  1. As everyone else have already said, it usually takes 4 to 6 months to get approved (NOA2). It might sound like B S, but try and have a litle patience and not think too much about it. Believe it or not, I find strengh and comfort on the posts of those that have been waiting longer than me and are still trying to hold the line.

I hope you get yours soon. It only means that they are working faster and we'll all get ours sooner.

this is so true! everyday i check on VJ and see if someone got approved, then feels so happy for them and excited for our case at the same time, knowing our case will be next in line....thank you VJ members for being diligent in updating your status...it means a lot to us waiting..i'm hoping and praying that i can update my status "SOON"! :star:

  2. actually it wasn't really an rfe, i am sorry for the word i use :), our petition was rejected due to wrong amount of check, we are November filer but they rejected our docs, then we resubmit last December but USCIS got it last January, i am just so jealous with my friend, how come they got approved while she didn't sign anything nor fill up anything, that is so weird to me....

oh ok! thanks for the reply. :star: we are all jealous with your friend! we all want that NOA2

  3. hi if you don't mind me asking why did you get an RFE?

that is what i am thinking, i am still talking to her right now, all i am saying to her now is a non-stop WOW  our talk started when she asked me about G-325a, her friend was asking about it, and she asked me about it because she don't know what is G-325a, i said you filed it together with the petition packet how come you don't know it? she said all i gave to my fiance is my BC he said that's all he need, i am sure she don't know the process even the forms, so now i am sooooooooooooo jealous they didn't get rfe but me and my fiance did get rfe :(

  4. hi did you just missed sending the proof of bonafide relationship? or you just sent the forms, no birth cert, no petitioner's passport?

Hello VJers... Help me Jesus!! I recieved a text stating... "Our case has been updated" I was so nervous. I recently passed the five month of processing, and I sent in a service ticket. Anyway.... I was too scared to check. When I logged in on my cell phone and saw that Denial..... I almost passed out. Who is making these decisions? How dare did they deny me without an RFE??? WT*! I am so confused... 150 days of waiting. I know my package was missing proof, like photos, or paasport copies, required docs. I didn't know that I needed those things. I filed my petition in Iraq. I didn't even enclosed the fee. When I returned from overseas, I saw the rejected letter, and then I sent in the monies for the fee.

So now, USCIS is just taking money and denying... I know everyone up here is working hard to pay these filing fees, AOS and so on.. How can my life be in someone else hands, who is just looking for a way to deny. Why didn't I get the RFE? I would have had the proof.. I need prayer. Thanks for reading this... I hope everyone will have a great day! :crying:

  5. i assume you mean 'the visa holder' and not the petitioner.

    Here ya go..

    K-3 administratively closed - http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

FWIW, the petitioner usually will pay another bunch of monies for the K-3 visa holder to get a green card.

oops i mean for the beneficiary.. thanks for the replies!

  6. After almost 6 grueling months of waiting with not so much as a peep from USCIS, WE'VE BEEN APPROVED!

The hubby is actually down visiting for a few weeks, and we were on our way home from dinner, and at 11:30pm I get a text that said my file was updated. I bolted into the house and checked, only to see APPROVED!! :)

Though I know there's more to come, it honestly feels like the weight of the world has been lifted off my shoulders. We're both so excited to finally be able to start our life together (in the same city).

Thank you all for your constant assistance, kind words, and a shoulder to cry on.

    Horray!!

    congratulations!

  7. if i was anyone with a pending I 130 at the csc i strongly suggest u send in an expedite. i sent my I130 in january 6,2012 and received my approval on january 23 2012 very simple and easy.....i was desperate to have my husband here i just cut 6 months of waiting into 2 weeks.

my case is now being transferred to the nvc

can you kindly share what your reason to expedite your case? might help some of us here in VJ. thank u

  8. I haven't seen any cases of anyone getting denied, but maybe someone else can confirm or deny that. USCIS is probably not going to deny based on an error in his tax returns if they were indeed filed. The issue is with IRS, they may audit and cause problems. The other issue is that it does not look 'good' in terms of proving a bonafide marriage to file as single, especially when that is not even really an option except when filing was done incorrectly.

oh thank you ceadserc. i have to convince my husband to amend his incometax.

  9. So, my question is as follows.... I had originally filed a 129f however being that I actually did not follow the directions on the application and failed to submit my supporting documentation, it was obviously denied and they sent a notice to appeal. I will not be filing the appeal because i just intend on getting married next month come back and file the I-130 in early May. That I am thinking will not have any effect being that my 129f was denied correct? Any thoughts on this would be greatly appreciated.

hi i'm a little bit confuse, what exactly did you submit? just the form? i'm sorry i just i want to know if we are in the same situation.

  10. Married is married. Only in rare cases (like legally separated but not divorced) can someone file as single when married. Check the IRA website guidelines for more information.

The options are married filing separately, or file jointly with an ITIN.

He can take care of the mistake by filing amended returns for the improperly filed years with the 1040X.

anybody here got RFE, denied or AP because of the "single" issue on income tax documents?. i called my husband about this and i emailed all your comments and past discussions about this and he said he talked to his lawyer and the lawyer said it's ok to put single just attached a letter why he wrote single on the affidavit of support. i'm so confuse about this matter..anybody had an actual experience about this....thanks in advance.. im so grateful there is VJ, great help!

  11. You been married to him since 2003 and you just now started the visa process? Anyways I think it was ok for him to file single because you didn't have a SSN. That is my thinking but not sure maybe someone with more knowledge of taxes can help. BTW good luck with this process just remember its a marathon not a sprint.

yes we waited until he became a us citizen before we applied for a spouse visa and unmarried child under 21. because we believed those who advised to us that it will take forever for a LPR to petition a wife. and he stayed for a while in the phil after we got married under a re-entry permit. well going back to my problem...i read here in VJ some members were able to put married in their income tax..tnx tan&tuyet for your reply much appreciated..

  12. hi VJ!i'm married to a USC since 2003 but he got his naturalization last dec 2011, now we are applying for I130 and k-3 visa. but ever since my husband filed his income tax he usually writes SINGLE as per advised by his accountant for the reason i do not live in US, i don't have an SSN and TIN. i'm just worried if this would be an issue during the interview or even when NVC requested for the income tax documents. if so, what can we do now? my NO1 is january 9, 2012. so i guess we have ample time to do something about it. i hope you can help me, any suggestions please...
