    @O.P. Get professional help, aka a laywer and a psychologist. If the petition for ROC because of abuse fails, ask for Asylum. Forums are great, but take everything with a pinch of salt. Your husband is insane, and, while I know in your culture wife beating isn't really frowned upon (I am guessing you are Iranian), such is not the case in any normal society.

  2. hi, I am trying to answer some of your posts in my opinion.

    1. Should I marry her? If I marry her will my other two processes be void?. What benefits will I be granted in marring her? Can I apply for a work permit? if so, how long this work permit will take.

    I don't think, it will be the best idea to marry her, because it could look suspicious, since you already tried to immigrate TWICE through your brother and your mother. it could be seen as red flags for USCIS. If you do wanna go down that road, your brother & your mon have write a letter to USCIS to withdraw your I-130's. just keep in mind, since she is an LPR and not a US Citizen, it takes much longer (several years I read) to get your resident status. as soon as you would get married, you will be able to get your work permit within 3 months of filling the appropriate forms.

    2. Should I wait for any of the two processes to be given a decision. Why my process by my us resident mom is taking so long?

    I don't know, why it's taking so long. you should make an info roads appointment and see what's going on with your cases (you do have two, one of them will be denied, because you aren't able to file both!)

  3. Symply_Me Looking at your timeline did they not question your motives when arriving in the US. You appear to have got married very quickly. We've read a lot about the whole 60/30 rule?

    not one word, nothing. I read about that rule too, but this is more important concerning your actual application. because it does take you a while until you have all forms together, especially since you didn't have the intent to get married. that means getting your birth certificate, shot records, papers filled out.

    my interview was easy, he only asked us one question: did you bring photos? he did not wanna see any originals & we talked a lot about my husbands job (he was very interested) I guess, that's why it was pretty easy. we had nothing to hide. plus, my husbands job is very important. he could get into big trouble doing something which is not allowed & the person who interviewed us said that from the beginning too, that they aren't concerned about him, because they don't get ppl doing what he does in the office very often. so I guess, I got lucky.

    sorry, that I am not straight forward about him, but I promised my husband not to be so personal in this forum. I registered, to help ppl out.

    but don't worry, if you are honest and filled out the forms right, there's no reason to get denied.

    ps: we got married quickly yes, but it was on a already planned Halloween trip to Vegas :)) just us two. there's nothing more spontanous than that.

  4. 12 days more for husby to be here :dancing: .tryied telling him B2 will not be possible or not a good idea but he thought I just don't want to acompany him. Anyway not to use the little time we will have together to argue, I'll convince and take him through this site whiles having romantic night on the beach with glow sticks around us and I know how to make him listern, he will understand better after going through this VJ site with the help of the mood I'll make him be in.   5. ha, I was with my husband in a stable relationship for YEARS before we got married and I just didn't meet him, while vacationing here. I always came here 3 months at a time and last time, he didn't want me to leave anymore. that's quite different. and yes, I said clearly its MY opinion. I can say a lot, but none of you have to believe me. go through this forum and read people's posts.

    and FYI everybody, who judges my timeline b/c I got married on VWP. my husband and I would NEVER do antything against the law because of his job. the immigration officer at the interview even noticed that too, thats why i got my GC so fast. And hey, I clearly adjusted my status here without any problems :)) We got married during our Vegas Trip on Halloween without friends and without any family. just us two. does it seem like I came here to get married? ha, clearly not. did I wish, I would have be prepared? yes, because not having your parents there, was the hardest. I don't have to explain myself on my situation, because we are talking about somebody else here. it's funny, how EVERYBODY jumps on me for having a different opinion. maybe you should read a while back in this forum and you will see a pattern. like I said before, nobody has to agree with me, but attacking me in this situation, is clearly childish. I read in this forum everyday and I do know almost everything about fiancé visas. I am trying to help people out, but I am also not afraid, to tell how it is. read a few sites back here in this forum and you will see a clear pattern between situations & people.

  7. Green card is too big an attraction to leave US...no matter how much abuse she's getting. If i were u i would go back to my home country..but for what i understand from you u don't wanna back out from green card so i guess just bear the consequences with it too.

    I agree. you should return to your home county. at least you will have your family there. here in the US, you will be alone and on your own. I am sorry, but in my opinion you shouldn't be able to stay here. (just MY opinion) it would be a bit of a different scenario, if you came here on a fiancé visa. you didn't even know him, jumped into a marriage and now you wanna get a divorce and still get the GC ...

  8. So today, I received text messages saying EAD card is in production and AP is approved. Does anyone know how long does it take to have the card in hands? Even though I might not need it for long considering my interview is the end of the month, it would be good to have it so I can get SSN. Is it different if I get SSN with EAD or just wait till AOS is approved?

    @chimcham:regarding evidences for marriage, we submitted:

    Marriage certificate

    Joint bank account statements (both personal and business because he puts me as a cosigner for his business account)

    Family phone bill

    Costco family membership

    His life insurances with my name as the beneficiary

    Rental agreement with our names

    Car insurance with our names

    Pictures since when we started dating till now (with friends, families, wedding pics, etc)

    I think that's about it. We didn't get any RFEs :)

  9. When I applied for my SSN my I-194 was already exprired too. It does not matter, just bring your I-194 with you even if it is expired and bring the following documents that you have; Marriage Contract,EAD card,passport,Driver's License if you have one,Greencard if you already have one and the letters or notification sent to you by USCIS or department of homeland security - that will not be necessary but it would be good to have for evidence or documentation.     she doesn't have an EAD yet. now you have to wait until you actually get yor EAD card and then you will be able to get a SSN. I already had my GC when I applied and all the needed was my Greencard, drivers license and passport.

    it doe make a difference, because the overstay will be not forgiven. from the time her visa expires until he gets the US citizenship, there will be most likely a overstay while he was and LPR. this time doesn't count as forgiven overstay, because be will become a citizen! there are some potential problems coming forwards her, if he decides to stay here in the US. if they deny her application because of the overstay, she probably already passed the ban-free time!

  11. Dental only costs us 12$/mo but they are changing the contract now for everyone. It wont be with the provider they currently have now.

    we will be changing in may to MetLife, but that doesn't really matter right now, because she will still sign up with united Concordia for apil (if she does it right away) plus changing to the is better, because our allowance is higher and they cover white fillings!

    Is it absolutely necessary that I change my name on my passport right away? Can that be done in time...only because I think they take your old passport which has my visa in it..even though they return it, that would be something I would like to hold on to.

    you don't need to change your name at all in your old passport if you want to, but it makes things easier. just make sure, if you decide not to change it in the near future and your have international travel planned, book your tickets in your name, that appears on your passport and have a copy of your marriage certificate ready, when you enter the US again.

  13. the military has nothing to do with your immigration. they should have not given you a dependent ID with such a close expedition date. I got mine last November and it's good for the next three years and they still don't have my social in their system! all they did wrote my passport # in their system. as soon as you married a military member, you are eligable for tricare, you will be able to sign up yourself with your ID card. just visit your nearest tricare office. sign up before the 15th of this month and your coverage will start on April 1st. they will still treat you on base before, if you need medical assistance, but you wouldn't be able to get off base referrals before April 1st. also make sure you sign up for your dental insurance as well, it is separate from tricare and cost I think 15 dollars/ month. they will give you all the information at the tricare office, but you will need to apply online!(united concordia) go to your DEERS office and ask to speak to a supervisor about your ID card. they should give you another one, which doesn't have such a close experation date. if you have any further questions, just ask or shoot me a PM.   14. This question is for my sister who came last November 2011 in the US to visit me. I showed her around, and she reconnected with her friends. We met her former HS classmate, and they fell in love. They recently got married, and the guy filed for naturalization yesterday 2/29/2012.

    My question:

    My sister's visa expires in May. And the Certificate of Citizenship of her husband might come out after 3 months the earliest. Should they wait to file the I-130 when the husband becomes USC? Her tourist visa expires by then.

    Or..should they file now, so she wont ne out of status, even if the husband is still LPR?

    Any thoughts, suggestions will be highly appreciated..and please, no condemnation. They are really sooo in love....

    very complicated situation. overstays are only forgiven for USC. since he's in the progress of getting his citizenship, it could take quite a while until it actually happens. that would mean she is going to be out of status for a while. that could create a problem. filling right now here in the states for AOS is not a good idea, because the progress takes years for a spouse of an LPR to get her greencard. I would suggest taking the safe route with going to her home country before her visa expires and filling CR-1. if she overstays (it depense how long) she will risk a ban between 3 and 10 years.

    Hey guys, so I'm located in Alabama now and as far as I know the closest ASC is New Orleans and the other local office would be in Atlanta. If I'm scheduled for an interview at the National Benefits Center, does that mean I'd have to fly to Texas seeing that TSC deals with applications around my region. Question is, where is this place? I'm just a tad curious now and I know I will get more information when the hard copy notice arrives but..the I'm excited and worried all at the same time!

    In addition to that, I have yet to receive any news on my AP/EAD card. No updates, RFEs..nothing has been touched since Jan 17. The last time the case was updated was when they informed me that they had received my application. I have also already completed the biometrics 3 weeks ago. Is this normal? I thought the usual process is to receive the EAD/AP and then the letter for the I485 interview.

    that's great news. you got your appointment really fast and if everything works out, you won't even need the EAD/AP. I got mine one day before I received my actual GC. so worthless.

    should I only include my passport only as a proof of citizenship or should I include other things ?

    should I file seprately form I 130 OR WITH the adjustment package ?

    is the photograph needed the same one used in the DV lottery ?

    Should I include when Filing lease copy , other things that proof that we are living together ?

    what visa did she came with?

    you also need to include a copy of your birth certificate, to proof your citizenship.

    the photograph requirements are in the instructions, which you should have printed too. it's petty clear!!!

    and the last question again, it depens on which kind of visa your spouse came with. then you can look more into what documents you will need.

  17. My husband pcsd a month after we got married. We filed for aos last 01 dec and got approved last week. If your husband is going to put you on his orders as cmd sponsored, he can request to have your case expedited. Just attach his orders on the packet and write on your cover letter that he is going to pcs. Then once you rcvd the noa1, call the military hotline and follow up on your case. I still think my case was processed faster because i included his orders on the packet. Goodluck.

    we were approved faster too. only took me 2 months and 10 days to hold my GC in my hand and we didn't expedite the case, they did it. they also said at the interview, it was because he was military. so they do it anyways, if you are active duty.

  18. This isn't exactly true. The OP's wife has made it obvious that she is "visiting" the US rather than living here and if CBP see that pattern they can accuse her of misusing the GC and revoke it.

    Hopefully she won't have any issues re-entering this time but she needs to stop going in and out.

    if she doesn't wanna live here, she shouldn't have a greencard! it's for residents and not for visitors.

  19. Any amount of overstay is overlooked for spouses of USCs with no other adverse factors. After 180 a ban is incurred IF they leave the country.

    But as was said, if there was lying or evading in order to get into this country despite prior overstays, you will probably have a big problem regardless. I'd consult a lawyer on that front.

    she's an LPR, not a US citizen yet! so the overstay WON'T be forgiven.

    I love this new military sub forum!

    Anyways i have a few questions i dont know if anyone can help me with..

    First:

    Tricare. I was told i may be able to claim back the costs of my medical exam once i got back to the states? Has anyone tried to do this?

    Also, if my husband wasnt on a mission at the moment then he would of come here to visit me for my interview and would be able to fly home with me which would mean my airline would allow me to bring up to 3 bags, or if i was traveling alone on military business i could do that also, but since i am not and he can not be here do you know if there are any exceptions because its going to cost me a total of about $200-$300 on my luggage which would of been free if my husband could leave his duty station? Im asuming since we arent PCSing then the army isnt going to cover any of my shipping costs to get my stuff over to the states and i wont be able to claim any moving costs back once i get to post. Does anyone know of any kind of programs or exceptions we could look into to get some help on this as we are running on a very tight budget after all the visa fees?

    I have a complicated question about my wife's Residency status...

    Her and I have been through some bad times toward the end of last year.. Up to that point she had been out of the country 2 diferent trips.. She returned again to Colombia in Late November and has been in Colombia since.. She and I would like to possibly work on our relationship again and she is considering coming back.,. In addition to the problems we've had, we had been granted the visa for her daughter, but in the end, My Wife was not able to get the fathers permision for her daughter to come back.. She says she needs to stay until 2nd week of Feb while she sorts out some issues with her Ex (Daughters Father)

    My question is; with the number of trips she and the total number of days she's been out, (See breakdown below..) will she have an issue with her residency status when she enters the US???

    31-May-11 to 21-Jul-11 - 51 Days

    11-Aug-11 to 21-Oct-11 - 71 Days

    24-Nov-11 to 10-Feb-12 - 78 Days (To expected return Date)

    Total Days - 200 Days

    to maintain your legal permanent residency status, you have to be in the states for more than 6 months out of a year. she could already get into trouble because of the 200 days spending outside the US!
