  1. Hello everyone,

    I have been using the site for a while now, and I am thankful for all the help I have received here! I am now 2 days away from doing my oath taking for my citizenship and I am excited to finally start helping my parents.

    I would like to petition them. Can I petition them at the same time? They are both here in the US. Both overstayed their visas. My dad and mom asked for visas together, and we approved. My mother came to the US 20 years ago, and stayed. My dad came 8 years ago and stayed. My dad has all of his papers, i94, original passport, etc. My mother in contrast, has nothing. Not even her original passport. How much of a problem will this be? They are still married.

    I have many questions:

    1. Will there be a problem with my mother and the loss of documents in order to petition her?

    2. Can I petition them at the same time?

    3. What do I need to file, and what supporting documents do we need?

    4. Do you think we will need a lawyer for my mother since she has lost her documents?

    I am applying for the green card with my husband as the petitionary. I have never worked in this country. i have been married 5 years. My husband never filed taxes for me. He always filed as single. Now my lawyer says that immigration will not like that and we will have to amend out taxes. We amended them. We now owe more than 3000 dollars. We have two kids together, and I am not sure how i owe if i HAVE never worked. We dont have the money to pay for this and we would like know what could our next steps be. We dont want problems with the IRS.

  3. Hello everyone!!!

    I just received a letter in the mail that i need to apply to remove conditions on GC. My green card will expire on July 14, so i am already getting ready to reapply. The thing is that i feel i don't have enough evidence. This is all i have:

    -letter stating joint bank account

    -lease of our apt (I am not listed in it because at the time i didn't have my GC)

    -Some pictures?

    -Federal/State Taxes

    i have been in school the whole time so we never really went anywhere. We have no kids, car, house, etc.

    What else could I include? Would this be a problem? Also where it says who prepared the form...(screen shot of section below) I just put my name down and sign it? Thanks guys!

    Ps: My husband is an US citizen, whats his A number?

  5. HI guys! I am happy to inform you that my green card is on the way; I should be receiving my welcome notice tomorrow, buT I have a little problem. I just recently enrolled in a new school and I need to get financial aid. But I don't have a ssn yet. Is it possible to go to the ssn office and apply for it now, Even though i don't have the green card physically? A woman in the FAFSA office at the college I am applying to... told me that i should wait for the green card because that way if i apply for the FAFSA it will be linked with the ssn but if not, it wont. Is this true? If so, fI go and apply for the ssn can I get the number before I get card? In how long can I do this? Thanks Guys!

  6. My husband and I have a 18 month old together, is that enough proof of a real relationship? He is not a picture person, so we don't have many pictures together, at least not enough to fill a whole big album with photos.

    We have been together for about 6-7 years. When we started dating I was a 14-15 and he was 19-20. Is there anyway he can get in trouble for statutory rape, or could we just say we started dating when I was 18? I am 21 now and he is 27.

    i was 15 when i met my husband... and he was 20... Nothing happened when i went to immigration interview... They did not ask anything about that.

  7. That is really strange. If he went to jail because of hitting her.

    The law says that he will be deported to the country of birth (or country of origin).

    Some one at court house dropped the ball. "domestic violence" case against GC holder is reason to start removal process automatically.

    She can not remove the proceedings, it the state they live in case take the domestic case with/without her being at the court.

    Check the status of his case... I think he is also in trouble because of domestic case.

    it is really sad because they have a kid together... and she does not want to leave him... she has told me that he does not do stupid things anymore... thank you all for your responses though thanks!

    If she files a petition and it is approved, she can get deferred action or a Green Card. At the very least, her immigration status won't be connected to him anymore, so she can leave the relationship if she needs to. She'll need to prove the abuse, so it's helpful if he's been found guilty in a court.

    There's probably an organization that helps abused women in your area, so she should contact them. Maybe you can look around for someone who can help her.

    He went to jail once for a day, but my sister dropped all charges from him. She said it was because of their 2 year old and their relationship... Will that be a problem for him if he wants to apply for citizenship? thanks :)

    she actually send him to jail for one day but got him because she felt bad about their 2 year old son and her relationship with him... she drop all charges from him will this be a problem for when wants to become a citizen? thanks a lot!!

  10. She should withdraw the I-485 (adjustment application) but leave the I-130 (immigrant visa petition) pending. Hopefully USCIS will not begin removal proceedings against her. If she has overstayed for less than 180 days, she can leave without incurring an overstay ban. Then when her I-130 is approved and her priority date is current, she can apply for an immigrant visa at the consulate.

    If she stays, her only options would be to (1) stay in the U.S. as an undocumented immigrant until her husband becomes a U.S. citizen, and then file I-485, or (2) stay in the U.S. as an undocumented immigrant until her I-130 is approved and her priority date is current, then travel back to her home country to apply for an immigrant visa AND apply for a waiver of the overstay ban based on severe hardship.

    She has been here for 7 years, and she only applied for the 1-130... Can she still be deported?

  11. my IO is not the same as yours, but he said the exact the same thing, we will be making decision by Saturday. But now it's Monday, still nothing. Did you get a white paper form that ticks "Your case is being held for file review..."?

    I'll definetely keep u updated :D!! My interview was wednesday and nothing has happened. Case status only says that i received a letter for the interview but nothing else... One funny thing happened, my husband got the mail and saw a letter in the that had a card and it had my name on it, He was screaming "THIS IS IT BABE!!!!!" HE forgot that i was supposed to get a debit card with my new name on it! lol It was Funny!

  12. PJ1925, I think maybe we had the same IO, what's your IO's name? My IO said the exactly the same thing: "blabla, I will review your document and make a decision by Saturday", he also wrote on my passport, "I-485 Pending, and his name initials", but Saturday has pasted, nothing ever happened, I guess we are going to get bad news sometime next week. I am prepared for appeal now, how could government tear family apart? this is so absurd and ridiculous.

    his name was B. CHISOLM Im so scared!!! we are also a legitimate couple... i wish they ask my hs teachers... all my/his family and friends.. People get nervous with these things!

  13. Hello you guys! Thanks so much for helping me throughout my journey with adjusting my status.. My AOS interview was a not so great experience. I have been with my husband 4 years and like 10 months before we got married. I was aware Of the fact that he has dyslexia. He always gets confused and switches letters on his own name sometimes. Since I knew about this Made him read books because I heard it helps people with dyslexia. Anyways, to make the story short... We went for our interview in NYC at 8:00am. He was very nervous. I know that he isn't very good under pressure... The IO started asking him questions ( he is the petitioner) my husband couldn't remember how many people I lived with before the marriage, what's the capital of the country I am from, and it was hard for him to retrieve information. I know that it's because of his dyslexia. He even said the wedding date wrong... January 28 and he said June 28 because both months have the J at the beginning he gets confused... When the IO asked me questions I was not scared because I knew these things. It was just my husband that had problems answering questions. At the end the OI PUT the Alien number on my passport, and he put i485 pending and his last name also. He said he was going to approve it Saturday?? And the interview was on a Wednesday. He asked my husband why isn't he on unemployment - he lost his job and he said that it was because he was looking for jobs... I don't know what to make out of this interview. It's already Saturday and noting has changed on the status of the application online. Help please? Thanks :(
