All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

You can check USCIS website to see whether you are qualified for expedite processing, or call them to ask for the specific criteria and see whether you fall into one of them (something like military service, brutal abuse, etc. I forgot where I saw these), but most of the time we dont fit any of those criteria. And what you can do is only one word: wait. Plus, like others pointed, you have the one year extension paper, which gives you the priviledge to work and travel abroad. Good luck.

Two days after receiving the approval letter, today came texts and email saying "On March 21, 2012, we ordered production of your new card.' Online status finally changed as well. Waiting for my new card and planning to visit my family soon. Good luck to all the rest of May filers!

I decided to call USCIS customer service tomorrow and request some information about my case (applied for removal of conditions with a waiver on filing jointly in APRIL 2011).

Is there anything I should know before I call their 800 number? I have my biometric app letter as well as the extension in one folder in case they ask me about specific dates or numbers.

Should I have other documents ready? And does it give you an option to talk to the customer representative right away or is the wait really long?

Hey Mayfiler how did you talked with a level 2?I called them and they are saying my case is still in the processing time and cant transfer me.

In feb, I made a phone call and was told by a level 2 officer that my fbi name check was not cleared at that time. So today when I called them, I told them that I wanna check whether its clear now and only level 2 officer has the information, so they transferred my call. I am sure if you insist that you need to talk to a level 2 representative, they will transfer you. And also I made a service request on march 1st (not due to out of processing time, but based on the previous SR I made last december), I don't whether its because of that SR or just a coincidence. Good luck.

Thank you for the quick update. If the level 2 representative didn't fool me, then my case was approved yesterday (march 15th). But I will update this once I receive the actual approval letter (I am still in doubt and can't believe this is true). Hope all the rest of may filers get approved asap.

God is GOOD!!!! I just called USCIS and was told over the phone by a level 2 representative that my case was approved yesterday (I called twice to confirm it is correct). But no email no text no approval letter yet. Does anybody have similar experience? I mean is it really approved or they just dont wanna get annoyed by me anymore by giving me that information? I still cannot believe it. I will post my update once I get it.

Oh, I am sure you will get approved this time after RFE. I will start to collect more evidence for possible RFE and N400. Really hope to get approved by the end of may, then I will not need to apply for citizenship (not considering to become a citizen). But if they do not approve my case by may, then I have to file N400. Really tired to deal with uscis.

Great news! Its better than nothing, like mine, completely silence Just get all the evidence as requested, we will pray for you for immediate approval. Is the RFE general or specific? Did you submit those requested evidence the first time?

What is really going on with VSC? No news whatsoever with the rest of May cases here. I called them and was always told "intitial review" status. I am so sick of this waiting game! F*** USCIS!

To all the rest of april and may filers, lets gather here to get some brain storm. I know its useless and beyond our control, but this long waiting really irritates me.

What do you think the possible reasons why there is no news for our application?

Background check delay?

Loss of documents? (then at least RFE should be sent out)

Suspicion of marriage fraud? (then interview should be scheduled)

Race issues? Or nationality issues?

What else? I can't figure out other reasons.

i just called them back last Monday , and made another SR. Got a email couple hours later saying my case is still pending . I got mixed response fr VSC everytime i called .

Thank you very much for your info. Customer service really does not help much. I actually give up on calling them. Lets hope for the best, and prepare for the worst (file N-400 to force the closure of I-751).

Keep us updated! Seems there is no new approval since they updated the new processing time last week... Dont know what VSC is doing now. Frustrating!

It has been quiet for the past few days here. I noticed that there is no new approval from VSC at all since last week. Even though 2 or 3 June filers got approved, their approval are from the local office instead of VSC. Seems that after VSC made a lot of progress in Jan and Feb (most May cases were approved in Jan), they are now doing something else (probably other type of application other than I-751) after they updated the most recent processing time (May 23rd). It is frustrating that the rest of our cases are left in the dark and dont know when they will touch it... Lets keep this post alive, and please update any information you have, regardless of a service request, or RFE, or even if an interview notice, so at least we will know they are still working on May cases. Thank you all!

i called USCIS yesterday and got to speak to a supervisor. She told me that VSC was working on my case couple days ago and they r trying to come up w/ a decision. I hope she did not lie to me. Fingers and toes crossed .............

Wow, this is the first time I heard of this kind of information from uscis customer service people. The supervisor may have access to some internal information, but I was told twice that they have very limited information about i751 application in their system. I really hope this is good news and you will hear approval soon (maybe next week). Btw, I remember I saw somewhere here in the previous posts that mentioned or assumed that uscis officers usually make decisions really quick on easy cases, then some of uneasy cases will be up to the supervisor, and some may need more intensive reviews before they make a decision. That's why cases are not processed strictly based on receipt date. If what you were told was true, then probably it's in the supervisor hand. Keep fingers crossed, waiting for your good news.

I agree with that they are just a mess. I have a feeling that they are losing papers and all as reason of delay because a lot of people who submitted applications at the same time as us got approved but few people were left out.

She also mentioned that VSC is overloaded right now which adds to the problem.

Unfortunately, nothing we can in our end.

The thing is if they lose our application, then they should and will send out RFE instead of complete silence. It is strange, though. Also, overload seems another excuse USCIS likes to use since many late may filers and some June filers are already approved, so overload really cannt explain this.

As for expiration, simply make an infopass appointment with your local office (through USCIS website), they will stamp your passport with one year extension.

Please do not let it make you sad... It will come when it has to... Try to forget about ... And don't worry ... Go try to do some fun things this weekend and distract your self from the waiting and try to keep peaceful... It's hard to not think... We know... But it's not impossible ...take courage from the fact that people are praying for you guys... And that all of California applications on this May forum got a 100% .. So Vermont also all will be 100%.

Yep! and that level 2 person was the one who hung up one me My case is now close to its 10 month mark and customer service rep told me to wait 60 days....very helpful huh!

When I asked what's the most common reason why the delay, she said it's background check. And when I asked what kind of background check, she hung up on me.

Seems a common excuse, not sure whether that is the real reason for processing delay. I called USCIS about two weeks ago and accidently the level 2 officer told me my FBI security check has not been clear yet as of their last system update which is at the end of Dec last year. I was so concerned since FBI background check is notoriously flawed, sometimes it takes forever for them to return results to USCIS, so I called USCIS the next again to double check the information, and this time I was told that they have very limited information about I-751 in their system and the information about my FBI background check from the previous level 2 officer was completely wrong. I was so confused, so I made an INFO pass appointment the following week, and I found that the USCIS system is really a mess. When I asked the IO in the window, it took him at least 10 mintues to pull out my information and this time he said he does not understand why the system does not show any of this kind of information. And he reluctantly said that it seems the results were returned to USCIS, I guess he meant fingerprint result instead of background check. So I left there without even asking him more info since all seems self-contradictory. There seems some cover-up excuses USCIS like to use, as for the real reason that causes the delay (I guess nationality, race, etc all play a role) will never be released to us, customers. It is frustrating, but it is beyond our control. I am not even thinking of getting citizenship now, totally disappointed at this beraucracy (worse than what I expected) and dark-box system. Keep our heads up!

Bad instinct. We, the rest of may filers, most likely are the unlucky ones. This entire week there is no new approval, even very few new approvals for june filers. That reminded me when most april filers were approved, the rest of cases became cold cases, either approved very late, or still no action till now. I feel we are treated the same way, probably we won't see any new approval anytime soon, we just have to fight with uscis. For whatever the reason they don't give a word about our application, it's unfair. It's not that they have not touched our cases,I believe that they have some internal control, and it will take long time for the higher ranked officer to make a decision on our cases or committee decision. I hope I am wrong, but it seems this is the cruel fact. Uscis does something that they never want outsiders to know.
