  1. What is your Visa category? For IR/CR category IL's are going out today and they are in Feb 2023. So they are a 12 month wait for that category.
  2. Yes you can use the I-864W. The I-765 is just so she can get the Social security # so as EAD card arrives since the approval of the I-485 can take some time. Just nice to have that sooner rather than later.   3. No I-751 that's Removal of Conditions. They need to file: 1. I-130 2. I-485 3. I-765 4. I-864 5. I-131 (optional)
  4. Unfortunately this is so flippin common in Nigeria that I deal with the embassy expects it. It is not impossible to get over this hurdle. Just wish you knew what you knew now. First a Writ of Mandamus was a waste because you are telling them to make a decision now. They don;t even have your evidence. Have you even got your NOIR or NOID letter from them. Yes it's unusual to get case sent back for misrep most get a chance at embassy to rectify the situation. This is what your wife needs to do. She needs to go to her high court (get a lawyer to do it) and get a swore affidavit stating she has never been married before. She needs to coup to the lie. The agent can put whatever they want she raised her hand t interview and said all was true and yes they do ask are you married so she can;t say she didn't know that was there it was her responsibility to check and make sure all was true. Get the affidavit and wait out your letter from USCIS.
  5. Unfortunately, we with family in Nigeria have to pay for the sis of those before us. Unless your father (who might get a Visitor Visa depending on age) may get visa it will be very hard to get one for your brother without a long travel history outside of Africa that required a Visa. You need to show strong ties . The CO has to feel confident that the beneficiary will return wen they are suppose to. All you can do is apply and let the chips fall where they may. Appointments are pretty far out. But after booking a date you can always keep checking and maybe get lucky and find an earlier date. I did the same for my brother in law.

  7. I have a friend going through the same thing she filed her ROC 1 month after my husbands in June 2018. But she divorced about 1 year after Then last year she applied for citizenship. Had interview finally for I-751 in April 2023. Then N-400 interview in August 2023. Adjudicator said she will her something by end of August. Nothing. End of September nothing. Weird the adjudicator gave her her phone # and email (if they legit who the heck knows) but no movement on I-751 or update since 2019 and nothing on the N-400. She is Nigerian also and so was her ex. But Ex did get messy in beginning cuz he was hurt and called immigration saying all kinds of wahala. I do agree with @Rocio0010 previous marriages to your country people especially Nigeria is a BIG Read flag. So I am sure they are examining the divorce decrees and such. You know how documents go there it can be troublesome at best.
  8. Not a good reason but you won't know unless you try. You must show why bringing beneficiary here sooner rather than later will help the situation. I mean you have the condition regardless as they see it so how will having the Beneficiary here help?
  9. Just FYI the two people getting married don;t have to be in same place. But they do have to "Consummate" meet up after the ceremony and before filing I-130. I know a few coupes who have done the UTAH zoom wedding and both parties were in different countries all approved and living in US. This zoom thing getting popular in these had to marry places and especially for those condemned to get married in certain countries so they keep it on the low low.

  11. I have a friend same situation (weird they are from Nigeria also and had to switch to divorce waiver). She filed one month after my husband which was June 2018. She just had her N-400/I-751 interview 2 weeks ago. Yes filed in 2018. There's was filing I-751, getting divorced. moving from one state to another, transferring case. But finally after many e-request finally. Still not approved still waiting for I-751 to get approved. It's like it's stuck like yours. Hang in there. Hope you don't have to file WOM.
  12. Congratulations to all the August Interview letters(IL) folks for category CR/IR that dropped today. I have seen DQ dates so far for: May 12, May 16, May 21 through June 28. This was for IR5 also DQ June 28th. Are there any other DQ dates getting IL's today? Report back.
