  1. To everyone who supported and gave me good and respectful advice, I thank you! I withdrew the petition in february. I haven't been on because like all of you, I have a life outside visa journey, and since everything went down hill I do not stay on like I use to. To those that felt the need to be rude and disrespectful, not considering a person's situation, thank you anyway!! Everyone is entitle to put whatever they wish on here and rude words that are thrown to me, I just brush them off. I am doing good (those who are concern) better than what I thought. Thanks for everything VJ!!

  2. A different affidavit of support would come in to force - the I-864 - as part of the adjustment of status package. But if they do not marry, then he has no way to adjust his status, and will not have this form in place.

    But again...they never collected the I-134. I know of some members here where they did not ask for that form either. I am not sure why, but the only thing that I have in writing is the intention to marry. Now lets that he comes here, and I do not marry him, how can I be penalized when I can say that he lied to me. It does happen to other people that bring their fiances, and their relationship did not go well after coming to the US and before the 90 days.

  3. Mixed feelings about what part? Him being there illegally will have no effect on you. You are on the hook for the I-134, but that'll expire when his I-94 does (90 days after he enters).

    If you don't want to marry him and you've been 100% clear to him about this, he shouldn't want to come to the USA anymore to be with you. Make sure you are clear with him. After that, if he wants to be an illegal immigrant, well, that's his problem not yours, but why would you think he would do that?

    After everything, I don't trust his words. Maybe he is desperate enough to cry to me and try to convince me to let him come to be with me. However, I think it's best if I contact embassy just in case.

    Now, about the I-134, at the time of interview, they never collected that form from me. They never even asked for it.

  4. So, I haven't been on here for A LONG TIME.. and in the time that I have been MIA things have happened.

    First of all, after being on AP for quite sometime, I unfortunately found things out about my now EX fiance. It has been a hard situation for me to recover. Secondly, I grew out of love for him and no longer wish to be with him. October was the last time I ever contacted the embassy along with the senators help but nothing was solved and no answer was given as to why we were on AP(FYI, I broke the relationship off in August 2013). I thought to maybe do the favor of finishing up with this process and maybe if he would get to the US, fix us up. Nope, that couldn't be done b/c of his actions, so I never thought to follow through with CEAC website or call the embassy/NVC or even log on to VJ.

    I went back to DR in December, to have a nice time by myself and with my dear family and friends. I saw my "ex-fiance", after all the nonsense that he spoke about me, I went to collect a few documents that he had of mine, and took advantage of the fact that I was there in his house to confront him about everything he said and done. I concluded that I would be making the biggest mistake if I bring him over to the US. I decided that I didn't want to go through this process any longer, but before I told him the desicion I had made, I sent an email to the embassy asking what was the status of our case being that it was exactly 8 months on AP. The next day early in the morning, I received an email from the embassy stating that they were pleased to inform me that the AP has been concluded and that they would need for him to resubmit his medicals in order to issue his visa. Confused, with mixed emotions, I told my ex-fiance this information, still thinking that it might have been the right decision. That same week he went and did his medicals. Well, that was mid January, he received a call from the embassy today and was told to take his passport back to the embassy so they can issue his visa.

    Guys, I don't want to go through this, but he called me crying today, his family and friends are telling me that he loves me that he has changed so much that even if I don't want to bring him to the US, not to leave him etc.... This is a very hard situation for me. I took the time to write what happened during the time I didn't log on VJ to kind of update you guys who are my friends on what has been going on. (I apologize for the long story)

    My question is; If he comes to the US, and I do not marry him, he will obviously be here illegally. Is that going to affect me in any way? Thank guys. Fast response would be greatly appreciated.

    Congratulations. Now the hardest part - waiting...did they give you the tracking number for the package? If so, check it online (http://domex.do/) quite often, as it was the way we found out about the packages for my In-laws had been sent out. The Embassy did not bother to notify us about it...crazy, hopefully it does not happen to you this way.

    Thank you! Yes, I have the tracking to domex, and have been doing so once in awhile, since I know that the embassy is notorious for that lol.

    This AP thing has me really puzzled. I'd never heard of it until earlier this year. My In-Laws were put on AP and a cousin's mom as well and took them 4 and 5 months respectively to receive their visas. This was in the Dominican Republic. Not to say yours will take that long, I truly hope not as this very frustrating and don't wish anyone to have to go through this nonesense. I know, their cases and yours fall under totally different categories, but that AP bs can take up to 60 days or more no matter the case. Many do not take that long, but is good to be aware.

    "Most administrative processing is resolved within 60 days of the visa interview. When administrative processing is required, the timing will vary based on individual circumstances of each case."

    The worst part about this is that everytime you call, the answer is the same, they do not provide details as to why it is in AP.

    Just try your best to stay possitive it will come soon, as patience is probably the only option available for those in AP. If everything went well in the interview, you should be good.

    Do not forget to call them and email them at least every week.

    I agree, you should call every week and email them every once in awhile. I have been on AP for 3 months now, and they also kept my fiance passport, and everything went so well. Everytime I call, they tell me the same thing over and over, "everything looks good, you have a great case etc". So I am just waiting patiently.....

    Interview: 05-16-2013 (Great interview, done in 5 mins and Approved, Kept his passport, and paid mail courier, nothing was mentioned to us and nothing was given to us)

    Last update 08/07/2013 after my congressman sent an email regarding my fiance's visa. Embassy responded same day and stated same general response they give everyone lol

    Everytime I call DOS, they say case looks real good any nothing is needed from us

  8. I am sorry to hear that you are going through this. I as well had to wait exactly 8 months for an NOA2 including an RFE. Believe me when I tell you, I know what you are going through as for I am as well a single mother of 3 boys.

    Wait patiently. I know easier said than done, but one you receive that approval, you won't even remember the fact that you waited so long. Good luck on your journey mama! It will be here before you know it :)

  9. Seems like the same is going on with us. They keep on telling me case looks good, they are just determining eligibility for his visa. Which doesn't make sense, b/c in packet 4 it clearly states that we are in the final stages of the visa approval. On top of that approving us on the day of the interview saying that we were approved, keeping his passport and having such a smooth interview, confuses me so much. My fiance has never had any trouble, never done anything illegal, works and goes to school. My congressmen tried to help as well and tells me to wait the 90 day period to send them another inquiry. I wish you and your fiance the best. This is a black hole that really tests our patience in our relationship. Keep us posted :)

  10. They did keep his passport and like others told us our case looks good and they have this process that they have to put him through. What's bugging me is our case hasn't updated once since the interview.

    Then when you hit your 90 day period, write an email to your embassy. Tell them that you want a status update on your case. They kept my fiance's passport as well. I am hoping that we are not on this AP for much longer :( Please keep me updated !!

  11. Don't feel bad hun, I may not be on AP for so long either but I feel as bad as you do and many other that has been on it for so long. I agree, we as citizens and tax payer should have the right to know exactly what is going on instead of keeping it a secret and not updating us. Did they stay with his passport? They say that if they keep the passport is usually a good sign (coming from the visa specialist every time I call lol) I wish you the best. Even if you think it's a waste of time contacting anyone, I still think you should.

  12. I am sorry to hear that you are on AP as me and my fiance are on AP as well. You may email your embassy if you hit the 90 days period and/or call DOS to send a report. Not guaranteeing that you will get an answer to your AP right away, but you wouldn't lose anything if you try. You can also try contacting your congressman, senator etc...

  13. Anything on the DS Immigrant forms is what Embassies base Admin Processing off of. As previous post suggest try contacting the embassy and see if they respond. Hopefully they don't give you a generic answer like they will contact you if they need anything. The problem is you don't know specifically what they are looking at that is causing the delay. Also, why one is in AP is considered classified information, trying to get these embassies to tell you the cause for the delay is like pulling teeth out with your bare hands. I know i'm in the same situation. I wish they would just let applicants/petitioners know specifically (i.e. security checks, previous travel, etc...)

  14. I think I am going to get everyone tired with my post LOL. I just can't think of a reason as to why were are on AP!! He doesn't have a common name, his records are clean and so are mine, his medical results were normal and so then my little brain began to think...and think....idea9dv.gif

    Could it be that he applied for a J1 visa back in 2008 and I put on one of the DS forms (I think DS156) Q1 VISA, b/c we weren't sure about the visa that was applied for, since it was 5 years ago and he doesn't remember anything (Sad I know). Is it possible that the embassy are trying to look for this non existent visa??? And if so, should I call the embassy and let them know that I put down the wrong visa applied for? We just found out that it was for a J1 visa through the university that he was going to.

    He was denied the visa, we have no clue why, he wasn't told why and didn't bother to ask b/c he was sad. We have no idea on finding out either b/c he doens't have any documents stating his denial, neither did they stamp his visa as far as being denied.   16. So, I was in constant communication with my congressmen or better yet his secretary lol. She was very kind and was always responding quickly to my emails.

    In this email however, they referred to my SO as a female. LOL How weird is that?? Anywho, what qualification can they be possibly looking for?? crying.gif

    The immigrant visa application of Mrs. Joan XXXXX is undergoing administrative processing in order to verify her qualifications for this visa. Administrative processing often lasts about 90 days, but in some instances, it can take several months or significantly longer.

    We realize that these extended time periods cause frustration to many individuals, and we are sensitive to the fact that the purpose of the immigrant visa program is to re-unite families. Nonetheless, the U.S. Embassy in Santo Domingo, like all U.S. Embassies and Consulates, must adjudicate visas in accordance with the provisions of the law, and, in some cases, this involves extensive administrative processing. While we cannot predict when the processing of the visa for the applicant will be completed, please be assured that the Department of State, including the Embassy, is aware of your concern. We will do all we can to see that the visa is adjudicated as soon as her qualifications have been verified.
    We hope this information is helpful, and we regret that our response cannot be more substantive at this time. Please do not hesitate to contact us should you need further assistance.
  17. Go to the senator. Set up an info pass appointment. Look up the Ombudsman's office and get a letter ready for him too. There are actually a lot of things you can be doing at this point.

    "You must first try to resolve your matter with USCIS in good faith, you should have at least sent the Service Center director and District Director two letters inquiring about your case via certified mail with return receipt.

    You should also make an Infopass appointment with your district office and talk to an immigration officer to inquiry about the status of your case (this did it for me when my case was frozen).

    Lastly, USCIS has the office of the ombudsman (a person that works for the public to resolve USCIS matters by making suggestions to make the process smoother or by inquiring about cases that have been frozen as far as processing goes) which can investigate the case for you.     Then if you have gotten no movement (unlikely) you can file a writ of mandamus.

    Contact anyone and every one you can to try to get something done with your case! I'm sure this step must be 10x harder then any other because it's just a matter of getting the AP removed before you two can finally be together!     Call your U.S. Senator and ask to speak to an immigration case worker. You will have to fill out and email a release to them allowing them to view your case. They can get an answer from the embassy within 24 hours. Then at least you'll know where you stand.

    Thank you so much. I did just that, and was able to speak to someone from my congressman. I gave her all my info regarding my case and filled out the release form. Hopefully I can hear soon from them :)

  18. Today marks 60 days from my interview. I am at the point where I can't stop crying and asking why has this happened to us? If everything went "well" (Yes I know that there are people who has been on AP for a much longer period of time, but I am not at that stage where I am just "waiting" patiently yet). I started a routine of calling every Friday, hoping for a new answer. Every time I call I get "oh wow, your case looks excellent" or "Oh, they just have to finish the case", "They have everything they need, they are not missing any documents" Ok....so...does it really take that long to finish a successful case? They have even told me that there isn't any red flags on my case. How can they give me bits and pieces of my case but at the same time give me no information??

    Should I contact someone of higher power?? Congressman?? Senator??

    The last time my case has been updated was June 19 b/c I sent an email to the embassy asking for some info on our case (which of course got no where) They say that they are "currently" working on our case, but then again they say that every time I call lol.
