    Again, that was not her intention. She just followed along to what others were saying which is why my suggestions got drowned out and now i've having to handle this headache again while she gets to be stuck in a hell hole. We are filing for returning resident visa come january. Let's see where this takes us. Appreciate all your opinions. And wishing everyone a safe and joyful christmas.

  2. Sorry about the omission but whilst there, my brother tried to get them family based residency because of his health and was asked not to leave the country. But he decided to and was given a letter asking him to come back by Sept 8. This is something i don't know very well, only been told about this. As for now, the status of that application is unsure,  although i've been told it will be a long time before she can go there again. I would rather have her here since she already has a resident card. It's a little frustrating to realize she has to jump some hurdles now even though she's only been a spectator in this whole ordeal

  3.           Going to Nepal was dads decision. None of us could convince him not to. The plan was to come back to the USA. But Nepal he choose, for a few other reasons I cannot tell. They got there on March 13 only to have most of the world shut down on us less than 2 weeks later. He was doing ok till June when his health took a turn for worse and October took him in.  

               Nepal is probably the worst place to be at right now and I cannot let my mother stay there by herself. I did ask her to make an appointment at the consulate to argue her case. although I'm a little less optimistic about our situation, it's something I have to do. Just not sure what the best way of going about would be. Sb1 would be a little less hard on the wallet so...

  4. 1. My brothers have just had newborns which was the reason we went there. They have 4 kids altogether and work full time but I'm all by myself which is why i think i can take care of them 

    2. They have had to pay out of pocket for specialist and diagnostic exams and its been quite expensive already

    3. Md thinks dad had another stroke sometime after coming to Australia which went unnoticed. Dad's vertigo is so bad now he's almost wheelchair bound whereas he used a walker when i took him there. He also fell and hit is head while on a ferry ride. His bp just won't come down for whatever reason. His been told to wait 4 months before travelling

    4. Parents are considering going back to Nepal if it doesn't work out. In some ways medical care will b cheaper if they do although quality of care may not be the same

     

  5. Fellas I desperately need some advice. US citizen here.  I brought my parents to USA as a permanent resident in the summer of 18. In February of 19 we all went to Australia to visit family and friends. Dad's health has declined quite a bit (2 strokes in 2 years) since and he's in Sydney with a visitor visa extension and has been advised not to fly for now. I didn't apply for travel documents before leaving due to poor financial situation. Now I'm considering bringing them back to the states as soon as he's in the clear. What do you all think is my best course of action? I don't want USCIS thinking they actively abandoned their privilege although it looks to be that way. 

  6. Evening everyone, my parents have their interview scheduled next week for family based immigration with me as their sponsor. I'm just curious about the kind of questions they will have to answer during the interview. I'm sure a lot of you have had your parents/family members come to the USA, kindly let me know if any of you have any information to share. I want to give my parents a heads up but i'm not sure where to start. Thanks.

  7. Can somone kindly clarify a few things for my I-864 for my parents?

    1. On part 1, do I select 1.a. even if my wife is going to be filling out I-864 am I'm the only one who filed I-130.

    2. On part 3, I have to select 2 and include my mother since she will be immigrating with dad, right? And vice a versa for mom's I-864? Otherwise the total in household becomes 3 which is false.

    3. On part 6. Item 19, if my last year's income was less than $10,000 but my wife's was 4 times that, will this have any impact on the application? I make more than my wife this year and have all the copies of my pay stub to include.

    I looked around and got more confused therefore asking here. Thank you for the help in advance.

  8. Hey Guys, thanks for all the help you've given me. Long story short, I got letter for initial evidence for form I-864 saying I need to file complete federal income tax return for my sponsor for the year 2010. Since my father in law owns a business, I had filed 1040, Schedule C EZ, Self employment Tax and Profit and loss from business for the last three years. But they are saying it's not enough. Also they are making me submit I-864A since my mother in law is the president of that business and her income is used in the household. Assuming that I am just now filling out form I-864, Can anyone please clarify to me exactly what documents require to be submitted for I-864 and I-864A? And is it too late to just send them transcripts of Tax Returns to put an end to this unnecessary delay? Thanks again.

  9. Hi guys, I have run into a confusing situation with my AOS. Keeping this long story short, I filed for AOS, got a RFE saying I need to file affidavit of support signed by my wife which I hadn't with my application package since her father is the primary sponsor and so I didn't realize I had to. The things that I am confused about right now is:

    a)On Form I-864 Affidavit of Support, Under PART 6 Q: 24, Section C, I understand that I have to mention my name and my income since it's a part of the household income but which one should I check mark, option d or e? I am leaning towards option e since I am the intending immigrant and have no accompanying dependent. I am sure my wife can't be one since she's 23 and has recently started working.

    b) My wife's recent employment brings into question the Federal Income Tax Return under Q:25. She was in college until early 2010 and employed for 3 months only last year for which she got a W2. She's been employed since March this year and has no W2 or Income Tax Return to show. What should I do in this case? I simply have nothing else but her recent pay stubs to submit. The instructions on USCIS weren't clear enough to me.

    I did all my preparations myself via help from Visajourney and USCIS.gov and seems like this is the only thing I missed. Thanks for all the help guys.

  10. First of all, thanks VJ and its members for everything. this newb has learned a lot here. But i still have a few things I could use some help on:

    I am about to file for AOS in a month. On my applications I have submitted the front pages of my passport and copies of visa that was stamped back in 2003. The thing is I lost my passport with I94 on it back in 2006, had a police report made, got a new one made for both. So the copies of the pp is from the new one while the copy of the visa is from the old one. I have included a letter saying what happened and attached a police report i made. is this good enough or do I need to add something here?

    I am about to file late income tax. I don't owe or am owed anything for that year so I never cared to file. will this have any effect on my application since one of the forms specifically asks if i ever skipped or didn't care to file Form 1099 and I have marked 'NO'? I sure hope this doesn't come to bite me.

    We have been having problems with mis-delivered/undelivered mails lately. Is there any way I can ask them to send all/any of my mails at a different address? I am not moving out so the change of address doesn't apply here. The last thing I want is for them to send me a RFE letter and me not knowing at all it was sent.

    I am representing myself so I hope you understand my confusion.

  11. a little late to the party here but i might as well share my experience.

    i lost my passport, social security card, i-94 and i-20 while moving to Texas from Colorado.

    i applied for a replacement I-94 and attached a police report only saying i lost it. they sent me a new card after 3 months. it came in the mail all of a sudden and never showed up in the CASE STATUS page on USCIS's website. i did remember my 1-94 number in my head so may be that made it easier i don't know. I recently got married and will be filing my AOS next month myself. Thanks visajourney for all the help.

    funny thing is my community college didn't help me either. they said they didn't have copies of the documents I submitted there.
