  1. Thank you all for your kind and encouraging words. I called DOS yesterday. The lady I talked to said send in fresh medical and documents they are ready to issue the visa

I just want to be sure because the medical costs $130 along with travel expenses. I could use that money to buy food for my son. I don't have money to waste on a medical

that is not needed. Please continue to pray for me and my husband. I believe that prayer changes things for the better.

    Carolyn,

I am praying hard for you that this is finally your finish line! You have endured so much! Good Luck to you and your husband in these final stages!

  2. Hi All,

Another quick update - I met w/a lawyer yesterday....he has really good reviews and after our conversation I feel confident that this is the best route and that nothing much would change if I leave it in the hands of the Senator's office... The lawyer says he will take 4 months to work w/the DOS/embassy to get a resolution...if after that time they don't issue the visa we'll take them to court...sounds like a plan to me...

Also - I noticed that there is no longer any way to get ahold of the embassy since the phone number on the consulate's webpage leads you to an automated voice system in Virginia...I dialed every option until I finally got through to a human who was of no help at all. It appears you can no longer even call to get the special code you need in order to email the embassy - so if I can't contact the embassy, and they are saying that they've sent requests for documents but we aren't getting them...then how the heck are we supposed to know? Mind reading perhaps? Further confirmation that it's time to go w/the lawyer....

  3. I have some good news. The embassy finally called and emailed my husband to come in for an interview. There is one problem. I have a letter from the embassy saying my Affidavit of support and all the other documents we sent are fine but in the email we got today they are saying the Affidavit of Support is not fine and we need a co-sponsor.

I have written to my senator about this and sent a copy of the letter. I also emailed the embassy to find out if they made a mistake because I meet the income

guidelines. I will keep you guys informed about what happens with my case.

That is great news Carolyn! I am so happy to see some movement in your case! Wishing you all the luck in the world that you are close to getting the visa issued! :)

I have some good news, After 2 Years & 1 months My status Changed to Issued. It seem that Consulate(Islamabad) has started to clear their backlog because two of my friends who were in AP since 8 months they got their visa stamped in last week. Here's the Activity history on my Case

12th Aug, 2011-- Interview at Consulate(Islamabad),On Interview day they handed me with Green slip with case in AP

24th Dec, 2011--- Case Refused & Sent back to USCIS for Revocation

13th June, 2012-- USCIS Reaffirmed Case and sent to DOS,

    29th June, 2012-- Case received at Consulate(Islamabad)

29th June, 2012-- Consulate put in to AP

After that when i check status. it says No Status.

but after 1 year and 3 months.

    26th Aug, 2013-- Administrative Processing

    28th Aug, 2013-- Administrative Processing

    30th Aug, 2013-- Administrative Processing

    3rd Sept, 2013-- Ready

    15th Sept, 2013-- Administrative Processing

Congratulations! It is so nice to hear a little bit of positive news for a change! :)

  4. Hi All,

Quick update - hoping I'll have more news to share in the coming weeks.... After this awful news I worked w/my senator's office to make a follow up inquiry and provided affadavits stating that we've never received anything from the embassy and timelines for all the times we've reached out to the embassy since their "request"....I'm still waiting on the response and planning to call the senator's office this week to see if there is any news (although we have seen a lot of date updates on the CEAC website - so at least that feels positive)

I also spoke w/a friend of my husband who is an immigration lawyer...she recommended getting a lawyer at this point (not her - so she's not biased) - if we do not hear anything positive from the senator's office, we are going to have a lawyer file a complaint w/the Inspector General's office at the DOS....if after 6 weeks this does not get things moving, then we've been told we have a very good case to file a writ of mandamus....this is our current plan - hopefully it works out sooner - I'll try to post updates after we get more info....thanks for the support all! :)

  5. I've called the embassy multiple times to confirm that they have my husband's correct contact information - as well as mine - in addition I have contacted the DOS repeatedly and asked if they needed any updated forms (always told no), I've written to the whitehouse (as the first time this happened that is how I found out the embassy was waiting on our travel history - they apparently requested it in October and I discovered this after receiving a response from the DOS in regards to my letter to the Whitehouse at the end of Novemeber)....I've also emailed the embassy w/no response and called them specifically regarding this and was told it was probably just expired forms and the embassy would notify me when they were ready for them...and that I should wait for them to respond to my email - which they never did!

I am LIVID! They are playing games with our lives! This could have all been over MONTHS ago - and now we are back in AP! ranting33va.gifranting33va.gifranting33va.gif

  6. Hi All,

I'll try to be as brief and to the point as possible...

    - In October 2012 I wrote to the White House to inquire about our case after being in AP for over a year...for those of you who don't know my husband is a UK citizen and we are processing at the London embassy, but he grew up in Morocco (not a citizen though) and has a muslim last name...received a response at the end of November 2012 informing us the embassy was waiting on his travel history/passports...due to the holidays we submitted these to the embassy on January 15th 2013....we waited and didn't see any activity on the CEAC website since January 25th....I called the DOS semi-frequently to check our status and response was always "still in AP"....I even asked multiple times if they were waiting on any forms and the answer was always no...

    - Flash forward to May 04, 2013 - fed up w/waiting I emailed the embassy (w/the proper code) to inquire what was taking so long...no response...still to this day....nothing!

    - Called the DOS on May 07, 2013 and by some miracle spoke to someone who *seemed* to know what he was talking about - said the embassy was waiting on updated medical and police certificates and that could be why we were waiting in AP....

    - Called the embassy ASAP and mentioned this - they said it's probably just because the forms were expired and they wouldn't request new ones until they were ready to process the visa....told us to wait for email response from the embassy (they never responded). I also double checked that they had our correct contact info because I was worried about not receiving any notices again...which they confirmed they did...

    - Contacted Senator Gillibrand's office end of May/beginning of June and they made an inquiry w/the DOS on June 21st

    - Received a letter from Gillibrand's office TODAY July 15th informing me that the embassy requested my husband's updated medical and police certificate on JANUARY 22nd 2013 -- which THEY DID NOT -- and since so much time has passed we have been put back into AP and should not submit new medical or police certificate until it is RE-REQUESTED!

This is the SECOND time we DID NOT RECEIVE a notice from the embassy when they said they did - we've triple checked to be sure he is getting his mail, the address is correct, etc.

#######?! Any suggestions on what I should do?! Who I should contact?? I'm ready to get a lawyer - any suggestions for a REALLY GOOD NYC immigration lawyer???? can I sue the embassy? The DOS?

I'll be calling the Senator's office tomorrow to see what else we can do - in the meantime want to find a lawyer asap - possibly file a complaint w/the inspector general of the DOS....any other suggestions?

Here is the official response from the DOS below:

"Embassy records show that Mr. ___ was contacted on January 22, 2013, with a request that he obtain and submit a new UK Police Certificate and undergo a new medical examination with the Embassy's panel physician.

However, due to the time that has passed without a response from Mr. ___, the Consular Officer has determined that additional administrative processing of his application will be required before further action can be taken in his case. This processing is mandatory and cannot be waived or expedited. Whilst we cannot predict when the processing of Mr. ___'s application will be completed, we can assure you that he will be notified as soon as it is.

Please note, Mr. ___ should not obtain a new police certificate or medical report unless they are re-requested by the Immigrant Visa Unit."

  7. Hi All - thanks for sharing your experiences - here is a quick update.... I called the DOS today and they told me that it is noted in our file that they are waiting on an updated medical exam and an updated police certificate...apparently this was noted back in january which would have been right after we submitted the travel history and passports...again we never received ANY notification from the embassy and also I called the DOS less than a week ago and was told there is no info or anything they could tell us about our case or why we are still waiting...the guy I spoke to today told me that it is very likely that this is the hold up and they are just waiting on the submission of medical and police cert. and might issue the visa shortly after... I'm going to do some investigating but will post what's going on as soon as I find out....it's beginning to seem like the only way to get any sort of progress in your case is by pestering and bugging anyone you can to get a drop of info about your case in order to try to find out if you need to submit anything to move on to the next step... and they might be sitting on your case and not requesting info for months without you knowing to ask...

  8. Hi All,

So with the holidays and my new job keeping me SUPER busy it took us a bit to compile his travel history....but we submitted it mid-January along with his passports. Unfortunately, he does not have one of his previous passports anymore so I really hope that does not cause us any further delays. I included an extremely detailed travel history as well as a letter explaining the missing passport, the letter I initially received from the DOS/Whitehouse response, and my email correspondence w/the Embassy about this recent development in our case. And just for the record, we never received any official notification from the Embassy requesting this information, so had I not been checking into it, who knows how long we would have gone without knowing. Now - we wait. Will try to update w/any news...according to the DOS visa status website they last updated our case on Jan 25th...hoping we hear something good soon...thank you for all of the great feedback and good luck to everyone else that is waiting!

  9. THANK YOU ALL for the feedback - sorry for not getting back right away - I've been busy trying to get to the bottom of this....I finally heard back from the embassy and they confirmed that they just requested this information on October 29th so we have not been waiting forever for nothing - although we did not get any requests for this information through mail or email, etc.

They are requesting his complete travel history, current passport, & all prior passports. Has anyone else had this information requested of them? We're not quite sure how to format his complete travel history? I'm a little confused, because shouldn't everything already be stamped in his passport? Unless they just want us to write it out so it's easier for them to read? Also, my husband said he no longer has his old passport - he's looked everywhere but apparently it's long gone... Not sure why they need an old passport but I'm not quite sure what to do if we don't have it?

Sorry for so many questions - getting any specific information out of the embassy is tough so I'm hoping someone who's been through this can share some advice....thanks!

  10. Hi All,

I need your help and advice - my husband has been stuck in Administrative Processing for the last 12.5 months. I have assumed it was because of name checks due to his common muslim name. I have repeatedly called the Department of State, emailed the embassy, and even had our Senator make several inuiries into our case. After our interview we were told no documents were missing and they had everything they needed (they did not ask for his passport), but told us that we just had to wait for our AP to finish.

Well, I recently sent an email to the Whitehouse and this is the response I received:

    Dear Ms. _________,

I am writing in response to your October 5, 2012 letter to President Barack Obama concerning the immigrant visa application of Mr. ________ in the United Kingdom. Because the Department of State is responsible for all visa matters, your letter was forwarded to us for our reply.

Visa applications are adjudicated in accordance with criteria specified in the Immigration and Nationality Act (INA) and applicable federal regulations. A review of Department consular records confirmed that Mr. _______'s visa application is pending at the U.S. Embassy in London, United Kingdom, under Section 221(g) of the INA. An application may be refused under Section 221(g) of the INA when required or supporting documents are incomplete or while the consular officer verifies information submitted in support of an application.

In Mr. ______'s case, the consular officer is awaiting submission of Mr. Mohamedy's complete travel history, his current passport and all prior passports. If you have questions regarding the submission of these documents, you may contact the Embassy's Visa Information Center by telephoning 09042-450-100. If calling from the United States, the number is 1-866-382-3589.

I trust this information is helpful.

    Sincerely,

I am not sure what this means. I have not called the embassy yet, because I want to get some feedback and find out if anyone else had a similar experience first. I was under the assumption that we have been in AP due to name/background checks...but it sounds like they are waiting for his travel records and passport. We were NOT asked for any of this at any point. I even heard about another case that had expired and was denied because forms that were never requested were not submitted in time - so I specifically asked the DOS if they had everything they needed for our case when I last called them - and they said they did.

Is there an agency that performs travel history checks (FBI?) for the embassy or is that something we were expected to submit?

Do you think it's possible we've spent all this time waiting while they were actually waiting on us to submit travel history/passport?

Please - what do you guys think? Please share opinions/advice/similar experiences... I want as much info as possible before I try to call the embassy about this...

Thanks in advance for your feedback....

  11. I'm sorry to hear about what you are going through - my husband interviewed in London and we have been in 'Administrative Processing' for the last year. I've done everything from writing to senators, calling the Department of State, & contacting the Embassy multiple times. I recently wrote to the White House and received a response saying that they are awaiting submission of travel documents & his passport. I don't know what this means yet. My understanding was that we were pending due to Name/Background checks...I am going to try to post a thread about it sometime later today when I have more time. I also need to call the embassy and try to figure out what this means. But if I found out we waited a year after our interview and we never got any requests for this information (after repeatedly calling and asking if there was anything wrong/or missing in our case) - then I will be EXTREMELY upset... I've also heard of someone's petition that expired and denied because they didn't submit information in time that was never requested of them. I will post my thread later, but I wanted to share my experience w/you - will try to share more when I have time and figure out what's going on. All I can say is I'm sorry you have to deal w/that and glad you are on top of it making sure it gets resolved asap!
