  1. You didn't get that one year extension letter? We received that separate from the biometrics appointment letter. Wife had to carry her expired green card along with that extension letter.

    In frustration, we also applied for US citizenship at the earliest time, so had to send in a copy of her expired green card, copy of the extension letter, and she also had to bring in her foreign passport book with their I-551 stamp in it. That was another 450 mile trip for that because her one year extension letter also expired.

    Up to us to keep ourselves legal, she finally received her ten year card three weeks after her citizenship interview, only to give it back one week later at her oath ceremony, that wanted that ten year card back.

    Wasn't too bad, because we also included her daughter with her I-751 as she was a minor at the time, but did receive her ten year card at the same time. She needed that to apply for college and to get a part time job. She also turned 18 one week before my wife's interview, so could not become a US citizen with her. Wonder if the USCIS planned it this way. If she had her interview one week and a couple of days earlier, would have been included.

    So for us meant another 1,350 miles of driving, another 700 bucks, and another two years of waiting.

    Hello all,

    We receive blue letter asking for more documents to prove our marital bona fides. We both have a child together. At the time of filing my wife was 7 months pregnant, now our son is 10 months old now. Does our son birth certificate the strongest evidence and only document we need to send? I don't really know what else to send. The first package we sent including utility bills, bank statements, pictures, letter from landlord, insurance cards...Please advise me what to do

  2. Can somebody please advise me on what to do. My wife filed to remove her condition on 04/2015, she did the biometrics and since then nothing has happened. We contacted the USCIS and we got this response

    "We have placed your case on a processing hold because the required security checks remain pending. Until we receive the results of these security checks, we cannot move forward on your case. We require the results of security checks before we make a decision on any pending case."

    What should i do now? I heard there is a memo that USCIS is forced to approve if they takes longer than 6 months to do the check. Is that memo still in affect? Please let me know what to do

  3. Basically it is the same process you went through with your wife but you will be sponsoring your step son.

    Timeline is tricky, it has been a year or so, but Obama has mentioned Executive Action, that could easily push out the time lines significantly.

    What form should I file? Also my wife already in the U.S for more than 1 year already. Please help.

    I need help on what form to file here. About 1.5 years ago my wife (Vietnamese) came to America with the financee Visa; however, her son (10 years old) didn't go with her (His dad didn't allow/agree his son to go to America with my wife). Now his dad agrees to let us bring his son over to America. Can anybody please guide me what forms should I/or my wife file so my step-son can come to America and unite with my wife? What is the timeline for this process? Thank you so much VJers.

    I am planning to take my wife back to Vietnam this year to visit her family. She is currently having a 2 years temporary green card. Can you guys let me know what procedure/paper/form I have to file? I heard that I need to apply for a re-entry permit for her. Is that the case?

  6. This morning I checked the USCIS for my wife i485's status and we were excited to see that we were under "Card/Document Production"; however, 1 hour ago I checked again and this time it is under "Decision". Are we approved or expected to receive more requests?

    Decision

    On July 3, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

  7. My wife and I went to the SF office today for the interview. The lady went fair well. She told us that because we entered my wife's birthday incorrectly when we filed (we have corrected it 1 month before the interview) so she has to check to make sure whether they need to do background check and verified my wife's medical condition (my wife tested positive for TB and currently on 6 months medication). The USCIS lady took my wife i-94 and other pictures. She told us that if my wife GC is approved we will receive GC in 1 month if not we will receive letter in 7 days to instruct us what to do next.

    Please advise if this is normal process. Are there anything we should prepare ahead? We are very worry and anxious. Thanks

    I haven't heard a happy song from Khanh Ly so I suggest you stay away from Khanh Ly's music.

    so does she need to get it notaried in vietnam?

    Yes timeline is important. If you aren't there for the interview then I would suggest you notarize it. Make sure your wife is fully aware of what you write on the timeline because the CO will ask questions base on the information you put down.

  10. Someone has mentioned his friend did similar thing about 6 yrs ago when the wife was pregnant.

    However, his USA-Citizen friend first wrote an Invitation to Visit and submitted to US Embassy in HCMC and copied the mother in VN. Then the US Embassy proceeded, contacted the mother for interview, etc..

    Has the right procedure changed such that the US Citizen did not initiate the Invitation?

    Your mother-in-law would have to apply for a visitor visa and from my understanding your role has no involvement in the process. However, It is easy for old people with property + other assets.

  11. My wife and I accidently put a wrong birthday on the AOS form and the stupid thing is we didn't notice until few weeks after our NOA1. What can I do now?

    I just wanted to give everyone update of my situation and hopefully it would be useful for others. I called the 1800 on the NOA1 and they instructed me to send a pesonal letter explaining the typo, NOA1 (copy) and included my wife birth certificate (copy) + the translation version to my Visa Center (in my case it is Lee's Summit). I did that and 2 weeks later they sent me a letter confirmed that they have changed my wife's birthday in the system.

    I also asked the biometric officer to update my wife's birthday in their system as well. Apparently it is a 2 systems so if the biometric's birthday is not the same in the central system you might get denial.

    So yeah make sure your birthday is also correct in the biometric system.

  12. My wife and I have known each other for about 2 years. I've been back to VN to see her 4 times in that time span. My finance is pretty strong. I've made over $100K a year in the last 3 years as an engineer.

    We were never married before. Each trip I'd been back, I took her to Cambodia(angkor wat), thailand, singapore, Mui Ne, Halong bay, Hoi An, Hanoi. We talked on the phone everyday, we kept ALL records and photos.

    So i'm confident our case is pretty strong.

    However, there is a couple red flags.

    My first trip, we spent two weeks together, but we never traveled to her hometown to meet her parents. She worked in HCM city, so I met her there. Her hometown is in central VN.

    I proposed to her over the phone two months later. And another two months later I made my second trip to VN to marry her.

    On this second trip, we traveled to her hometown to meet her parents, and a week later, we signed marriage paper at the city hall in front of her parents.

    So the FIRST red flag is, I met her parents for the first time and signed the marriage paper with their daughter a week later on the same trip. We just had a big wedding with over 250 guests last month in her hometown.

    The SECOND red flag is, my wife has a sister in the US, and the sister doesn't have a US citizenship yet. Her sister and I lived in different states. So I dont know how the visa interviewer would react.

    Honestly I don't see any red flags. Your case is solid. Make sure your wife lists out she has a sister in the U.S. And at the interview (if you are there) make sure you can answer question about her sister such as: her name, her address, whether she is married...and your wife needs to know everything about you in the U.S.

    My husband just moved to TX this April, and he is still in search of apartment now. Therefore, we do not have a physical address yet. He will rent a mailbox at the post office until we move into the new apartment. I will arrive in TX on May 3, my POE is IAH. I know that I need to notice CBP officer about the change of address. But does my husband need to do the Change of Address on USCIS website?

    My visa expires on May 7. Due to my family issues and my husband's relocation, I cannot come to the US earlier. Is there any troubles when my arrival is too close to the expiration date? Will they ask the reason for that?

    Also, we got married in Vietnam. My husband wants me to take his last name when I come there. Can I notice the officer at the airport about the desired name change on SS card and green card? If not, what do I need to do to change to my husband's last name?

    I don't think the custom agent will accept PO BoxThey will ask, in regard to your visa about to expires, but it would not cause any issues as long as you explain the reasons. You can change your last name anytime at your local SS office with your marriage certificate. I am not sure if you can do that at the POE.

  14. hi vj users.. good day.. i just want to ask if i wont be questioned if i travel without my fiance/petitioner upon goin' to US. the story goes like this, when i had done my interview last month, the DS forms i'd filled out has the name of my Fiance/petitioner who will travel with me upon entering US, because he told me he will fetch me here and we'll travel together to his homeland. but sad to say, he won't be able to accompany me due to his work.. am i be questioned for that ??travelling without my fiance upon entering US??

    Shouldn't be an issue at all. At POE my the custom agent did ask my fiancee "where is your fiance?" my wife told him "outside" and the custom stamped her visa and let her out.

  15. My wife had her exam at Iom yesterday. The dr asked if she had any prior illnesses which she replied no because she has no infectious diseases. However, we have been treating her for an overactive thyroid for a little over a month. Her thyroid is noticably large and so the dr asked if she knew she had a thyroid problem. She replied yes. The dr immediately chastised her for lying when asked if she had any illnesses. My wife replied that she thought only spreadable diseases were any issue so that is why she said no. She had nothing to hide because a thyroid issue isnt going to prevent her from entering the us. The dr however insisted she lied to cover up a sickness and claimed she would write in the report that my wife lied and could possibly have a fake marriage to enter the us. After some insisting and crying from my wife, the dr said that she would not make the report, but could instead suggest barring my wife from entering the us until her thyroid treatment is complete in 6 months. In reality, based on the test results, her thyroid will be at normal levels in 2 weeks or less.

    Can the dr really do this? Will it become an issue at the interview? My wifes medical came back all clear btw. And she really had no intention of lying to the dr.

    It seems that this Dr wants coffee money. You have nothing to worry about, I would just go to Cho Ray hospital
