  2. Hello all, I've some questions regarding I-864, W-2 and tax transcript.

    My spouse is my sponsor/petitioner who makes above the poverty limit. We got married last year and filed jointly our 2011 tax. Since I worked last year, I included my income when we filed our tax refund for 2011. We requested and received copy of our jointly filed tax year for 2011. Per the tax return transcript, it states the sum of our wages without specifying what each of us made individually.

    Question for the I-864:

    1. Do we need to include her W-2 and my W-2 for tax year 2011 (jointly filed as married couple) when sending the I-864? Reason: tax transcript shows our total wages WITHOUT showing spouse or my wage individually

    2. Is the tax transcript for 2011 sufficient enough; that is, should we ignore her W-2 or both of our W-2s?

  3. 1. Does the Sponsor/USC include form G325A in the I-485 ?

    A: No. Only in I-130.

    2. Also, do we include the sponsor/USC's passport type photo in the I-485 ?

    A: No. Only in I-130.

    3. How many passport type photo is needed by the beneficiary/non US citizen spouse when filing the I-485 ?

    A: Beneficiary: 1 in I-130 and 2 for I-485. If you are applying for I-765 than 2 more.

  4. & If the number of the tax document pages seem embarrassingly voluminous, (As i can imagine, especially if they are for 3 tax years) :lol:

    Get a Tax transcript from IRS.

    we have tax transcripts for 2009 and 2010 but unsure when we can request the tax transcript for 2011 because we recently in the last 48 hours filed for our tax return for 2011. Anyone knows how long it takes to get a tax transcript for a recently filed return?

  5. You need to include your spouses tax returns (all pages) W2s and letter from her employer showing current employment. If she has her 2012 pay stubs, include those. If possible, include tax transcripts from 2010 and 2009 as well. Better to over-do it than get RFEs for missing tax documentation.

    Tax returns....all pages/schedules. It must be complete. Obviously assuming that her income alone is enough to exceed 125% of federal poverty line.

    so i, intending immigrant, do not need to include my w2 so far my spouse's income is over 125% and even if we files jointly?

  6. I have some question regarding what to include for tax year 2011.. (AOS from F1 to LPR via marriage)

    Since my spouse/USC is sponsoring me, do I(intending immigrant) include my W2 information (with spouse's W2) for tax year 2011, which was recently filed JOINTLY? For tax year 2011, I know we need to include the W2, what else should we send with the W2 since we don't have the tax transcript for 2011 yet ?

  7. University is not mentioned in the instructions, and current status is whatever status you entered with. You can add "out of status" after the visa type if you wish. Good luck.

    I have the same question regarding the PART 3C on I-485. Did any of you include organization related to place of worship. I mean exactly, name of church I attend.

  8. Employment is limited to no more than 20 hours per week when school is in session, full-time during holidays or vacation periods. Employment authorization is automatically terminated when a student fails to maintain status. Students may work for an employer at any job, anywhere in the United States. A job offer is not required in advance of obtaining employment authorization.

    Students seeking employment authorization based on economic hardship will need to apply by mail to the C.I.S. Nebraska Service Center to obtain an employment authorization document (EAD), which is valid in one-year intervals. There is a $120 fee for the EAD

    As far as I know, once you graduate your ead card based on economy hardship would be invalid and that's why they give you the option of staying for another year for opt or leave as you're no longer a student. I know you have a grace period of 60 days between graduation and employment. and you are not allowed to work until you receive your card in hand. if you can't find a job within the time frame, you are supposed to leave the country but most people stay through the validity of their opt.

    I don't think you'd be penalized but you should not hide it from USCIS.

    Trust me, there is nothing to hide from USCIS. Our document will speak.

    Btw, EAD based on economic hardship can be obtained not only at CIS Nebraska, and the fee is about $385 or so.

  9. Ok so here i am with yet another precision...

    on the g325a form with the last 5 adresses i came here in december 06 and i was in new york in the streets lol for about a year what adress should i put i did live with friends though i wasnt like homeless but i had no address??? And i listed all adresses since august 2007 to present here in GA where i have been living since aug 2007...does it matter if i dont have adresses from dec 06 to aug 07 knowing that i have been in the us since then??? Or do i have to list addresses SINCE i got here in dec 06??? thank you :D

    Lets try it this way.

    I have an employment authorization based on economy hardship from March 2011 - March 2012. I graduated (F-1) in June 2011 and was required to apply for a Post completion OPT which was approved in September 2011. So, I started OPT job in June 2011 by using the employment authorization based on economy hardship while I was waiting for employment authorization for OPT to be approved in September 2011.

    Question: Will I penalized for working with the "employment authorization on economy hardship" after graduation ?
