I just got approved!!! Text at 12:30 am woke me up and said to check my case status and my case status is that they sent out the approval April 9th! Really happy about this! I was trying to be so patient and now I'm extremely thankful to be moving on to the next part I really hope that everyone's approvals come as quickly as possible, and for those who are still waiting longer than I did, I will be praying you get fast approvals!

Does not make sense. You filed in October so Nov, Dec, Jan, Feb and March. 5 months gone and their current goal is 5 months. Are they stupid or am I counting wrong?
And God forbid if they sit on their lazy bums and are still doing September in May 2012 then are they still not "officially" past your NOA1 date?
It doesn't make sense, but that's how things are. They are not going by what their website says...they are going by what there office is considering the date they are working on...its a pain but there isn't much we can do. I'm over 5 months and a week and I'm not going to bother calling if they are still turning down September filers for service requests.

Your lawyer has given you good advice. By leaving before he turned 19 1/2 years old, your husband accumulated more than 180 days of unlawful presence but less than 1 year of unlawful presence which resulted in a 3 years ban. If he left after age 19 1/2, he would have accumulated more than a year of unlawful presence which would have resulted in a 10 years ban. If your husband never left, there would no way for him to be legal under the current law (the Obama order to allow a person to apply for a waiver without leaving the US is not in place and there is no timeline for when it will be in place - so you cannot rely on this now).
If you are changing lawyer because you don't like your lawyer, then that is a good decision.
If you are changing lawyer because you think your husband shouldn't have left the US and you can't handle the separation, then you are making a bad decision. Your lawyer is giving you good advice. It's not her fault that your husband's situation sucks. It's his family's fault because they brought him to the US illegally, and it's his fault for staying in the US illegally after he became an adult.
Oh, I know she had the correct information, but what I mean is that a lot of people do this process with the ten year ban. I have also consulted different lawyers and a few said that adjudicators might look at the 3 year ban and think "oh well it's not that long, so he doesn't necessairly need to be approved right now" I don't know if they will do that (I hope not), but my previous lawyer basically made it seem like if he had the 10 year ban that he would have to be there 10 years.
Besides that though, we are changing lawyers because she was inconsistent with contact, cancelled appointments last minute, and just did not seem very concerned with our case or updated with the current information regarding filing a waiver through Ciudad Juarez. Thank you for the input though

To be honest, unless they magically finish October and November and start December, I don't think it'll be next month...they are speeding up which is awesome, but don't get your hopes up because once those dates pass, then you start to get discouraged, and that is not a great feeling...

Well I'm not sure how it is for different countries, but we are filing through Mexico and it doesn't really matter if the spouse goes with, so I won't be going with my husband...I'd try to find other people who have filed through your country. Good luck though! and after the I-130 approval (which could be 5-7 months from NOA1 date) then it's about a month or a month and a half at NVC then 3-6 weeks out is the visa interview...at least that's what it is for my country flag

Well good luck and congratulations Are you planning on having the baby back home in the U.S. though? I'm guessing you guys would be back before then since he doesn't need a waiver..

I am 20 and my husband is 19...we missed the "grace period", but he left before he was 19 to only have the 3 year ban...so we still need a waiver, but he has a lower ban. We have a two year old son together (had him when I was your age) and we just got married in September because our lawyer told us it was advisable for him to go back before he was 19...I don't necessarily agree with her on that now and I am changing lawyers, but for you guys, that was probably a better decision, since he will not need a wavier! So, once you get your visa appointment, he can hopefully get his visa right away When are you due???

I know what you mean.....I've been trying really hard to be patient all this time, but now I'm starting to go I just want something to be moving!! I feel like we've been sitting ducks, so it's nice to hear some October approvals!!!

Based on Paisaman's latest September stats and Igor's List, it looks like there is a lot of action happening for mid-September filers. I think CSC may start October processing by end of first week of April month or may be even at the end of this month if they are really trying to expedite processing.
I really hope so!! I'm prepared to wait to end of April for my approval (or maybe a little after), but it would be comforting to know at least someone from October is getting approved

I'm in October, but just reading what you guys are saying about calling USCIS...I'm a proactive person and I'm not good about just sitting around, but I feel like I will get more discouraged if I call USCIS. Do you agree that it is kind of a waste of time to call USCIS if you are still under six months?

It's strange that on Igor's List, they are working on September and even August still and then there have been a few November ones approved lately...I guess alot of October petitions are still in boxes?

I really hope its early or mid-April rather than the end of it...I'm trying so hard to be patient!
