsor income and contract is not similar (because he had sent the tax form for his salary plus his wife).

    We were waiting for the new form from the joint-sponsor and in the meanwhile the joint-sponsor contacted the NVC for the problems in the form. We were preparing new form and documents that suddenly I received another email in 19th of September that your case is completed and we will send it to consulate for the interview time ohmy.png . On 2nd of October, they gave me an interview time for 7th of November. But in the letter about the required visa interview documents they put code "I" for "financial evidence". "I" code definition is: "This form is incomplete. You must present a completed form at your interview."

    What do you think about this story?! isn't it odd or it is normal? Should I take the new I-864 filled in by joint-sponsor to interview ? or here financial evidence is another thing and I need to show them my bank statement or something else?....

    I am really confused....huh.pngunsure.png ? Please help.... any experience or suggestion....unsure.png

    We are applying for IR-1 visa from Spain. Our I-130 is approved and last week I sent an email to NVC as DS-3032 for choice of agent. Yesterday they emailed me the IV (immigrant visa) invoice (for 230$), but I did not receive any invoice from NVC for I-864 yet.

    1. Should I wait more?! or because we applied from Spain they do not charge us?

    2. Do they send an email again for I-864 bill or they send me the invoice via normal mail?

    3. For IV(immigration visa) invoice, can my relatives pay it online at US?(becasue I am abroad and I do not have a US bank account)

  5. Hi evrybody,

    I am American citizen and I am applying for IR-1 for my husband at Madrid. We got approval from USCIS and now we need to send i-864 and tax return.

    But my case is a little complicated. I have not been in USA since I was 2 years old and I did not have SSN and income during these years. Now, I am housewife and my income is zero while my husband is Doctorate student and he has income from university. Now I have some questions:

    1. Can I write a tax exemption letter for not filling in tax return? (According to i-864ez instructions (on the actual form)it states "If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it." )

    If NO:

    a. How I can fill in tax return? I checked the IRS.gov website but I do not know for which type of tax I have to apply. Can I get tax return while I do not have SNN?

    b. Do we need to apply for tax return jointly with my husband? (Because he has job and income from University?)

    2 . Since my income is under 125% poverty limit, can my uncle co-sponsor me for i-864?

    Sorry for all the questions!

  6. Dear All,

    We applied for IR-1 and my American citizen wife filled in I-130 petition.

    Now, we both are living in Spain as student. Last week my I-130 petition is approved and they sent the case to NVC on 16 of November.

    But now our situation is changed and I got research position in Sweden for 4 years and I should start my study there from 1st of January 2013.

    My questions are:

    1. If we move to Sweden how we can inform NVC that our address is changed? is it also necessary to inform USCIS about it?

    2. Can I get my immigration visa in Sweden and travel to USA for short time about 1-2 months (during summer vacation) for Green Card and social Security Number and then come back again to follow my study?

    3. Is it compulsory to stay in USA after I receive the green card? for how long? (or I can come back and follow my education in Sweden?)

    Actually, I wan to finish my education and then we are going to move to USA. But I don’t want to lose what I have done for our immigration so far.

  7. A social security number is not required. Though you will want to obtain one ASAP.

    You will have to establish a US domicile. And also show that you've filed US tax returns (the US taxes on worldwide income, though there is a foreign tax exclusion) if needed.

    I have to go through it as soon as possible. Now I have two more questions:

    1. Is it okay if I write my uncle address as US domicile? (actually he would be our co-sponsor too.)

    2. Do you know How I can file a US TAX return while I am abroad?!

    I am abou to send my I-130 petition for my husband (We both live in Spain).

    I attached all of this documents to my petition:

    • Cover Letter (This document)

    • Personal check in the amount of $420

    • G-1145 (E-notification of Application)

    • From I-130: Petition for Alien Relative

    • Copy of unexpired U.S. passport (Petitioner)

    • Copy of the full Birth Certificate (Petitioner)

    • A copy of the Iranian marriage certificate and its English translation

    • G-325A and Passport Style Photo (Petitioner)

    • G-325A and Passport Style Photo (Beneficiary)

    Evidence of Bona Fide Marriage:

    • Letter explaining our relationship history and marriage

    •Copy of Petitioner's legal registration of address in Spain (Sabadell), and English translation

    • Copy of Beneficiary's legal registration of address in Spain (Sabadell), and English translation

    • Copy of Marriage Certificate from Iran

    • Copy of bank statement showing joint account

    • Copy of Beneficiary's passport all pages (evidence for joint trips)

    • Photographs as evidence to our bona fide relationship and marriage

    Am I missing anything? Or should this be good to go?

    I have US passport but I don't have social security number, because I have not been in USA for 25 years.

    Now we (me and my husband) are living in Spain and I want to fill in I-130 Petition for my husband and move there together.

    Does it make any problem if I want to apply for him as IR-1? or it is compulsory to have a social security number before?

    Please help me if you have any info or similar case. :help:

    You don;t need to pay taxes, but as a US citizen, you were supposed to file tax returns. You can back file with the IRS, and will need to do so for at least the last three years.

  11. Spain does not have a USCIS field office, so there is no DCF there. Residents of countries with USCIS field offices can do DCF. You'll file the I-130 to the Chicago lockbox. If you use your international address where your wife and you reside together, you may get put through the I-130 stage faster than those filing from within the US (this started happening recently, though it has not been universal and it does not seem to be an official policy for USCIS. A few people have reportedly it anecdotally here in the past 6 months).

    Now the only question is that: since I have not been a USA resident does it makes any problem in terms of Tax and etc.? Because I have been always(since I was 2 years old) outside of USA and I didn't pay anything.

  12. Spain doesn't have a USCIS office, so you will need to send your I-130 to the lockbox in Chicago.

However, I have not been a resident of USA because of family we moved outside of USA when I was 2 years old.I got married three years ago and then we moved to Europe to continue my education in Sweden and Spain.We have stayed in Spain for more than 2.5 years and now we hold a resident permit of Spain till Jan 2013 as a student. We are looking for the fastest and easiest way to move to USA to establish there for living and work within 6 months.As I read about the DCF I found it interesting and I want to apply for my husband. However, there are some problems:

    1. Is DCF suitable in my case? is DCF still applicable in embassies?

    2. Can I apply for DCF in US emabbsy at Madrid? becasue they notice that in their webpage : "U.S. Citizenship and Immigration Services (USCIS) has announced that effective August 15, 2011, petitioners residing overseas will no longer be able to file the Forms I-130, Petitions for Alien Relatives, with U.S. Embassies or Consulates. They will be required to file forms I-130 by mail with the USCIS Chicago lockbox."!!!!??

    Please let me know how I can do it asap,
