  1. Did he become your husband overnight? A few hours ago you were asking about CR1 vs K1. I'm fairly certain you've applied for neither.

    oh my goodness. he is coming down in about a week and we are going to get married, i did not explain because i didnt find it necessary. but no i havent filed but plan to file the CR-1 once we get the marriage certificate. so about a month... and he will still be here with me.

  2. No fees at the interview.. only fees you pay for CR1 is for the i130 when you file, i864 and DS230 packet for NVC when its time.. its all less than 1k

    don't actually have the fees in my head right now but if memory serves me right...

    we paid

    355 for i130

    88 for i864 packet

    400 (can't remb the exact it ws under 500) for the DS230 packet

    okay, so now since im all confused, and learning a whole new visa process.

    do i file the i864 pacied and ds230 packet together? and do you send those in by mail, and if so, when in that process? is it after the approval of the i130?

    and could he be in america with me until the time comes for him to go to the interview?

    We also did the CR1 because to us it was just as simple as we knew we were getting married anyway so why not go ahead and do it this way.

    For us, it ws better to file the CR1 so he could work as soon as he came instead of waiting to Adjust status and another 1k paid.

    See if any of this helps make your decision.

    the time it takes varies but usually between 3-5 months for i130 approval then another few months between NVC and waiting for the Interview date. From your country it's not common for a long AP (if any) so you could see the visa that day or within a few weeks after the interview.. so it may be about a 9 months to a year tops.. maybe longer as it's difficult to say.

  4. Thats what I thought.... All the Answers were assumptions. It's the begginning of the year. I'm not sure until your licensed but a Certified Nursing Assistant is Only a 9 week Course and take a test and pay a Fee.

    A CNA will make more than Poverty LInes by far and be required to work So much Overtime ( Double Shifts) Most are Union and require Double time on Holidays. Being a CNA is not a job everyone wants to do, but the sick and elderly require 24 Hour Care. It is a Good job with a Future.

    You just Filed your 129-F and you have lots of time before the interview to show Pay Stubs at that time. (About 7 or 8 Months from now) Your in a good position.. I'm sorry everyone assumed you were an adult but in fact your are (were) a minor.

    My indication was when I seen your Time-line. LOL hahaaahhhaaa.

    CNA's have a good future (Anything in Healthcare) Be pre-pared to adjust to working 50 Hours or more per week.

    but i plan on just working part time because im going to be going to school to become an RN, so i will need a co sponsor...

  5. I-134 only requires copies of tax returns IF a person is self-employed according to the instructions: Section: Supporting Evidence , sub-section C. -and then only a copy of the LAST tax return filed (not three years), and it states a copy of the return not a transcribe for the IRS.

    Sub-section B, requests a letter on business stationery if you are employed with the required details of employment.

    okay so what do i do then to state that i have only just started working? and what will i need as the primary sponsor?

    and my co sponsor will need what to be exact

    okay. thanks, but i dont think you realize that i didnt ask the same exact question, please dont do that again. it doesnt bother anyone that i post twice, i dont post that much at all, and i am very oblivious to this and i want all the answers i can get so i can get my fiance back here. so, i could care less about having two posts that are the same topic, i just want my fiance back.

    that was my main question. and if i dont have a job at the time how do i fill out the paper work? and how does it differ from the co-sponsors?

  7. okay i know for sure im going to need a co sponsor for my i134 form, and i have a few questions

    im taking CNA classes soon, and after that i will be working part time, and i wont have any tax returns to send in due to me just getting a job... so. what do i do about my lack of tax returns for the i-134?

    and okay, so do we both fill out the i134? does my co sponsor do anything different than me?

    alas, one more question, what if my co sponsor doesnt have the most recent tax return?

    im so scared they are going to deny us because of this

  8. You and your joint sponsor will both fill out an I-134. You'll also both submit your most recent tax returns, and evidence of current income. Your joint sponsor will also need to submit proof that they are a US citizen or permanent resident.

    The I-134 is submitted at the visa interview.

  9. If your state's law says you are legally able to marry at 17 then you will not need parental permission. If the law in your state lists legal age of marriage at 18 you will need parental permission.

    Your birthday is in 2 weeks. Best to wait until you are 18 and file with the knowledge that you won't be denied.

    Just out of courisity, how will you qualify income wise for the I-134? I assume at 17 you are probably still in school or just starting out in the work force.

    Sorry that I assumed we had discussed your age in a prior post. Recently there was a young lady in a similar situation and I assumed it was you. You might want to do some forum searches where underage petitioners have dicussed exactly what you are asking.

  10. This was covered many times in your PRIOR posts about you having to be able to legally marry at the time you file.

    So... If you are NOT legally able to marry at the time you file due to your age your petition will be denied. You will lose your $340 petition filing fee and you will start all over again with having lost months of time waiting...

    WAIT FOR YOUR BIRTHDAY TO FILE...

    im sorry, not meaning to be rude, but i never once asked question that had anything to do with this.

    this is the first time i have ever asked about me filing before my birthday, so i am VERY oblivious.

    so i couldnt even get a notarized note from my mom saying i can marry to help it? and with my birthday being so close do you think they would be okay with it? thanks.

  11. okay so im 17, and my birthday is January 13, so its only two weeks away. could i send it in now? or do you think they will reject it? im so confused :(

    also, my fiance is coming to see me a few days after my birthday, would that be okay? even though when i sent it in only a few weeks prior it says he isnt in the country?

    and if in the case of them returning it, if he is in the country when i re-send it in, would i have to state that he is in the country? or not? PLEASE HELP

  12. They won't reject the visa because he stayed too long. The issue arises at the border. They might only give him a small window to visit because he's been there so often or they might not give him any time at all (i.e. he would be rejected at the border).

    He won't be able to stay until his interview for several reasons. Once the NOA2 is received (about 5 months from NOA1) the file will be sent to Canada. He will need to have police clearances done (with fingerprints) as well as medical.

    but he can stay till the noa2 right?

  13. There's no rule about staying 30 days, unless his I-94 specifically dates his expiration date as 30 days. Do NOT overstay that date.

    The issue you may have is when the IO reviews how many times your fiance has been in/out of the U.S. during the year. If it looks like your fiance is attempting to live in the U.S. (which may be considered as spending more days per year in the U.S. than in Canada) it may look suspicious. Proof of ties to Canada, return information, etc should be brought - but it should be brought regardless as entry is never guaranteed anyway.
