Have your parents or whomever owns the house you and your husband live in write a letter stating what you just said above, get it notarized and signed and send that in. Should help. Speaking from experience because I went through the same K-1 process recently and have the same living situation as yours.

My father did fill out his own I-864. We just filled out the I-864A together. But now with submitting his 2011 1040 tax return and all other documents with it, I think it should be ok now.

July 3 - mailed out AOS packet
July 11 - NOA1 for I-485, I-131, I-765
July 13 - Biometreics appointment letter
July 25 - RFE I-485 - I-864 Form lacking evidence (most recent year tax return required, 1099, w-2, etc, and joint sponsor does not meet 125% mark)
I mailed out a I-864 for myself and one for my father since he is the joint sponsor. I have been a student and have no income and I am also listed as a dependent on his 1040 tax return. We also filled out I-864A Contract. Submitted my father's 2010 1040 tax return where it shows he has an income of that year for over $100,000. Yet in the RFE, it states that the joint sponsor's, being my father, income did not meet 125% of the federal poverty line for the joint sponsor's household size. I checked online through the government website and for our household size, his 2010 income was well above the 125% mark. They also asked in the RFE for the most recent year tax return, 1099s, W-2s, etc. but he is self employed and only has a 1040 tax return. Just recently he got his 2011 1040 tax return, so I am assuming they want to see this one instead of the 2010?
Will just mailing my father's 2011 1040 tax return, a letter stating that he is self employed and has his own business suffice in answering this RFE?

Sounds like you provided a lot of evidence for proof of relationship. As some others have mentioned, it could have been the actual interview that drew the CO suspect of your case. Having everything on paper is one thing, knowing how to answer the interview questions is another. Did you prepare prior to the interview? Do a mock interview with sample questions? Confidence is key.
As far as providing additional evidence, I would suggest typing up an updated Fiance Letter of Intent to Marry - one for you and one for your soon to be. Sign and notarize of course. Also, get both parents' side to write a statement that they are happy with your engagement and support you two and look forward to your upcoming marriage. Sign and notarize as well.

You can get all your paperwork and letters in order, just don't sign or date any of them. Once you get your Packet 4 or actual interview date, do it around then. My fiance and I signed an updated letter of intent on Dec 28, 2011. Her parents and my parents signed an updated statement supporting our engagement and upcoming marriage in the US on Feb. 14, 2012. Her actual interview is March 12, 2012.
Hope that helps. Just try and keep the signed papers with dates within 1-2 months of the interview date.

Eee, Mr. Sachinky and I took a trip to Puri a couple of days before our wedding since he was scheduled to fly out right after our wedding and there wasn't any time for a honey-moon, per se. While my parents, of course, knew about it and so did my close, immediate family, I was advised by mother not to mention it to extended family/elderly relatives/village-cousins for fear of outright disapproval. Of course, she should know better than that. Things like that just make me mad so I told all and sundry during the wedding that our lovely tan was from sun-bathing at the Puri beaches. Oh, the horror!
So you got married before you came to the US...?

I would advise you to contact your local congressman only after the allotted waiting time has passed for your case at that particular Service Center. I contacted my local congressman after the 5-month mark and they helped expedite my case. If you try to expedite your case via your Congressman, not much will happen.
Just wait.

Depends on how your US Embassy works, we had to submit all our documents (Packet 4) before the visa interview at an office called the VFS. In that Packet 4 we included an updated Fiance/e Letter of Intent. Also we have a copy that we will be bringing to the interview just in case.

noticed your timeline, why did you end up canceling your K-1 interview and get married 4 months later? what happened? why not just do the interview and get married in the US with the K-1 visa?

I have read a lot of K-1 visa interview reviews and have noticed that a lot of COs suspect or believe that the beneficiary (interviewee) is married. Why do they think this? If the person wanting to come to America is married, why would they file for a K-1 fiance visa and not a K-3 spouse visa in the first place?
The only thing I can think of where this legitimately applies to is to people who get married while they are waiting for the K-1 visa (which doesn't make sense either, why would you do that to jeopardize your K-1 Fiance Visa?)
Does anyone have any insight as to why COs are such harda**'s with K-1 fiance visa interviews thinking that you are married??

It may come up in the interview. My advice is to always be prepared to handle a potential question a CO might throw at you. I can tell you truthfully that I have read topics on VJ posted by India members that have had issues with taking a vacation together prior to marriage. The CO was convinced they were married and on their honeymoon. Be prepared to rebut this with affidavits from parents and documents showing you are not yet married.
My fiancee's parents have signed a letter - statement of parents - stating that they are happy with our engagement and are in support of our future marriage. My parents did the same. Both letters are signed and notarized. Also, the letter was signed AFTER our small vacation/trip so it shows that they knew we went on a trip together and are still in support of our upcoming marriage.
Should I get another letter from her parents stating that they are aware of the trip my fiancee and I took together and are OK with it and approved of it? Or is that overboard?

This is a great topic. I recently went on a trip to India to visit my fiancee. I was gone for a whole month and during my trip to India, I surprised my fiancee with a trip to Goa and the Maldives. It was just her and I. We ran into problems going through immigration to the Maldives. The immigration officer at the counter was convinced that we were both married. That we both ran away and and got married together! I was baffled by this!! Blown away, shocked!! I told him no we are just going on a small vacation. But he was not changing his mind. Even though it doesn't matter if we are engaged, married, friends, classmates, etc we would be able to travel because no where on the immigration form does it say 'Married' or 'Single' or anything about marital status, mainly just asks purpose of visit, passport information, contact information, etc.
Regardless, we were both able to go to the Maldives and come back without any further problems. Obviously we were both shaken up quite a bit from the experience due to the pending K1 fiance visa.
Her parents and my parents knew about the trip before hand. I asked her family if it was ok before I booked anything.
Advice? Tips? Is this something that will come up during the interview? Potential problems...?

Congrats and good luck. There is a ton of helpful information on VisaJourney. I's suggest doing a search for other VJ members that the beneficiary is from the Netherlands and get in touch with them. Get tips, advice, etc.

The US Embassy in New Delhi emailed me saying they mailed out Packet 3 to my fiance's home address more than 2 weeks ago but it still has not arrived. Also, in the email they said I could get my fiance to fill them out, scan them in and email them back. I ended up doing the scan and email route just because it is a lot faster and easier. Am I supposed to receive a confirmation email saying they have received Packet 3?
Does anyone have any prior dealings or knowledge with the US Embassy in New Delhi that could shed some light on this? Another question is how long does it take for them to process Packet 3 and when should I or my fiance expect Packet 4? Also, is Packet 3 just the DS-230 Part I form and the Applicant's Statement? That's it? Anything else required for Packet 3?

A bit late posting, been out of the country for a month visiting my fiance. Received my NOA2 on Dec 15. Got a letter from NVC, case has been forwarded to the requested embassy. My local congressman's office helped me out. Took 6 months from filing the I-129F to getting my NOA2.

They mainly just wanted the most recent year tax return. So I just mailed his 2011 tax return which has my name on it and also a letter from his company stating that he owns and operates his own business and that I am a dependent on his tax return.
After I sent in these documents in response to the RFE, it went through without any further problems. Hope this helps.
