    Thanks for your email.

    I will definitely continue to pray for you and your family. Like you, we didn't hire a lawyer 'cause we think we can do it. So far, for my AOS stage, we are ok.

    Today, I received NOA of my hubby's (USC) petition for my daughter in the Philippines so it's in process. I have been reading a lot in VJ about similar cases in Manila. China is a bt of a challenge I gathered. It's less complicated ( I hope!) for me 'cause I was not married to my daughter's father. In the Philippines, the mother of "illegitimate" children has full custody. I hope I wouldn't need the father's signature or "permission". We are "in touch" and he said he wants the kids (my son is a USC by birth, 9 yrs old and he is coming here in Aug for Sept classes) to spend at least a year with him and family. I am not keen to the idea and told him so. He said he will go to court on the basis of his paternal rights (I never asked for child support nor did he voluntarily give any and he is currently unemployed) and that I have abandoned my kids...whew, the drama of this!ha!Pardon my sharing my case.:)

    Anyway, I will say a special prayer for all of us while watching the July 4th fireworks..:) All these effort we do will pay off.

  2. Hi, everyone!

    There are only ten (10) states that are on known to be "community property states" - Alaska (opt-in),Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington State and Wisconsin.

    Under a community property system, all property acquired by either spouse during marriage, with a few exceptions (such as property acquired by gift, inheritance, or devise, or the rents and profits of separate property) is treated as "community property" meaning that each spouse owns an undivided 1/2 interest in it. At divorce, all community property is split 50/50 between the spouses. If the property can't be divided in half (basically any property besides money, including houses, cars, and other tangible property), it will be sold, and the spouses will split the proceeds.

    In the Philippines,aliens, as a general rule, are not allowed to own real property in the Philippines. By “general rule”, though there are certain exceptions, as the 2 below:

    The prohibition on foreigners owning Philippine lands is embodied in no less than the Philippine Constitution. This, in fact, is one of the usual reason cited by those who want to revise or amend the Constitution. The Constitution provides:

    “Save in cases of hereditary succession, no private lands shall be transferred or conveyed except to individuals, corporations, or associations qualified to acquire or hold lands of the public domain.” (Article XII, Section 7)

    It’s clear from this provision that private land may be transferred only to persons or entitles who/which has the capacity “to acquire or hold lands of the public domain.” Those who are qualified to acquire or hold lands of the public domain are as follows:

    1. Filipino citizens.

    2. Corporations at least 60% of the capital of which is owned by Filipinos.

    In other words, the Constitution explicitly prohibits non-Filipinos from acquiring or holding title to private lands. Among the exceptions are as follows: (1) transfer to an alien by way of legal succession; or (2) if the acquisition was made by a former natural-born citizen. The 1987 Constitution provides that:

    “Notwithstanding the provisions of Section 7 of this Article, a natural-born citizen of the Philippines who has lost his Philippine citizenship may be a transferee of private lands, subject to limitations provided by law.” (Art. XII, Sec. 8)

    The Supreme Court reiterated this general rule in a recent case (Borromeo vs. Descallar, G.R. No. 159310, 24 February 2009). The Court also reiterated the consistent ruling that if land is invalidly transferred to an alien who subsequently becomes a Filipino citizen or transfers it to a Filipino, the flaw in the original transaction is considered cured and the title of the transferee is rendered valid.

    There are other exceptions to the prohibition on aliens owning real property in the Philippines, like full ownership by foreigners of condominium units.

    To summarize: The USC couldn't touch the VJer's property in the Philippines especially that she acquired them before marriage. Suggest you google on real property owndership in the Philippines. I read somewhere before that even if a Filipino, after marriage to a foreigner, acquire properties /businesses in the Philippines, the USC will have difficulty getting his share (if at all) from the Filipino spouse, after divorce. Any foreigner who wants to acquire a property in the Philippines need a Filipino citizen to "partner" with them. Thy can't purchase land and businesses there on their own. They can get condos and apartments under their names but not land. So figure how he can get his condo from the "landowner" who is his/her spouse, the Filipino citizen, in case they divorce? Sounds ridiculous huh?!

    Apologies, you came to the US on K1 so messybrownhair is more familiar with the process. Her replies are more reliable as she had been there ..:) I came here on a B visa so my husband needed to file I-130 for me after marriage that required both of us to submit G-325's.

    I didn't look at your visa type.I just went ahead and looked if you have a timeline published or not.

    Yes you can't file for AOS without your MC...so try to find out exactly when you can get it.

  4. Hey everyone,

    Just recently got married and going to file the AOS soon. Wanted to get some quick answers before I send things away. For the fees that need to be paid, does it include the fees for the other optional forms like the I-765 or would you have to add the cost of that form in with the I-485 form fee?

    Another question is do you need a co-sponsor when you file for aos if you meet the 125% poverty limit?

    My last question is who fills out the G-325A? Both of us or just my wife who is the applicant?

    Also, I don't know if any of you had a problem in getting a certified copy of the marriage certificate, but where I am, in Hawaii, they told me that they are backed up and it would take maybe 6+ weeks to get a certified copy and that is when its a rushed order. Any advice? I do have the little paper that the judge gave me that shows we were married.

    Ok, what was you visa prior to marriage? Suggest you also include your timeline when you reply so we will know about your journey so far. :)

    To answer your questions:

    1. If you're applying for I-485 (AOS) along with I-765 (EAD) (together) then you don't need to pay for the EAD. So only one fee, that of the AOS -$1070 ($985 for AOS and $85 for biometrics). That's why I applied for both one time.

    2. If you're certain that the sponsor or petitioner's income reached or exceeded the stated 125% income bracket per I-864P, then you don't need a co-sponsor. Make sure that you have the petitioner's income tax returns since 2008-2010. They should be reflected on the Form I-864 (Afffidavit of Support) which is part of your AOS packet. Please ensure that you have I-693 (medical) sealed and signed by a Civil Surgeon designated by the USCIS attached to your AOS packet.

    3. For the I-130 (Petition for an Alient Relative) that the USC files for the alien spouse, you both need the fill out a G-325. Make sure you got 2 pix each in the packet. For I-765 (EAD), the applicant/intending immigrant needs a G-325 too and pix. Some forget the pix, you will get an RFE, that will hold the processing of your papers ...you don't want that...delays. :)

    4. Wow, 6 weeks?!We got our certificate of marriage the next day after marriage from the Court House in Bedford, IN. You might want to call them again? Even in Vegas, my friends got their marriage license within 5 days after their wedding, considering the load of marriages Clark County has daily..:) Maybe some VJers in Hawaii can help you on this one.

  5. Stokes interviews are pretty much only ordered if the immigration officer has a very strong gut instinct that the relationship is fraudulent, and needs an "objective" reason for the denial. Stokes interviews are as clinically objective as they come: the couple is split up, and each person is asked the same list of several hundred [occasionally VERY personal!] questions. If the two people are in substantial agreement on a certain percentage of answers, they pass, and are approved. If they are even one disagreeing answer above the (unpublicized, secret) threshold, they are denied.

    If you find yourselves called to a Stokes interview, things have already gone badly wrong. There are immigration lawyers who will help you with Stokes interview preparation and training, and that is several hundred dollars VERY well worth spending. If you go to a Stokes interview without major preparation, you will almost certainly get denied, and appealing/recovering from that is very difficult, if it is even possible at all!

    I have NO idea what kind of bizarre legal voodoo the OP's lawyer has in mind, but skipping a Stokes interview will virtually certainly result in an immediate, automatic denial, with (as was said above) MASSIVE red flags attached automatically to any future petition or appeal attempt. In your shoes, I would get a VERY detailed description of his plan of attack, and then I would get a second (and maybe third) opinion. And then I would fire him. Because I don't see any possible way (in my reasonably educated opinion) that skipping an interview could ever be a good move!

    If there is nothing to hide, I think the concerned must attend the stokes interview.

    I got a text and email from USCIS yesterday saying my EAD card is on production. No NOA yet though. Hope it will be here next week as I do have a job waiting and the bills with my names too..hahah!

    My husband has also applied for I-130 for my 3 yr old daughter and we have received the email and text message of receipt and acceptance, said the case was forwarded to CSC. No NOA yet.

  7. The conclusion I've got from this (with the help of you on this forum) is to not to limit yourself to the standard instructions and the documented process. If there is a legitimate reason for special attention, there are helpful people in the immigration organization who are willing to expedite things.

    Anyway - fingers are crossed. Biggest fear now is that my wife will go monday to pick up the translated notarized document and find for some reason that it is delayed.

    I have no knowledge nor experience whatsoever that I can impart regarding your case but I have been reading the thread since you started this because my husband, the USC, has filed I-130 for my 3 yr old daughter (his stepchild) in the Philippines last Sat and we have gotten email and text notices of its acceptance with the WAC number last Tues. Think the NOA1 will be within the week.

    I can only offer my prayers to you and your wife and stepchild.

    I am learning so much from Jim and Darnell and you!I know where to reach out when I meet road bumps in the future regarding my case. Their support to your case has been very admirable. VJ rocks!

    I undertsand the "paranoia" that something negative could happen again when your wife picks up the translation, etc..I can be that way too especially with the tight schedule...let's trust our pure intentions and that everything do happen for a reason.   9. Wow, congrats to you both!

    Today, I woke up with a text fr USCIS that my EAD card is on production, checked my email and sure it said same thing, checked my cases status at the USCUS website..am happy! I got a job offer 2 days ago and we're just waiting for my EAD so I can apply for SSN and my state ID/DL then I can start work! I am one of the many who check the online status a million time a day..hahha!

    Please pray for our AOS interview set on July 25, 2011 @ 10am @ the Indianapolis CIS. I read some feedback about the office..all saying they were interviewed separately (25 mins in all on the average)...if there's anyone who wanna share their experience specifically in Indy, pls PM me or share experience in the feedback section.

  10. prep.mac WOW WOW WOW are you serious this is like what 1.5 months and interview date is already set? wow duude!

    many asking this very question nowadays, you are not necessarily receive an EAD, you may or may not receive it. We also don't pay for it so can't really complain about it. Most importantly, you have your interview date, that is above all the most importance.

    Thank you!..been pretty fast, yes..:) In fact, there was delay of a week or so cuz of the medical RFE (I-693) I failed to submit..so yeah it's fast...considering we filed on our own, no lawyer involved. Spent a week learning the USCIS process, fill out forms and submitted attachments. My husband said he didnt wanna go thru the same thing again.hahah!

    Still I am hoping I'd get my EAD sooner. I just got a job offer yesterday but could not start til I have my EAD and SSN. Of course, no car insurance inclusion yet.

    Also, I noticed there are like 4 May filers from the midwest whose papers are all at the CSC being processed who got interview notices quickly..CSC is kicking!

  11. To answer Delaw's concern, my wife knows about my finances, we however do not have a joint account yet, because she does not have a social security number yet. It has been 6 weeks since we applied, and when we called them back after a month to see whats taking so long, the rep in the office said that it could take from 4 weeks to six months. So unfortunately, I cannot add her on any of my documents because they all require a ssn. I don't know what to do, I am sure if her interview comes up before the ssn is issued, we will have to explain ourselves to the officer.

    My husband didnt have a problem adding my name to his existing bank account 3 days after we got married (it's a major US bank, btw). The bank gave us a printout right away and we included that in our AOS packet. I only presented to the Bank my Philippine passport and water/internet bills showing we live in the same address. Up til now I still don't have my SSN cuz EAD is not yet here. So it is possible you can include her name in your bank accounts to get a joint bank account which the USCIS will want to see on the interview too to show co-mingling of resources/finances.

    As to your assets, I suggest you write a cover letter to USCIS detailing the documents you submitted in response to the RFE,enough to prove to them you have met, or, even exceeded the stated income in the poverty guidelines (I-864P).If you can tell them that, and, if they still want your list of assets, they will send another RFE. Just my thoughts.

    I had my AOS Interview at New Orleans office today.

    Like others, it was straightforward, we were asked for ID and some evidence that we were living together - we produced a joint bank statement, joint auto insurance and life insurance showing each other as beneficiaries.

    The IO said that she was happy with what we had, and that she really didn't feel like talking about what color the paint in the bedroom is for half an hour. Explained that GC would take up to 8 weeks, but usually 2-4, and that EAD was proof of status til then. A brief discussion about soccer vs football, but then the IO noticed we had some wedding photos, so she had a look through them. The interview was over with in seven minutes.[/color]

    My question to all this is HOW IN THE HE!! am i to produce evidence such as listed above if i cant even get my wife a state I.D. card???????

    We have been being kicked around by the DMV and the SSI office.

    the dmv says she cant get a drivers license or an ID card until her social security card has her name changed, the the ssi office she cant change her name on the card until she gets a new form of ID showing her new name. Social Security issued her a SSN with only her Passport and k-1 visa but now they need a GC or EAD or something showing her new name change.

    so my point is how can i show joint car ins??? how can i show joint checking accounts?? how can i show joint utilities???

    something is screwy here in New Orleans.

    we have filed for AOD,EAD and AP, we are just waiting for the first document to arrive with her married name on it just to start moving forward.

    So you're saying you have not gotten anything back from USCIS? What about your I-797 (Notice of Sction of NOA)? You can't get the intending immigrant ssn or state id or driver's licence without either the EAD/AP card or the GC.And it's gonna take some time. It's a waiting game.

  13. Hi guys. We received our first RFE, asking for three things in subsequent to the first one. When we filed for my foreign spouse's aos, I had not yet filed for 2010 tax returns. I had made a note to them that I will send those out as soon as I file them. I filed for them the week after we mailed out the package, but I was waiting to receive the first NOA to have a file number before I mail it out.

    Well we have received both, the First NOA, and the RFE. The rfe has asked me to first submit the latest tax return, and then it also says that my income doesn't meet the poverty guidelines, and I know it does. I have no other dependents and I make more that twice as much required....and so they are asking for all other things like employment letter, bank statements, pay stubs, asset list, etc.

    My question is, if anyone is able to answer me, if I only submit the tax return will that be sufficient, along with the poverty guidelines proving that I earn sufficient amount of money?

    Gathering all the other things at this stage will be time consuming, plus I do not want to share my private paperwork such as bank statements and such with them.

    Please advise.

    Hi Desi78:

    Suggest you send all the documents they stated in the RFE. It may take time but you mightt get another RFE cuz you haven't completed the needed documents, and, that would certainly lead to more unnecessary delays.Look at it this way, you will still bring those documents to the interview anyway so might as well start gathering them now.

  14. I received two biometric appointments and both for I-485 !!! There is no biometric appointment for I-765 !!! Both came for the same form i-485 with the same receipt number !!! I received both letters 2 weeks ago and now while getting ready for tomorrow appointment i realize they both for I-485 :( What should i do ??? Its been almost 4 months since i received my first NOA and only tomorrow im going for my biom app and whats worse -THERE IS NO I-765 biometric appoinment :((((((( should i call uscis ? PLEASE HEEELP

    Why would you think missing a stokes interview which is scheduled only because they suspect fraud would ever be a good thing? Think about it, by missing it, you're pretty much confirming their suspicions and basically giving up and packing up.

    Like you,, I didn't intend to marry my husband now...lol! But, life has twists and turns so here we are. As long as we can prove to them that the marriage was into with good faith, that it is valid and true, then you should be ok. My journey so far:

    BTW, where is the National Benefits Center? Does it mean that we have to go there?

    By the way, to all members, in my NOA for my July 25th interview in Indianapolis, one of the docs listed was "any Government-issued photo ID"..which I don't have yet due to no EAD yet so no SSN so no state ID and DL and no car insurance inclusion (hahah!).. so I only have my valid Philippine passport to boot. I'd think USCIS would not expect me to have anything else? Any thoughts?

  18. and I called! my case was transferred to CSC yesterday!.... and i tried checking it online after i called and it came out.... "On June 23, 2011, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER ..." Yay!

    though my EAD is still not found.I spoke to a customer representative and they couldn't get any info either so they suggested that i would email uscis webmaster after a week. They were very nice and helpful customer representatives,too!

    Any idea why cases are moved to CSC? I gathered from the posts here in VJ that most military spouses' papers are moved there, almost all of them no interviews needed. Are you a military wife too?

    10/2009 - met online

    11/2010 - came here on B1/B2 visa

    12/2010 - first meeting in person in Chicago, IL

    03/2011 - moved in with him in IN

    4/25/11 - got married in Mitchell, IN

    5/02/11 - sent AOS packet (I-130/I-485/I-765) to Chicago Lockbox

    5/04/11 - AOS packet received by Chicago Lockbox

    5/23/11 - Received NOA for RFE (I-693)

    5/27/11 - Sent RFE to DHS Lee's Summit, MO

    6/02/11 - DHS Lee's Summit received REF reply

    6/06/11 - Biometrics done at Louisveille, KY as per NOA schedule

    6/24/11 - Received NOA for July 25 interview in Indianapolis

    Waiting on my EAD...have a final job interview tomorrow though...haha! This waiting game...

    5/24/11 - Received e-mail notification for I-485, I-130, I-765

    5/24/11 - Checks cashed

    5/25/11 - Last activity on account based on online tool

    5/28/11 - Biometrics appointment letter (for 6/20/11)

    6/20/11 - Biometrics Done (they were very nice)

    6/24/11 - Text indicating Activity online (at 7:30 am) in morning - I jumped up so fast to get to the computer!

    6/24/11 - Notice stating that interview will be on July 27 - no EAD action though

    6/25/11 - Received letter that interview will take place on July 27 at 11am

    We were prepared to wait for a long time - according to all the information out there. But basically within 2 months of USCIS cashing the checks they scheduled the interview - is this a good sign? I have not received EAD at all - they haven't even touched it. Please, anybody out there - is this a good thing? I am from Chicago ... also has anyone on the forum had any interviews at the Chicago locations recently?
