  1. Okay, so there must be a catch to this whole obtaining a K3 visa while you wait for your I-130 approval, or I think I'd see more people doing it. From what I read on the USCIS website, you can obtain a K3 visa, so your spouse can come wait for the approval of your I-130 with you. I am married and we have filed our I-130, and I would LOVE if he could come wait in the US with me.. but... what's the catch? Can anyone enlighten me?

    i have applied for K3 Visa for my wife last week.

Hello everyone , the NVC accepted our expedite request and forwarded my case directly to the embassy and I read lately that I have to send all my docs and forms to the embassy not to the NVC and pay the fees during the interview , but I already paid the IV packet bill and AOS bill online and sent the packets to the NVC like any normal CR1 case , but now the embassy sent to me a message saying it will send packet 3 to me for the required docs and forms :( so what should I do now , will I pay fees again during the interview and send another papers to the embassy or what? I'm so confused now

    what is the process of requesting for expidite?

Harsh had his interview in Mumbai and needless to say it did not go well at all, Harsh said there was 2 male officers one a US officer and also an Indian officer and they grilled him for several hours about the age difference and they kept asking him how much he paid me to file the K-1 Visa just so he can come to the US!!! Harsh said they even showed him my face book account and said see she has lots of male friends and she could be your mother!! He said they were both yelling at him one in English and the other in Gujarati and kept insisting that he paid me to file for a K-1 Visa. Oh and here is the kicker they told him I was married before.I have never been married and Harsh told them that but they said she has a daughter, Harsh said yes I know but she has never been married before. They then said she has a security number so we know everything about her and she was married before!!! I called our Immigration attorney and also I spoke with my Senator, my senator assigned me one of her immigration aides and I spoke with him today and he already emailed the consulate. Harsh is going to fax me copies of all the papers they gave him he said they gave him a 221g and told him someone would contact him, then they also told him that they know he paid me and he probably will be banned from the US. I know for a fact that Harsh has never given me any money I have covered the cost of the entire K-1 process including his medical fees.It has been a very emotional day for both of us with lots of crying, but now more than anything I am mad as hell that they treated Harsh like he was a criminal when we have done nothing wrong but love each other and only want to be together. I hope those 2 officers have their big boy panties on because they are in for a fight. We will not take this lying down.

  4. Hello, I am also in the same situation. If anybody got the NOC from us embassy, can you please let me know the process and the format of the affidavit. The info on embassy site doesn't mention anything about the affidavit format.

    I was able to register my marriage without NOC, i have registered thru an attorney, they charge some money but they can get the work done.

  5. From the Phoenix locbox, it will be routed to either the California or the Vermont service center. You should expect about 4 - 6 months processing time depending on the service center. California is currently closer to 6 months while Vermont is closer to 4 months.

    Altogether, expect 5 months.

    i live in Texas, so will they send it to Texas Service Center?

  6. After reading about this a lot during my process, this is the steps i took so please take this with a grain of salt. :blush:

    First of all, have your spouse hire a lawyer or setup appt with the people who do these things. Meaning people who take care of all the paperworks. They will know who to talk to and who to pay what fees to. Save you the headache for a fee that they charge. Make sure that the fee they are asking for includes everything. I think Fees could be from Rs.10,000 - over $20,000

    Depending on how they know the system or how greedy they are :angry:

    Before leaving, setup an appointment to get NOC and Print the appointment letter

    Steps:

    1) Day 1: arrive in India

    2) Day 2: Go to US embassy with the appt letter to get your NOC or No Objection letter, the fee was i think around $50 usd?

    If they ask you have you married already, say No yet because you are going to get married.

    3) Day 3: Get married via Religious Ceremony. (Take lots of pictures & develop the pictures)

    4) Day 4: Go to Court and meetup with your agent to get the marriage certificate.

    You both need: ID (passport ID?), Bring your pictures NOC, Cash to pay for fees. You should get 2 Marriage Certificate

    Note: With Civil Wedding, i think you have to wait 30 days? but not with Religious ceremony wedding

    What you need to bring back from India:

    1) Some passport style pictures of your spouse (maybe get 10 just to be safe, 2x2 white background).

    It's cheap so why not get your passport photos done here also

    2) g-325a Biographic application signed & dated by your spouse

    3) Any travel receipts from India showing you guys have spent time together etc...

    4) Lots and lots of photos with your spouse and his/her relatives and friends and from travels together

    5) Original marriage certificate & Certified Copy of Marriage Certificate, leave 1 of the original marriage certificate for your spouse, he/she might need it later

    6) Certified of your spouse's Birth Certificate

    7) Copy of your spouse's passport,just the biographic page (will need it later on, many months later at NVC).

    There are lots and lots of document later on but the above I think should be a good steps to take.

    Later on you need a spouse signed: DS-3032 and DS-230 (Signed and date part 1 only, not part2)

    Thanks all for your help in understanding the process, i think it is discreminatory policy which goes against US Citizens that they have to wait and live without their spouce for so long, but H1B and L1 Visa holders can bring their spouce with them. not fair.....

  7. You are a US citizen, you can do the following -

    1. Go to Embassy and get a "No Objection Certificate" from Embassy. Embassy knows what to write there (take your US passport and Driving license with you)

    2. Some marriage registrar are asking for this too

    3. This certificate can help your future wife's immigration process a big time.

    one more thing, do i have to take this before marriage or after marriage? do they write wife's name in no objection letter?
