  1. They're not applying for an IR-1/CR-1 case where visas are unlimited per year. They're applying for an employment-based green card in which there are a LIMITED number per year, so they have priority dates and such and have to worry about retrogression. Nothing anyone else in this thread has to worry about.

    Hahaha, thanks, PHEW! I sort of just assumed everyone in this thread was doing the CR1/IR1, so I was a bit puzzled. Saylin, on average between a case closed and interview date....how long is it usually? About 2 months?

  2. Called today. My case is completed!!! Unfortunately my category retrogressed for July and now I need to wait for September, so they can schedule me interview in October.

    I sent the IV package on June 14th, was at NVC on June 15th and today the case was complete. 1 week exactly.

    Wait, what?? I am also confused about what you mean with your case was "retrogressed"....your case is complete and the interview will in OCTOBER? Oh that makes me nervous, that's so late!!!

  3. In the scheme of things, Saylin, what you do here, helping us come to the States, or to bring family to the States, is a really big deal. You help us change our lives, doing this, in ways that will effect generations. It is weird: it is HUGE. It is excellent. THANK YOU for your help.

    I just got ANOTHER checklist. I think it's a "fake" checklist, because they say that they received the IV package, but they are waiting for our response to the I-864 checklist.

    So...........to all of you "pros"...........does that mean that the IV package was approved? Now I just have to send the response to the other checklist and we should be set? *Fingers crossed*

  4. Thanks, Trojam, I have already added my transcripts and will be sending those, although I hope they do not get confused by the fact that originally I sent my tax forms and now the transcript.

    As to what numbers to entern on the 1040....that's pretty simple! If you work abroad, you file a 2555 which is the Foreign Earned Income form, and with that you fill in the 1040. But undert no circumstances would you have a 1040. I am just so impressed with the NVC's incompetence because I cannot possibly be the only one in this situation. There's a good number of petitioners filing from abroad, many of whom don't have W2s. How frustrating to get a checklist for something so ridiculous.

    When I called yesterday the operater actually said this case is complete as of June 19 then went on to talk about it being in queue for an interview date and that an e-mail with the interview details will be sent when the date is chosen. She said to call back third week of July for interview date but I'm thinking to give it about a week then go back to calling daily asking for it. Saylin has mentioned numerous times that is a lie and interviews are scheduled all month long.

  6. Case completed @ NVC!!!

    Congratulations!

    NVC received our IV packet on June 12 and exactly 1 week later they accepted it and told me case completed - June 19.

    They received ours on June 12th as well, and still no news :-( Hopefully it will come soon!

    They just do that when they get to one package before the other - which is almost always. They don't even bother to see if the package they ask for in the checklist is in their building. Even in our case, we sent the AOS and IV packages together, and we still got a false checklist.

    Same exact thing happened to me....sent both packets together, and got a false checklist for the IV one.

    Just finished my medical in Montreal, didn't take too long. My results may be ready on Friday, or if not I'll have to go Tuesday morning before my interview to get them (Monday being a holiday here) let's hope I don't have syphilis (haha)! Everything else was fine!

    Question for all of you.....the NVC will never tell me perse that my case is closed, right? I have to call them to make sure of that? Also....about how long after you sent in the stuff requested on a checklist (and assuming everything is ok), did you guys get case completed?

  7. Hi everyone, I have been away for awhile, but I finally sent in the papers to the NVC and now have a received a checklist :-( :crying:

    Now I am hoping for some of your help!

    It says that I am missing the following:

    [x] It appears that there is no proof of current employment (a recently dated job letter or pay stub), or

    self-employment status (a recently dated letter on business letterhead or a business license).

    [x] The listed income tax documents/IRS statements for the years marked below are missing/incomplete

    (if you have lost any of the requested tax information, contact your local IRS office to obtain a copy)

    (Only Federal returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto

    Rico.)

    • W-2 forms are missing/incomplete for the year(s):

    [x] 2011 [ ] 2010 [ ] 2009 [ ] 2008.

    I KNOW I did not send proof of current employment, but that's because I didn't think I needed to (I'm not even remotely close to making the minimum income so it doesn't matter how much my income is, and there is a joint sponsor for that purpose). So...was I still supposed to send it?

    Secondly, I did not send my W2 form because I do not have W2 forms. I work for a company here in Chile, but for that I don't get W2s...only the 2555 form, for Foreign Income Exemption. I had sent in all my Schedules and the 2555 form to show my tax info for 2011. So what do I do? I am thinking of getting my tax transcripts for 2011 and sending that in with an explanation letter about how people that live/work abroad don't get W2s.

    Lastly, the instructions say: The checklist below indicates missing or incomplete documents. In order to make corrections you will need to download a new form at www.ImmigrantVisas.state.gov. You will need to complete and submit a new form with the changes noted below. Please provide all requested documents.

    Does this mean I need to redo my entire I-864 and resend all my other documents? I called the NVC and the lady (very mean lady) told me that I don't need to redo the form, but I am confused because of the above instructions.

  8. Oh no!! I should get my case number within a couple of weeks... Any thoughts? Do you happen to know more or less how long that stuff takes?

    Why wouldn't the foreign exclusion forms work?

    Amenspanglish....I called NVC and they told me to send an explanation letter as to why I don't have W2s. I requested a transcript of my taxes and will send that in addition to an explanation. I'll let you know if that works out or not...

  9. My husband and I got a similar checklist, we didn't think we needed to send proof of current income for the same reasons - he didn't make enough and we had a joint sponsor. We sent a letter from one of his clients as well as a paystub from our joint sponsor (they didn't request it but just incase) and a letter explaining why we couldn't provide them with one other thing they had asked for. We did not send in a new I864 and all was accepted no problem.

    Thanks for that....I will send an employment letter from my employer abroad, and hopefully that will be enough.

    I dont have W2s because I made foreign income too. Is this problem? I haven't submitted my docs yet.

    I don't know!! I didn't think it was, but apparently it is. I think I am going to write to the NVC trying to explain the situation. Unless Saylin has any suggestions.....?

  11. Hi everyone! Hope all is well! I have been missing from the Filers board as you can tell, but it's because I've been a bit busy with work. Plus, as I had mentioned before, we were stalling a bit with some docs., but now we are back in full action!

    I wanted to ask you all a few questions....are there no specific instructions for the DS-230 like for the other forms? I can't seem to find any.

    Also, on the DS-230, 31a and 31b, I have looked over previous posts on Visa Journey but am not 100% sure...in terms of "person(s) who will accompany you to the US"....I don't put myself, right? I only put any intending immigrants (which in our case would be 0)? I am just confused because since I live abroad, I will be going to the US with my hubby, but I am already a USC :-)

    And lastly, I also checked previous visajourney posts but found no answer....do you know if there are any DS-230 forms that can be saved? In ours, we have to retype everything every time we open it.
