  1. As a side note I just read through all the forms for K-1. Unless I missed it none of them mention the communist party until the I-485 for adjustment of status. I have no idea what complications that would have for AOS. I presume the same wavier conditions would apply and probably a longer name check.

  2. Communist party member ship is pretty much an automatic blue slip but is fairly easy to overcome. You only need to show that membership was required for your job. I have read where some members of the 001 website advocate one should lie about it. While I doubt that the CCP shares it's membership roles with the USA it is never a good idea to lie to the USCIS about anything. If for instance a few years down the road your sweetheart had an enemy that sent convincing evidence to the USCIS that CCP membership had been lied about, it would be grounds for a permanent ban and deportation. There have been cases at the consulate in Guangzhou where party membership was never asked about and a visa issued. I would recommend that you take a don't ask don't tell policy but be prepared to submit a waiver. I know of one case where the woman was still a member of the CCP at interview and couldn't quit her job until she had the visa in hand. She submitted a letter explaining why she had to be a CCP member in order to keep her job and was able to overcome the blue slip.

    Don't ask, don't tell will work fine for the verbal aspect but one would need to answer the questions on the forms honestly. I'm sure that's what Carl meant but the wording wasn't crystal clear.

    You are correct Mike. I only meant that if the question isn't asked you shouldn't volunteer the information. This is a logical assumption if you look at my statement that one should never lie to the USCIS.

  4. Well I can stop whining now. Our I-751 was finally approved today. I got this notice in email

    Application Type: CRI89 , PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED Current Status: Card production ordered. On May 10, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you.

  5. I checked the processing dates for TSC,VSC and CSC. They were all Oct 14. 5 weeks ahead of NSC. I learned to hate NSC 4 years ago when they took 186 days to approve out I-129F. They are still the slowest service center. We are like you Rayma. My wife will be eligible for US citizenship in October. Then we will never have to deal with the USCIS again. Right now I would settle for a 10 year green card.

It's just so frustrating that 1. we're out of pocket more than we should be (which, given that I wasn't allowed to work until they processed my work permit meant that we sank slowly into debt), 2. it seems like your zipcode determines the processing speed (or lack thereof) , and 3. I should be applying for my N400 this year not next -- and after nearly 8 years in this country I'd like a say in how my taxes are being spent (and who is running the country and USCIS!)...!!

    If you have been here 8 years you are eligible to become a naturalized citizen. Then you can vote and have a say where your taxes are spent.

  7. Could I just ask why it bothers you guys so much? Granted I'm the US citizen, but I don't see it bothering my husband that much. He has his extension letter, he has his job. It isn't going to really affect him how long he waits. I'm the one that does all the paperwork and checks this site...

    I'm just wondering how it actually affects your life. I understand being frustrated at seeing others get their greencard, but I really just don't quite get getting all worked up over it.

    And please don't take this in the wrong tone or the wrong way, I'm just really curious! Maybe I'm missing something, maybe it WILL affect us (or is effect, I can never get those straight)? Or is just the worry of being denied? I guess I just assume we will be fine.

    In our case they sent the letter with my wife's name wrong. It has her middle name as both her middle and last name. When I called them and asked them to correct it and send a new letter they said they corrected it but wouldn't send a new letter. Now the only proof my wife has of being legal in this country is a letter with her name wrong. In the meantime her passport has expired and she needs her green card to get it renewed with updated information. For the record we have been waiting 7 months. We have been waiting in one form or another for 4 years. I'm sick and tired of it.

  8. File as soon as you are eligible. The 90th day before the conditional green card expires. We have been waiting 7 months and the NSC website says they are still processing for August. In the mean time my wife's passport has expired and she needs her green card to renew it. Thank god we are almost done with these people. In Oct she will apply to become a US citizen then no more USCIS ever.

  9. I would like to know why so many I-751 petitions are screwed up with mis-spellings, typos etc. Of all the people who have filed one about half get screwed up. In our case they sent back the NOA with her middle name as last and middle name. after two attempts to get them to send a new corrected letter I get a letter saying it takes a year to process these and be patient. In the mean time my wife's green card is expired and the only proof she has of being a legal resident has her name wrong.

I don't post often on this site so I feel a little like I'm sticking my nose in other peoples business but I would like to point out that the K-1 visa was not designed for 90 day trial marriages. You are supposed to be sure the day you file the petition. Since you are from Canada you have the luxury of frequent visits to see your fiance without needing a visa. Take your time, make sure and if you arent write the consulate and ask to postpone the interview.

    The K-1 visa is good for 6 months from issue date. Stay apart another 3 months if the warm fuzzy is there You still have the 90 day window. If it is not Stop the process. The 90 day window only starts once you come to the US.

In my opinion it is not worth the risk to let it slide and hope they don't catch on. If you are supposed to be a conditional resident and you don't file within 90 days prior to the correct expiration of the green card you could be deemed out of status and deported.

    1. Processed for I-551, temporary evidence of lawful admission for permanent residence, valid until (blank), Employment authorized

    2. AUG 02 2005

    3.Class: CRI, Until AUG 03, 2006

    My Green Card says: expires 08/12/14, Resident since 08/03/04

    I´m a little bit confused. We will have our second anniversary in March this year. Why do I have a 10 year green card. Do I still have to file for Lifting Conditions (I-751)?

    Sounds like they made a mistake on the green card. The fact that the passport is stamped with the correct information shows that somewhere there is a file with the correct information. In my opinion it is not worth the risk to let it slide and hope they don't catch on. If you are supposed to be a conditional resident and you don't file within 90 days prior to the correct expiration of the green card you could be deemed out of status and deported.
