Hi.  My wife is a US permanent resident of 7 years.  I am an American.  In August she went to Canada due to a health scare with her parents.  With Covid and things being safer where she's at then where we are at in Georgia, we decided it would be better for her to just stay there until things get better here.  She is a non-resident Canadian citizen still, so she can work there.  We've already talked to the borders and immigration and she's allowed to legally stay in Canada for up to a year.  That is the reason she is staying there until March because she can't get work down here in Georgia and it's just safer health wise for her right now. 

     

    If you stay in Canada for longer then 6 months, you have to get a Canadian DL.  We are looking into getting an International Drivers Permit from AAA to prevent that from happening.

     

    The main question is, if you stay in Canada longer then 6 months you have to register your car there as well.  Her car isn't worth the import fees that it would cost to import to Canada and then re-import to USA in March when she plans to come back.

     

    So we are trying to figure out options for her car, so that we don't have to register it.  She could just not use it while she's there, but in March she will need it to drive back down here.  Do any of you know if there are options in regards to this?

     

    This might be more of Canada question then anything, I figured it was worth a shot to ask here.

Hi.  I don't know if this is the right place to ask this or not.  I am a US citizen and my wife is a green card holder (permanent resident).  We already have gone through the process and are well passed that.  My question is related to my wife (green card holder) is leaning towards wanting to live in Canada now (where she's from).

    I still need to work in the USA though and both of us have older parents that we need attention as well.  

     

    We want to remain married, but we are trying learn what options we have.  Due to work, being apart at times is not the problem, so that's not an issue.

    From what I can gather, either one of us can stay in Canada for 6 months out of the year and then we have to wait another 6 months before re-entering Canada again.  Is that the rule and if so, is there any other way around that, so that either one of us wouldn't have to wait 6 months to re-enter Canada again?

    Also too, is there a way she (the permanent resident green card holder) can keep her green card and choose to live in Canada and be a dual citizen?

     

    I'm also trying to find answers of how things could be possible to work, if she decides to want to end her permanent resident status, and then how I could still work and do what I have to do in the USA and still be with her as much as possible too.

    Anyways, it's all complicated, so I'm reaching out to the internet for some direction and any help I can get/find.

  3. I think the key piece of information missing here is: when did you two get married, in 2013 or 2014?

    As a side note, willfully failing to file a tax return (even if you don't owe taxes because you've already paid them through withholding) is not a good habit to get into, as it is technically illegal.

    Yes it is a terrible habit the problem is the amount of W-2s I have been tracking them down is always a problem. I realize others have this problem too and probably handle it better than me I just know that this year is one of those years in which I am having a hard time tracking them down.

    On the visa question I had we got married in May 2013. And she was approved to be able to work starting in September 2013. But she did not work still in 2013 does not have any income to report. She wants to go visit her friends in two weeks. I am scrambling a way to get my taxes done. But I wanted to know just for my sanity is this a problem if they are not done in time for her to get back into the country?

  4. Hi. My wife and I have successfully gone through the whole process and have been approved for everything. She has her drivers license and her permenant resident card and all that jazz.

    My question now is. I have not filed my taxes yet for 2013. I am the us citizen, she came here from Canada.

    We now have to file jointly.

    I have loads of W2 s to track down and it always takes me a while to do my taxes. it's never a roblem with penalties because I always get money back.

    My questuin is, she wants to travel to Canada for 2 weeks. She did not earn any money in 2013 at all. Does she still have to file taxes to be able to cross the border and return?

  5. Hello. We are at the final stage of AOS for our K1 Visa. My wife has received her work authorization and advance parole. We are still waiting on the final interview though. She has her Drivers license now too in the US.

    So, she was approved and received her card for advance parole. How does she use it? She wants to go back to Canada for a week in October and she is worried they are not going to let her back in and/or mess up our whole immigration process.

    The whole point of getting the advance parole is so that she can leave correct?

    Does she just bring that card with her and everything is fine?

    I've read over guides here but I am still unsure on how to tell her that it will be fine.

    Any help would be much appreciated. Thank you!

  6. If you already sent in he AOS paperwork with the maiden name then you'll either

    1. Get an interview and beg to get the name changed.

    2. Pay for a replacement GC with new name.

    3. Wait until ROC to change the name.

    You should have sent in your paperwork with the new name, but what's done is done.

    Okay so yes, we never knew when to get her name changed, so it has remained the same all the way so far.

    So we will have to go for an interview for aos right? So is it this interview we ask for a name change?

    What is ROC?

  7. Hello. Our K1 was approved. Just in time to have our ceremony. We are going to magistrate in two days to make it official.

    Question about importing cars though.

    The border said we had to take her (my Canadian wife/fiance) Hyundai to a national port and pay fees to have it imported.

    I have read that with a K1 that she is allowed to bring one car in to the country duty free.

    Is that correct?

    Anybody have any clear directions as to how we get her car legal now?

  8. Hello. My fiances interview for her K1 visa is this Thursday at the Montreal Embassy. We are going over everything. Is there a fee for the actual interview and is it supposed to be paid before or at the interview?

    Are there any fees to pay at the interview and if so how much?

  9. Okay, on the i-134, affidavit of support, at the bottom of the page, there is a blank line where they want you to sign and date it. I did this and fedexed it to my fiance who has her interview.

    At the bottom of the page there where it says "Oath or Affirmation of Sponsor"

    I signed and dated it,

    BUT there is a line after the part that reads, "I acknowledge that I have read "SPonsor and Alien Liability" on Page 2 of the instructions for this form, and am aware of my responsibilities as a sponsor under the Social Security Act, as amended, and the Food Stamp Act, as amended. ___________________

    Then it says, more stuff and then there is a place for a signature and date.

    I DID NOT see this line after the section I mentioned. It doesn't say to put anything there on the form, so I did not even do anything to it. I signed and dated it and overnighted to her to take it to her interview.

    The problem is, Was I SUPPOSED to sign something here? If so, are we screwed? Cause there isn't anytime to overnight another original form.

  10. It is for a K1 Visa.

    All I know is it's on the checklist and she spent a long time filling it out and got a barcode and they are asking for it on the checklist, so we are just trying to be prepared.

    I do not have a clue as to why or what all this stuff is for. I am just trying to make sure we have our checklist prepared correctly.

    Everything is jarbled and chaotic.

    I just want to know what we are supposed to bring, but there is never a clear answer from anywhere.

  11. I am trying to go over this checklist with my fiance to make sure she has everything she needs for her interview. This is the list on the Montreal Emabassy's web page.

    On the DS-160, it says these documents must come with it: passport, proof of petition, I-129F.

    Now on the interview checklist from the link below, it says you need a passport, which we have, but it doesn't include the next two items:

    Proof of Petition

    I-129F

    So with that said, do we actually need Proof of Petition and the I-129F and if so, what is a "proof of petition and I-129F?

    I-129F is just a copy of what I sent way back in the beginning of the process right? To the USCIS?

  12. Hi. My fiancé just got her interview set at the Montreal consulate on may 2. Assuming the interview goes well and she is approved. How long does she have wait before she can cross the border with her newly acquired visa?

  13. I need to send my fiance in Canada the i134 and intent to marry letter. It has to be dated within 30 days of the interview. We don't have the date yet, but can I just sign the forms here in US at home and scan them and send them to her. Then she can just print them out? Or do they need to be the original forms? Thank you!!

  14. Hello. Got this from K1 Montreal Guide, which is who we are dealing with.

    5. Sending Packet 3

    How you send P3 is up to you. It can be done for free via DHL, but many have found it faster to just use an xpresspost mailer from Canada Post and eat the cost themselves. If you are sending it via xpresspost, it goes to the following address:

    ATTN: Immigrant Visa Unit

    315 Place d'Youville Suite 500

    Montreal Quebec

    H2Y 0A4

    Make sure to again write your MTL case # on the mailer itself.

    (You could also just send it regular mail, but it’s usually better for peace of mind to get a tracking number, which means XPpesspost.)

    Is this still a safe option?

    We would rather do everything we can to make it quicker and every little bit helps. I just want to make sure that this is still a safe option as opposed to doing it through DHL.

  15. We are at the stage of sending in our Packet 3 to Montreal Consulate.

    Question, as far as the checklist goes.

    We are still waiting for finger prints to come back, police reports, and my taxes will be done in four days.

    With that said, is it safe to send in Packet 3 now and mark everything as checked, knowing we will have it all done within 8 days?

  16. Also, another question is the:

    DS-230.

    In line 14 of this document. It asks for "Spouses Name"

    Problem is we aren't married yet. So how is this approached. There isn't anyplace to put my name on the document. I am the American. She is the Canadian and it seems like I should put my name on the the Spouse section. BUT if I say I am a spouse, aren't we saying we are actually married, when we aren't?

    The whole idea of K1 visa is to get married after the visa, so I am confused as to what to do with this form.
