Another question...!
Is there any way that I can file I-751 and get Biometrics at the US consulate in Japan?? Or does it have to be done by USCIS in the US?
-
Yeah..... I know this is really risky.... we are not sure if we should do it. But there are a lot of plus side for doing this. My parents get to spend a lot of time with their first grandchild who they might not see for a long time once I go back to the US. I will get a lot of support from my family, and it's also cheaper doing this way than having a baby in the US in our current situation.

Thank you guys for you advices! I totally missed Biometrics part. We will file it close to the expiration date. For baby's status, we will get both US and Japanese passports for our baby before leaving Japan. I will go to the consulate with my husband when he gets there so we can prove she is our baby and her dad is an American citizen. We can apply for SSN when we apply US passport, but it looks like SSN will take longer than passport. It is ok to enter US without SSN for baby as long as she has US passport right??

Hello!
I always appreciate all helpful advices in VJ! I have a question about an oversea trip during the process of Green Card Renewal (removing condition on my 2 year Green Card.) I have read other posts and they were all helpful. But I did not see any situation that I am in and wondering if I could do this. Please let me know what you all think!
I have upcoming travel to Japan from US. Here is my back ground…
- I am married to an American citizen, and I have conditional (2 years) Green Card expiring 3/7/15
- I am planning go back to my country, Japan, to have a baby. The trip will be 12/25 – 3/20. My due date is 1/25/15.
- My husband will visit to Japan 1/20 – 2/20.
I have learned….
- I can file I-751 starting 12/7/14 (90 days before expiration date)
- As long as I have NOA, I will be able to enter US without problem since the letter extends my Green Card for 1 year
- It takes 2-4 weeks to receive NOA
My question is…. Will this process work???
- I file I-751 (12/7) before the trip then leave to Japan (12/25)
- My husband gets NOA from USCIS sometime in Dec or beginning of Jan
- He visits me in Japan. He brings the NOA with him and gives it to me. (1/20)
- I gave a birth (1/25)
- He goes bank to US (2/20)
- I go back to the US with my baby with expired Green Card and NOA (3/20)
Will I have any problem with this process? Also, what if we don’t get the NOA on time for some reason? Will I not be able to enter US?
Please help me and I appreciate any advice!
Thank you all!
Amy

Welcome, Saku! I have no experience regarding your question that's why I am not going to speculate on how-s and what-s. Yet, what made me curios in your post is that you mentioned getting married in Japan. From what I know, K-1 filers are to be married within 90 days of beneficiary arrival to USA. And after that we are not to leave the country until we have advanced parole or green card ready. Not trying to be noisy here, and of course every situation is different but something out of ordinary always makes me wonder...
Guys, thank you for replying:) yeah sorry I shouldn't have called it "wedding". It confused you guys. It's just a little reception we will have in Japan for my family and friends since not all of them will be able to come to our actual wedding in the states. So we won't be legally married till I move to the states. I will look for a forum about it. If any of you know some advise, please let me know. Thanks:)

Hi! Feb filers:)
I've been reading this thread for a while now and this always makes me feel better to know that all of us are in the same situation fighting for our love ones:) but this is the first time for me to actually post something. I just wanted to ask you guys if any of you visit the states since you filed the petition. Currently, I live in Japan and thinking about visiting my fiancé sometime in this summer. My fiancé was going to visit me in April but he couldn't make it because of his tight work schedule. We will have wedding here in Japan in oct, but it feels like forever since last time I saw him (it was January). So I want to visit him but I know that there is a possibility that they won't let me enter the U.S and I might have to just turn around and come back without seeing him... So I was wondering if anyone did it and if so how did it go? And what did you prepair for it? I heard bringing the return ticket, wedding schedule/contract, or work contract will work to show that I have intention of going back to my country. If there are anything else worked well, please let me know. But my first question will be... is it smart to do so? And how likely am I going to be denied??

Thank you for replying guys! Yes, I meant G325 not 345... Ahhhh maybe I sud repost the topic... Lol
Anyways, ok, I got photos, passport stamps, and boarding passes too. It just scares me when I think I might not have enough staff.
Does anyone know about the employment section???

Hi
Thank you so much for giving me a lot of info, VJ!
I am almost ready to send my documents needed for I-129 to my fiance in the U.S., but I have couple section in G345 that I am not sure about..... so please help me!
QUESTION1:
For employment section, should I put my part time job experience?? I would not put it if it is just a part time job. But my case is a little complicated. When I sturdy abroad in the U.S as a student with F-1 visa, I worked for the college as language tutor for their language class although it was only for 3 month. And that is how I got my SSN. But since I am putting my SSN in G345, should I put the part time job in the employment section?
One thing that scares me is that I dont think that I paid tax for it.... it was only for 3 month and the schedule was like 5 hours/week. I think I got some notification about tax back then, but I was not sure about it and I didn't file anything....
QUESTION2:
For proof of ongoing relationship or having net in person in the last two years, how many of pictures or copy of letter should I put?? Now I have about 12 pictures and copies of 5 letters that my fiance gave me. I am not sure if it's enough.... Also, is it valid or solid proof if the letter does not have dates or stamps on it?
Please help me with this, and I would really appreciate it if you answer my questions. Thank you!!
Will this work? - File I-751→ leave US→get NOA in the foreign county→enter us with expired GC and NOA
in Removing Conditions on Residency General Discussion
Posted
Thank you everyone for your comments! I really wanted to do this for my family in Japan since we won’t get to see the baby that often. It will means a lot for my family. A lot of Japanese women go back to their homes and give a birth in Japan. This is really common over there, and parents love it when their daughter come back and spend time with their grandchild. We also will be in the better place financially if we do this. We are trying to buy a house and the saving will help us a lot.
BUT….. you guys are right. This plan is too risky. I’m putting not only my residency status but also baby’s health & citizenship at risk. I also have a job that I need to come back after maternity leave and it shouldn’t take risk of not coming back the U.S on time. I discussed about this my husband quite a lot and we decided NOT to do this and have a baby here in the U.S. My family can visit us when the baby is here. This is my first pregnancy and I shouldn’t have this crazy plan with tremendous amount of stress. Again, thank you all for your comments, you guys woke me up and helped me make a decision!
