  1. Well it is now beyond the point of reconciling. She has explicitly made it clear that she doesn't want to be with me. I am talking to lawyers to find out the process. So yes it is happening. I just feel like I just lost the past year of my life. There is no way I can get it back. I had so many hopes and dreams but I guess it is for the better. I am glad now that I won't be spending my life with her.

    So I suppose wait till I actually file for the divorce? It is not like the case is going to progress at all without me doing something. Technically she could fill out the IV form and send the payment right? But I don't think she will ever want to come to the US.

  2. So I talked to a lawyer yesterday and was told about the no fault divorce. The reason would be irreconcilable differences. There will be a hearing but my wife would be permitted to attend via phone for the hearing. The lawyer is asking $3500 though which makes me feel that I should shop around.

  3. Well I did not know where to go to ask this question. The time has come for divorce. I really don't want to talk about all that happened. I am here just to ask a few questions on how to proceed with this matter from a legal point of view.

    My wife lives in Canada, I live in the US. We got married in Ontario last July. I want to know where I should file for divorce. How does it work when the husband and wife reside in different countries? If I file in Canada, will I have to travel there for court proceedings? In the US I reside in NJ. She cannot come here if any court proceedings are required as she is not a Canadian citizen, just a PR.

    In terms of the immigration process, I am holding off on paying the IV fee. I know that there is a 1 year period within which you must respond. I want to wait till the divorce is complete to withdraw the application.

    I probably won't be online a lot but I will come back to read your responses in a day or two.

  4. I would say you could always send the AOS. It won't be put into affect until your wife gets the visa and crosses into the US, making her a resident. Until then, it's just another paper submitted. So you can at least send that off in my opinion. If you want to hold off on paying the bill (so you might not lose $230), then that's where you might want to stop. Or, if you want to take one more step, you can pay the bill, but not send the IV package.

    As for the relationship, I'm probably the wrong person to talk about it at the moment laughing.gif But, I'd suggest doing what I did, and sit down (as much as you can while apart) and just talk about things. Trust me, it helped me in the long run. Ask her what she wants, if she can have anything right now no matter the impossibility of it.

    Ok so sending AOS package doesn't mean anything right now? I should send that? hmmm will have to think about this. But as was mentioned here the most important thing right now is resolving our issues and saving our marriage.

    I need to start looking for work too but I am in no shape mentally to do that.

  5. Well I really tried for the last 6 months to get things working, I tried to go visit and resolve our differences but we have a big issue communicating. As much as I try we can't resolve our differences because she refuses to talk. She says the most hurtful things to me and from all that it looks like now she says that she will never love me, she will never have respect for me in her heart, and many other things. I would just wish for us to talk about our issues and work towards resolving them but she doesn't want to even talk to me. She never considered herself married, for her it was when we are living together we will be married. I did not like a few of the things she did which I don't expect any married person to do. I tried so much but last 2 months I have had more than enough. I lost my job because of this, I am losing my mind also. I would still want to reconcile but I can only do that if she is also willing.

  6. OK, so I hate that it has come to this. After waiting for so long, I never wanted this to happen.

    So I have my AOS Package sitting in my drafts all ready to send. The invoice shows as paid. But I am reluctant to send it now. I am trying to think what exactly it would mean submitting the Affidavit of Support. Right now as things stand, I am waiting for my wife to determine what exactly she wants. If she wants to reconcile our differences or if we should just head towards divorce. I think the wisest course of action right now would be to put on hold the whole visa process which I can do easily by not mailing the AOS package and not paying the IV fee. But at the same time, if things were to get better between us, this will add to the delay for her to come here.

    This is a very screwed up time right now. I wish things were simpler. All I wanted was someone to love who would at least care a little about my feelings.

  7. I'm so sorry about your job and that things with your wife are not going well. This process is stressful and losing your job doesn't help. I hope that now that things are finally moving with your case, you and your wife will get back on a positive track. You've been waiting for a long time for NVC to even receive your case, so congratulations on that finally being resolved! Hang in there and focus on the positive movement with NVC, which brings you and your wife closer to being together.

    If you have your AOS package ready to go, I would e-mail it now. Did you get the confirmation e-mail that your Optin for EP has been accepted? I had to send mine twice and the second time, the confirmation e-mail stating that "This case is now enrolled in the Electronic Processing Program." was received less than an hour after. Once your DS-261 is confirmed, then the wait starts for the IV bill to be invoiced. Hopefully it won't take very long.

    I agree with everything Kerry said. I'm so sorry to hear about your job and the stresses with your relationship! Her advice is awesome though...and it's really good you've got some forward movement now. I really hope this helps things for you!

    Damn, losing your job, having a rough go right now, that really really really sucks. I'm sorry.

    Try sending your opt-in email again. since you have been invoiced, the 'switch' is on and it should be accepted quickly. Once you have the acceptance shoot off the AOS package.

    Now that the choice of agent form is filled out you'll get the IV fee invoiced soon.

    OMG, I was at lunch and I got an email notification that your timeline has been updated. I saw ur progress and got so excited for you and I wanted to respond sooner but was on my phone, but congrats!!! It's been a long time coming for u. I'm sorry to hear about the problems with ur wife and the loss of the job. Hopefully things are changing for the better for you. I'll keep you in my prayers...

    Just to clarify, the time to email the AOS package is once the invoice shows as paid, correct?

    Congrats for getting your case number and im sorry about loosing your job.You cant start with the process now don't wait for OPt to be accepted.Look at Saylin's signature she didnt waste her time waiting for OPT to be accepted.Wait till AOS status turns as PAID then email your AOS package.PLZ read again Saylin's CAnadian Benefeciary wiki.It has all the info into for us.

  9. OK, I woke up today late, long story, I lost my job on Friday, Things are not going well with the wife either, life seems to be at its lowest point right now. But today I guess there was some positivity. I got an email back after my NVC inquiry. They sent me the AOS Invoice and the choice of agent form. I was happy to finally receive my NVC case number. I first sent the opt in email for the electronic processing. Next I paid the AOS fee. I then printed out my AOS Document coversheet and was now going to email my AOS package. But I remember I should wait for the opt in email to be accepted first? I did receive the auto response. I then went to the forms portal and filled out the Choice of Agent form. What is the next step, wait for EP to be accepted? Everything is happening at once!

  10. USCIS. Get a Tier 2 human (see ISO - http://www.dhs.gov/files/publications/gc_1305658440339.shtm )

    then, get an ISO.

    then , once you've GOTTEN an ISO (that bit was important)

    ask them where the casefile is.

    Be adamant about NOT setting up a service request - as this will waste further time and really isn't useful.

    Instead, tell the ISO that the casefile has been approved for (x months) and there's no indication that NVC has received it, and that YOUR PRIMARY CONCERN is that it's still sitting on the adjudicators desk,

    and then...

    ask the ISO to send a request to the ADJUDICATOR to bundle up the casefile to go to NVC.

    Then call back in 2 days, see what's what. If still no movement outta USCIS, then get an ISO again, and ask the ISO to get to the Adjudicator's Boss, telling them that the casefile was lost by the adjudicator.

  11. They are lying that it can take a few months to get there, and your proof is all of us here and everyone before us. I wish I can offer some other sort of advice. I would not be as calm as you are now if I was in the same situation :no:

    I know they are lying. I just don't know what I can do. I am so pissed that people whose cases were approved after mine are already getting case numbers when there is no sign of mine even leaving USCIS.

  12. My I130 was approved on 3/23 (three days before yours). My case is still not at the NVC. after 15 business days NVC told me to send my notice to nvcresearch@state.gov and after a week they sent me an update that the case is still with USCIS. They said it could take 4-8 weeks to receive it. USCIS has been really unhelpful and rude, NVC at least gives me straight answers. I guess I am in the same boat. I don't know what else I can do. My congressman has nto responded yet.

  13. Just keep calling NVC. I'd suggest calling twice a day now as NVC is clearly assigning case numbers to similar NOA2 dates as you. You're getting it this week for sure yes.gif

    Well I wish I could be that optimistic. I don't know, I have lost all hope now.

    I called NVC and they said it still has not arrived. Called USCIS and they just kept on telling me it usually takes a few months for the case to move to NVC. They are telling me to call the NVC after 4 weeks. I don't know who to contact. Congressman has not replied. :despair:
