We are a lil be mad. After almost 11 months we received a letter stating an interview (Aug 29/2103). Thing is we believed that after all this time we should be waived for an interview until ROC time. The letter also asks for some paperwork i.e tax return, utilities bills... I would like to hear from members about their perspective/knowledge.

It's immigration fraud to use a b-2 non-immigrant visa to enter the US with the intent to immigrate. So, this is the last thing you want to do.

How long it will take for your stepson to immigrate to the US will depend on his current age and his age in the day you married his mom. If you provide these two bits of info, I can give you a better answer.

He is now 15 and 14 at the our wedding time. Although over 3 years of conversation about them come to live in the USA , when he got here, he was a lil be afraid when facing all these new challange at that time. He decided to go back to Brazil and a couple of months passed, he started to say how much he is missing us and about his mistake. I was thinking that he should apply for a tourist visa, and stay with us the whole July (school vacation in Brazil and USA) and go back to Brazil to finish his year at school. That's the issue. Have him applying as a visitor so he can come to see his mom and stay with her some days or have him finish school till December while put a I130 and have him coming back, more mature next july/2014

Hi. My fiancée and her son came to USA under k1/k2. Now we are married (almost one year)and she has ss#, DL, EAD an her temporary green card should arrive soon. The issue is that my stepchild left the country before his AOS. Now after 10 months he regretted and he wants to live with us again. Obs: He left the country before I put all papers in. He just had his passport and k2 on it. What can I do now in order to my stepson be able to come back?

Is worth get his b-visa and here apply? what is correct?

The fees for the I-765 (EAD) and the I-131 (AP) are both waived when filing with a pending I-485. The total is $1070 with or without filing the I-765 and I-131. You should go ahead and file the I-131 too. You never know if something might arise that would make her need to leave the US while waiting for her green card approval. The form is short and easy to fill out and free, so why not? Instead I693 I will go by the vaccination record DS (her is only 3 months old - vaccination and medical stuff)

For her first I-765 (EAD)and together with I-485: Do I have to pay the $380 fee or not? Like I will came ouy with $1070 for the I485 plus the $380 for the I-765?

I saw something like that too, but just do that:

Look for a Citibank webpage in Brazil and choose the branch closest the place the person in Brazil leaves. Exchange will be provided at the teller. Today about $240 dollars equal $480 reais. Tell the teller to mark Visa K 1 (if it is your case) beneficiary 's name and kids if any.

Fyi, my NOA2 dated as mar/19 was confirmed by email, text message and official letter. It took about two weeks to NVC provide its case number. I called (the lady who spoke to me was very frienly and professional) and was given my case number. Also next day I got an email with the whole information. They also stated that I should be notified when my case is on its way to Brazil. As useless culture NVC number works like that: first three letters for the inicials for the correspondent consulate; first 4 numbers for the year i.e. 2012, the next three numbers i.e. 5XX it means the numbers of the day for the year i.e. 531 for Jan 31st and the last three how many cases were assigned for that consulate on that day.

Btw, my interview is quite close.... wish me luck fellas.

O fato de casarem aqui ou nao, uma vez que voces estariam indo viver no brasil nao fara diferenca nenhuma. Para passear, voce aplicaria para uma visa de turismo. Quando estejam afins ou qdo vc acbar seus estudos, ele aplica e voces viverao aqui de boa.

Voces podem se casar nos EUA e homologar seu casamento no consulado brasileiro de sua jurisdicao. Para ele viver no Brasil, sera necessario voce peticiona-lo, se nao e se aprovado, a estadia dele como turista sera nao superior a 90 dias. Eh claro que pode ir adicionando tempo, pagando uma taxa modica.. Uma vez casados e vivendo no Brasil, mantenha docts e/ou copias de tudo o que seja possivel para provar que o seu casamento e de bona fide. Digamos que daqui a tres anos, voces decidem regressar para os EUA... ele devera peticiona-la. Todos os tramites feito pelo consulado americano do Rio, nao importando qual regiao voces estejam. Ele, na epoca de sua entevista devera estar empregado ou oferta de trabalho aqui, uma proposta ou similar para que possa ser seu sponsor I864 ou ter alguem que possa faze-lo por voces. Tabela de poverty guide line muda anualmente.

Enquanto nao decidem pela visa para voce vir morar aqui, ex. I130 e I485, voce podera aplicar para uma visa b1/b2 normalmente e vir visitar a familia dele.

Tip: Uma vez aqui e casados, ele pode te peticionar atraves do I130 e I485. contando que quando voce entre aqui, seja com a visa B1/B2.

2011 Tax filed and is well above 2012 poverty guide line; so my 1040 is ok. Two things: A temp to hire job will have any impact on the I134 as I started a new job on March 5th and my interview, at Rio Embassy, will fall before my 90 days experience? Second issue: Do I need a transcript or just the 2011 1040 is fine?

Today at 11:30AM I got a message from USCIS stating that my K1 was approved. It was five long months. I am so happy and I wanted to say thank you to all positive comments I received.

For those still waiting, keep your faith ... I know it is hard but just stay strong.

Well, first of all, congrats for your interview. Do not worry that much. As long as your fiancee is on medical assistance, she will be fine. It's more like a strong flu. She will be ok soon. My country (Brazil) has a lot of cases and cure is over 99.8%. Believe me, the waiting time for the the noa2 approval is worse than dengue. Just go ahead and prepare all paper work for the interview. No drama dude! Good luck :)

That's true. Waiting time between Noa1 & Noa2 is something else. I am over 130 days (Noa1 Oct21-11). Checking email and USCIS webpage every single day...

Well I just thought I would share an incredible moment that Carly and I experienced just a few short hours ago..

I rang her cell phone via skype just for a quick catch up on her day while she was on her break from work. She was very upset as she had just got off the phone from a tier 2 USCIS officer regarding our I-129F application. After 6 months of waiting he told her that it was going to take another 60 day period until we had a further answer/information on the status of our application.

As I was trying my best to keep her spirits up I received an e-mail on the computer WITH OUR APPROVAL!!!! So amazing to be able to share the surprise together, it truly was incredible. Needless to say there were a lot of tears and laughs and a feeling of complete and utter relief. For those of you out there approaching or past the 5/6/7 month mark.... I completely feel your pain and frustration. Seeing so many people who applied after us be approved was simply heart breaking. But there is an end and you will get there.

For people still waiting, keep pushing, I know how tough it gets, for those about to start, enjoy the journey and for those beyond us... good luck!

Just wondering about this: I am petitioning my fiancee (129-F - K1) - Time frame shows (as of today) that Vermont is working on 10/23/11; my notice date shows 10/21/11. Should I be worried already or just wait the 5 months time frame as we could see on USCIS (Vermont) I129-f status? I also changed my address with USCIS (online and confirmation received, back on 12/12/11).
